    • FINAL UPDATE.  I have not posted as the defence were reading the thread.  An agreement was reached on the day of the hearing.   I am unable to go into detail but for those in this position the forum has been priceless support and advice so thank you all in the site team.   for those going through this, follow the process, ignore intimidating tactics and threats and get to the Judge.  They are very supporting of those self representing.   I note her name has gone from the heading of the thread.  Was this them ?  Thanks again.  
    • I'm not sure what the "appeal" system asked but he said he definitely didn't indicate he was the driver so I'm just going to have to take his word for it. Honestly, I don't think the hirer will contact them. I think my brother will tolerate it. I did have a similar experience with another company 6-7 years ago and sought advice on here then to which you guys told me to ignore, I got the exact same DRP letters and then a "Gladstones Solicitor" letter.  After that nothing happened and it died away. Based on my experience with that I assumed the same would happen here but only asked to see if perhaps anything had changed since then.    Hopefully it doesn't get to court but if it did, I feel like we have enough evidence to sway a judge who probably hates dealing with this type of nonsense anyway. Or maybe I'm too optimistic.

    • Meter certification periods re given in The Meters (Certification) Regulations 1998, Schedule 4. From there you can check if they are correct about your specific meter .. https://www.legislation.gov.uk/uksi/1998/1566/schedule/4 If they're telling porkies then you have e clear grounds to tell them to take  hike. If they're correct or if you haven't been able to confirm then you have  few options. You could just keep fobbing them off. In general Octopus can't keep up with demand for smart meters. It took 9 months to get our. So they may not push too hard. Or ask if you can install your own choice of meter. The Electricity Act 1989 cover this in Schedule 7 (2) and (2A) https://www.legislation.gov.uk/ukpga/1989/29/schedule/7 Or fight the them and their enforcement. Or go off supply.
    • We received a copy of the completed Directions Questionnaire (N181) from the solicitors along with a draft copy of their directions. I am on a course today so can upload over the weekend if needed. By 4pm on 16th May both parties must each give standard disclosure of documents by way of list by category. By 4pm on 30th May any request for inspection or copies of docs must be made and compiled 14 days thereafter. I will provide more over the weekend.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Anyone out there to help me, just starting Abbey claim for a friend and only part of the info in statement form. Can someone tell me the code that they use for a charge to be taken ie vq, uq etc etc, cant go any further without this info.l cheers skeggsy

Got bog off letter but with a 150 quid as a good will gesture, they said they are going to investigate the complaint and this will take them 8 weeks! forget it, they have ten days and will still go ahead and file with MCOL. Any takers for what I should expect next.skeggsy

If you can try and file directly with your local court with the N1 form, it is a lot quicker as you dont have to wait for Northampton to transfer it to a court that isnt too busy.

 

Once you have filed, abbey will acknowledge it then send you a copy of their defence, probably along with a 65% settlement offer (which would already include the GOGW they have given you).

PM a mod and ask if they can move this thread into Abbey forums, as said in the PM the general route they seem to take is you will submit at court, then at the 13th day they will acknowledge the claim, 13 days after this you will receive a copy of the standard defence, then nogotiations can start, you are a while off yet, they like to draw it out

Skeggs, what court are you filing at? if it is Hitchin or Luton then dont use MCOL use a downloadable N1 and a proper full POC, otherwise they will you do it again, I am at Hitchin too

thanks Lula, thats interesting in St Albans, have done MCOL now, what do you mean they will do you again dont understand do you mean it will take longer> was going to do the n1 and got it out all ready but cos all my other claims won were via mcol i was more confident doing it that way, despite knowing that i could put less info in. My claim was moved to st albans county court last time with Lloyds and looks like we have won prior to court so hoping that the judge at st albans isnt too fierce although he did insist on a aq last time when the mcol said it would be dispensed with.

Skeggs, St Albans and Hitchin are the most likley courts to get you to do another one lol

 

Dont worry, if you get anything saying that they dont like the stylised particulars of claim. there is loads on here to help you, i am in Hitchin court and learnt the hard way lol

just thought would let you know checked mcol and the claim has been acknowledged on 26.7.07. Just heard that all courts waiting on report from latest OFT? and are staying cases? anyone else knowledge of this and why and the impact it will have?

In light of my recent win with Lloyds (skeggsy v lloyds) will be putting together a full poc for anticipation of mcol transferring to my local court. This is the last time I will be filing via mcol for that reason. What can I expect next from Abbey?? a defense? anyone got a good thread I can take a look at to see what the content of their defense will be?

Hi Skeggsy, It's a common misconception bought about by some ill-informed journalists, but all cases are NOT being stayed. The banks will probably , in light of the Test Case, request a stay, but it is down to the local District Judge whether he or she grants it.

thankyou the case will be eventually moved to my local court and i know for a fact the dj there will order a stay as she can be a little difficult at the best of times. i also need to get onto a full extended poc in readiness. just wanted to know the score with abbey claims, they acknowledge via mcol and had no paperwork from court or abbey to say its been acknowledged, what is likely to be the next move in the next 28 days, take it they dont allow judgement to be filed and iv heard that one should be a little hesitant at rushing in for entering judgements.all anticipatory advice welcomed.skeggsy

After reading some threads where they got lucky with the abbey negotiating, decided to e mail Inga and see if she would go for it, decided had nothing to loose as the oft will mean a stay for sure and poss a long long wait, Got e mail back saying thanks but no thanks. just cant help some people can you! drat!!

Hi Skeggsy. I would carry on as normal. Have you contacted the court (your local one if it's been transferred) to ask them if a stay has been requested by Abbey? There's been plenty of templates udated recently for contesting a stay, so all you can do is carry on an hope that the judge is persuaded to throw the stay out.

 

Going back to what Lula said, Is your local court Hitchin or St Albans? The judges there seem to have a problem with the lack of detail on MCOL Claims. Perhaps someone else can advise on this as I don't have any direct experience.

Sorry but had to post a new thread to get noticed..... my thread skeggsy v abbey is just not getting the replies and need a decision by tomorrow morn if poss, my day 28 is tomorrow and had no defense offered. I have had letter from abbey stating that they have requested a stay from the court but had no correspondance from the court to this effect, should i enter judgement tomorrow and what is the implications of this. any replies appreciated so i can make informed decision. skeggsy

Only that they will argue it and request a set aside (eventually, when the test case is over) they will probably get it granted and it will take longer.

 

On the other hand, when the test case is over, they will probably have to pay out anyway. So it really is your call.
