hi, firstly thanks for the help on this forum and template letters etc! Posted first letter to Abbey and received a standard 'Dealing with complaint' letter two days after saying it can take four weeks. Should I still send the LBA on the 14th day or wait for another response?

This is your claim so you decide the timescales. Send the L.B.A. after the 14 days have passed. Don't let the bank try to dictate the way your claim proceeds, it's you who's in control of this.....NOT them!!

Hi all, im just about to send my LBA and (although I may have been stupid) I missed off the interest amount on the first letter. Now Im about to send the LBA I need to know what Im asking for in regards to interest. I just need someone to claify it for me as my brains not working due to a cold.

 

What interest do I include - is it the interest amount that they show as a charge on my statements each month when I go into my overdraft or is it on the amount of charges each month - if the latter whats the best way of working that out? Should I get the amount of charges each month and work out the interest at the overdraft rate for that month on that amount....does that make sense??

Hi Dazbot

 

With regards to the interest you can claim there a a couple of options.

 

The overdraft interest is not claimable as a whole but you are able to claim a proportion which is deemed to be in direct relation to the charges incurred on the account. You should enter all the charge details into one of the spreadsheets as this will do the workings out for you. This spreadsheet will also act as your "Scedule of Charges" which should be sent at each stage of your claim as this is the direct breakdown of what you are claiming.

Once you reach the stage of filing your claim through the courts you are also entitled to claim 8% interest under Section 69 of the County Courts Act.

 

The Simple Spreadsheets will work out the 8% for you whereas the Advanced Spreadsheets will calculate both the O/D interest and the 8% interest.

 

Remember to omit the 8% part from your schedule for the early stages as this is only claimable at the court stage.

thanks for the replay but Im still a bit lost, I have filled in the date/charges/amount on the spreadsheet - but with the interest Im not sure still what Im putting down. The 'INTEREST CHARGED' is this the amount that is shown as 'overdraft interest' on the statement? If so should I be putting down the interest which is shown on the next months statement, which relates to this months charges?? Sorry Im confused!!

 

Also Im not sure if we have blown it or not, we missed a £100 worth of charges on an old statement. If I put a new figure on the LBA will it be ok, what can I say?
