      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just heard on the news, all you guys out there that the Consumer group over here, have today demanded that the banks declare their charges with explanations because they are unfair. I missed most of what was said but it will be on tonight, so everybody, WATCH THE NEWS! It gives a lot of hope for us to keep on fighting!!:)

Gosh, I sure am glad, I am not the only one round here who hasn't broadband.The reason why i have problems is cos, my computer starts to freeze up in the middle of everything and then it crashes and i have to start all over again! But thanks anyway, i got Caro's email and attachement.

Thanks all. Getting it all printed out and then I am sorting into piles and then i am now going to personally hand deliver my bundles to the courthouse in N'Ards and then to the Northern S***** ( that's with an es on the end). Sorry for the bad language, but they are costing us a lot in ink, paper, electricity,postage etc and hey! This is just what they cry about in their unlawful charges,-- remember CYNthesys?!!!

Keep a note of all you spend Northern Warrior and slap in a wasted costs order when it's all over. You could even take it to court with you if you get that far.

You, Bankfodder and all the folk on this site are the most kindest and generous people around. If it wasn't for you Caro and Bankfodder and your free advice (though when I win, a donation most certainly WILL be going in) i would have been totally lost and vulnerable as would most folk on this site! I would now rather go to court, because with this MASSIVE bundle that i have, i feel so well briefed that i can handle anything and it angers me to think that all this printing could have been for nothing .:x But now i will indeed put in a claim for my prep work after, of course , i get my money!:lol:

hey,Conlee, I did include these in my first claim (see thread;- nervous v northern bank, though it might be called northernwarrior v northern bank, i canged my name) but in the second the bank has omitted these charges as 'service charges', though personally, how that can be i don't think so! The maintenance charges did they occur after your referral fees and in the same month, cos if so, yes claim them. It is a bit of a grey area, but i would say go ahead, if it is wrong, the bank will just deduct it anyway, you've nothing to lose, everything to gain!!!!!

LISTEN UP EVERYONE!!!!! THE BANK HAS SETTLED AND I HAVE WON!!!!!!!!!!!!!:D :D

I received a letter yesterday, offering me £1208.41 instead of my £1400.00 what with the 8% stat.interest and they deducted £62.61 from the account stating that this was a 'service charge'!! Hmmm! Anyway, my court date was rescheduled to this Thurs.28th June ( at my request), so I phoned them to say,that i would accept this offer but with the daily interest mounting, i am now owed an extra £25.00 in the 8% int. I also said (wait for it) that my prep work amounted to 46 hours in total ( it actually was more if you take in the fact that this has been ongoing since Nov.2006) and at £9.25 I would be asking the judge to take this into consideration. I was then told (cos Ms. Nuala Walsh is on hols until the 7th July,) that the bank would phone me tomorrow morn.(today) Well, they b***** didn't!!! BUT..... when my hubby got home, he phoned me to say that a hand delivered letter from the Northern was waiting for us and when he opened it , they had lodged £2133.41 into our account this afternoon!!:D This covered the extra interest and even though they stated that the prep work did not cover the small claims court they stated:the bank is however prepared to refund the additional interest and to this end and in full and final settlement of this matter we have today credited your account with the amount of £2133.41, which I trust you find acceptable.

Well, blow me down.The bank cannot be seen to admit that this prep work ie.court bundles is not covered because a judge could decide yes it is and award the costs and also the bank would still have to go to court anyway.!!! The moral of this story is GO AND GET IT AND DO NOT BACK DOWN!!!!!!!

As I have said on my thread, i am now going to go beyond the 6 yrs. The stress has gone and I am now ready to begin claiming again!! The news today inspires more hope what with the Yorkshire and Alliance&leicester being made to disclose their charges and explain??? GO FOR IT, THE BANKS DO NOT WANT TO GO TO COURT!!! Well i am now off to start all over again, but at least i have my prep work on file. Do remember, if you have prepared your court bundle and you are offered a settlement, DO ask for your prep time, the judge may award it to you, but if nothing ventured, nothing gained!!:D :D :p
