    • Your concern regarding the 14 days delivery is a common one. Not been on the forum that long, but I don't think the following thought has ever been challenged. My view is that they should have proof of when it was posted, not when they "issued", or printed it. Of course, they would never show any proof of postage, unless it went to court. Private parking companies are simply after money, and will just keep sending ever more threatening letters to intimidate you into paying up. It's not been mentioned yet, but DO NOT APPEAL! You could inadvertently give up useful legal protection and they will refuse any appeal, because they're just after the cash...  
    • The sign says "Parking conditions apply 24/7". Mind you, that's after a huge wall of text. The whole thing is massively confusing.  Goodness knows what you're meant to do if you spend only a fiver in Iceland or you stay a few minutes over the hour there.
    • Hi and thanks It looks like they ticked all the boxes to me but I'll try and upload the notice. I was wondering if a witness to late delivery might be considered proof - I'm assuming they posted it as normal but Royal Mail stuffed up delivery. If not then they're really saying it just has to be posted within 12 days of the incident, regardless of when it is received.     • ROFL - dont get upset just because someone (quite a lot of someones) dont want smart meters - well unless you get paid for it .. in which case ...   I assume you haven't been with Octopus long enough to be on one of the very long fixed price tariffs they offered before the prices went bonkers .. and that you dont use your electricity in the evening/lunch time if you think the 'agile type tariffs are good value .. let alone worth installing a smart meter for - high price a good disincentive for an evening cuppa eh? Let alone all your computer/tv etc time in the peak price evening or lunch time. - and boy do those peak prices instantly hammer your bill when those Russian and middle eastern issues kick off.   I would only have considered a smart meter if solar panels had been an option for me - but roof is oriented completely the wrong way. Oh - and My opinion hasn't changed since the smart meter trials 40 years ago, because neither have the issues (well not enough) but I'm happy for you. Be happy for me.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I'm fairly new to this site, but i have read many threads where people are clearly becoming disheartened with their financial situation and the day to day fight with the DCA's.

 

This may already have been done, but maybe those with success stories ONLY to tell would consider posting on this thread so that it gives the rest of us more hope and inspiration, and a reason to fight on?:D

 

I'm not the greatest with computers so I apologise if this has been done before.:rolleyes:

Well I'm doing quite well.

So far I've had 6 DCA's give up on me, either by passing it back to the original creditor or just stopped contacting me.

Ok in that number are 2 that have simply passd the debt to another of their trading names, but I think it still counts.

I always ignore their first letter just to make sure they have enough information and it's not just a fishing excercise.

After that I put the debt to the test, so it's CCA time.

If I'm in a really evil mood, especially where charges exceed the debt, then I call them and have some fun. Of course this ISN'T on their 0870 number, but more normally on a freephone one.

Thank gid for SAYNOTO0870.COM - Non-Geographical Alternative Telephone Numbers, sometimes takes a bit of work, but it's well worth it in the end.

 

There is no point hiding from these people and I'm so glad I have found this site as it has helped me get my life sorted and I'm now working my way through some serious debts that are very nvolved indeed.

 

If you have debts it is better to face up to them and get them resolved one way or another, even if it means paying some nasty DCA.

ok, seriously, I CCAd global debt recovery a couple of months ago. They sent me a screen print out. An thats all. They said that is all they could supply. due to the age of the debt they said it would be difficult to get hold of at this stage. Anyway since then not heard a peep from them. apart from they would hand the file back to the original creditor. And not heard a word from them either. I also SARd them as well. And the bank. They are now out of time so time for reporting them me thinks. Global said they were acting on behalf of FV-1. even though they would not give out their address. said it was confidential. Naughty peeps. x so at the moment i am happy on that one.

Do I take it then that plan B - the dreaded "B" word is now out of the window and you are going to take them on, or is Plan "B" still there?

And, i also did an Sar for my dad for a car company with whom he bought a car from. He is retired and disabled. And almost 80. He did not know any better, but DCAs being the people they are thought they were onto a goodun with him. That is until i told him about CAG. I did the letter for him and sent it off. The DCA were pushing for more money than he could afford. Since the letter they have backed off and apologised saying a mistake had been made and the amount he is paying is ok. As is my name. My head is smashed with everything. And with the thread starter, i can sort every one else out but useless at sorting me out. But hey that is why we are all here. To help each other x

Smashedbobo, what is this about the car?:o How much were they wanting him to pay? And does the old man's other half know about it? Can't it be got rid of?

 

Start another thread on that if necessary, cos this is for success stories and that is a partial one I suppose. (Its alright, i know smashedbobo...you just have to keep her in line!!! (joke SM)

It was got rid of years ago. He was on mobility at some point but he decided to an HP. Was reposessed. I took on the collection agent for the car company at the time and paid what i could for it. They then came to me for a while. you the thing. We have a name so lets use it. Any way he has been being paying 4.00 a month for it. And NO the other half does not know thjat i am aware of. At least i hope not. They sent my dad a letter saying he was behind. He has been writing to them about his situation probably every couple of months when they have contacted him. It was only when i popped in to see him at his home did i see all the letters he waas writing. Was like war and peace. When i saw them thanks to this site i was a little ore informed and told him not to send them. I did the cca and sar instead. so far sogood. everything ok. The only thing i sooooooooooooooooo pleased about is my mother so far is computer illiterate. I HOPE.

Oh i think people are bothered. The problem is that with DCAs is that they are soooooooo long winded. But what goes around comes around. Read some of diskmandaves other threads. I think it just going to take time for folk to put up the thucktheth thtories up. Me got a lithp. I dont think tho

It's hard though facing up to the inevitable isn't it? I can be a bit of an ostrich, although i know i have to sort out my finances. I'm lucky that I have a good job, but the stress is still bad and the WHAT IF's do my head in. Well done you though.!!!!!!;)
