I've just joined the forum. I wish I'd known about it before. I've claimed my unlawful charges back from Lloyds TSB; gone through all the steps, including making a claim in the County Court. Lloyds are defending the claim and disputing the whole amount. I'm particularly worried because of a similar case a few weeks ago in which a district judge found in favour of Lloyds TSB. I'm on the point of withdrawing my claim (losing the £120 I had to pay) and referring it to the Financial Ombudsman instead. Any advice?

It is fairly standard for the bank to submit a defence and dispute the whole amount. Don't let the case which was found in favour of Lloyds influence your decision, there have been many a success before that and there will continue to be many a success after it too, yours included.


Could you post up details in a a new thread in the Lloyds forum outlining all the details of how you've gone about your claim up to this point and we will be able to see if there are any points for concern.
