Hi Everyone,

 

I've just started my claim against Abbey and thought I would post my progress as I have found reading about other peoples adventures very helpful.

 

1/6/2007 Received details of charges (after a bit of a delay).

Prepared spreadsheet. Amount to claim £2,468 (8% Interest not included at this stage).

 

5/6/2007 Sent Pre-Lim letter by Royal Mail "Recorded Signed For"

 

7/6/2007 Received standard letter from Banking Specialist Team including "How to complain" leaflet ( I think they should just print the CAG website address in big letters on this leaflet!..lol..it would certainly be more helpful!!)

 

Now waiting 14 days before dispatch of Letter Before Action

 

Does it look like I'm doing things in the right order and not missing anything out?

Any comments gladly received.

 

P.S.

Thanks to all of you in this forum for sharing your info and experiences and to the Mods for their excellent advice and commitment, it spurred me on to make my claim :)

Looks good so far. You''ll get some sort of "good will gesture" offer, Pahh!!!!! "We laugh in the face of good will gestures" . Mine appeared in my account before I had the chance to decline it.

I used the MCOL website to start my claim. Then it was transferred to my local county court. Plenty of advisers on this website. It spurred me on and THEY were ALL right. The Shabbey National rolled over after 10 weeks from my initial letter and refunded in full.

 

I have just contacted them today for ignoring another issue and they have refunded another £40.00 for phonecalls. They really are The Shabbey National.

 

Just as an aside. I'm having a nice patio built with my refund and I'm going to send them a photo when its finished. I'll raise a glass to the Shabbey when it's done.

 

Go for it, YOU WILL WIN.

if you send me a pm i can help you and see if your doing anything wrong as i work in one of the abbey mailrooms and see ALOT of these letters

 

 

So that makes you able to tell other people not to claim interest when they should....

 

which is exactly wht you have done on other posts, there is no defence for abbey or their employees who try to dissuade people from claiming the money they are due

get ready to file that claim at court, they wont settle yet, they seem to love leaving it till the final day to do anything, and they take no notice f you till you start court action.

Update:

 

LBA received by Abbey on 04/07/07.

 

I received standard response letter ( " We are currently investigating you claim...it is taking longer than expected.....would like to reassure you that your complaint is very important to us" ) on 07/07/07.

 

Preparing Particulars Of Claim -N1- form, to be sent on 17/07/07.

 

Just a quick question for anyone. I haven't got the dates for when the account was opened and closed, so I was wondering if it would be better to phone them for the dates or write to them asking for the dates quoting Data Protection Act, S.A.R. etc ?

Update:

 

Particulars Of Claim -N1- form sent 17/07/07.

 

Notice That Acknowledgement Of Service Has Been Filed received from Court on 8/08/2007. (Abbey filed their Acknowledgement of Service on 7/08/2007)

 

Abbey has responded to the claim indicating an intention to defend all of the claim.

 

Abbey now have 28 days from the 7/08/2007 to file a defence.

 

I'll wait to see what happens next :-)
