    • In terms of "why didn't I make a claim" - well, that has to be understood in the context of the long-standing legal battle and all its permuations with the shark. In essence there was a repo and probable fire sale of the leasehold property - which would have led to me initiating the complaint/ claim v SPF in summer 19. But there was no quick sale. And battle commenced and it ain't done yet 5y later. A potential sale morphed into trying to do a debt deal and then into a full blown battle heading to trial - based on the shark deliberately racking up costs just so the ceo can keep the property for himself.  Along the way they have launched claims in 4 different counties -v- me - trying to get a backdoor B. (Haven't yet succeeded) Simultaneously I got dragged into a contentious forfeiture claim and then into a lease extension debacle - both of which lasted 3y. (I have an association with the freeholders and handled all that legal stuff too) I had some (friend paid for) legal support to begin with.  But mostly I have handled every thing alone.  The sheer weight of all the different cases has been pretty overwhelming. And tedious.  I'm battling an aggressive financial shark that has investors giving them 00s of millions. They've employed teams of expensive lawyers and barristers. And also got juniors doing the boring menial tasks. And, of course, in text book style they've delayed issues on purpose and then sent 000's of docs to read at the 11th hour. Which I not only boringly did read,  but also simultaneously filed for ease of reference later - which has come in very handy in speeding up collating legal bundles and being able to find evidence quickly.  It's also how I found out the damning stuff I could use -v- them.  Bottom line - I haven't really had a moment to breath for 5y. I've had to write a statement recently. And asked a clinic for advice. One of the volunteers asked how I got into this situation.  Which prompted me to say it all started when I got bad advice from a broker. Which kick-started me in to thinking I really should look into making some kind of formal complaint -v- the broker.  Which is where I am now.  Extenuating circumstances as to why I'm complaining so late.  But hopefully still in time ??

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Lloyds TSB deducted over £1500 from my account in the past three years in overdraft excess fees and unpaid S/O and D/D's.

 

Before hearing about this site I wrote in Feb this year requesting a refund.

 

Got a letter back from David Just refusing any refund and saying "I accepted these terms when I opened the account" and also suggesting I ask the Financial Ombudsman to independently review his decision. Oh but I "must must do this within 6 months of the date of his letter". (Why?)

 

Wrote again this month asking for a refund but this time (having found this site) now know I can insist they tell me how much exactly they've deducted in the past six years.

 

Got a letter back from Andrew Watkins saying there is "little I am able to add to the previous letter" although I do respect your opinion about our charges". He also suggested I contact the appropriately initialled FO (as I'm sure that's probably the sort of answer I'll get from them). So far no mention by LTSB of the back-data I asked for.

 

Will now give them 40 days notice to provide the data. Then go from there. Here goes....

That's the same person I got my get lost letter from. Did he also tell you the bank wouldn't be replying to anymore letters you send? He didn't answer my query about charges applied that shouldn't have been even using their twisted justification

Being the lazy sod I am, rather than having to keep trotting off to the letter box every few days, I'd like to try to do my banker-bashing by email.

 

But does the multi-billion-pound conglomerate, that is LTSB, have email yet?

I must be a bit fick!

 

I keep reading comments here about using the LTSB letter templates and also the spreadsheet template, for working out how much I've been overcharged.

 

So I've done a general search for them and another one in the FAQ's but I still cant find them on this site.

 

Put me out of my misery somebody, please.

Would try, where possible to stick to the traditional format - many banks will refuse to communicate via email..

 

Also it is helpful to have a paper trail - and recorded delivery for particular letters such as the LBA should you reach the litigation stage - then you are covering your behind..

 

You will find it may well save you time in the long run. Laziness is NOT a virtue!:)

HI Notlam

when i started my claims i had to decide email or letter.

 

I felt that when preparing evidence for court i have all paperwork in order, all postage proof, any letters they send me that i feel are inadequate i have highlighted and attached as necessary and i copy everything.

 

At anyone time i can pull a folder, Cap one, lloyds, mastercard, and there in full order is everything i need.

 

It seems to also gives a whole over view in my mind if that makes any sense.

 

and stops any chance for computer breakdown, and internet down on dead lines there is a case on here where a member lost all thier files :o (he still one though)

 

Hope this helps when you need to start that engine;)

I have banked with Lloyds/Lloyds TSB since 1975.

 

According to the statements since 2003, the bank has charged me over £1,500 in Overdraft Excess fees, Unpaid Standing Orders and Unpaid Direct Debits.

 

If this is what they've stolen from me in 3 short years, it makes me wonder how much they've got away with in over thirty.

 

I appreciate getting hold of all the information over such a long period would be hard, but does anyone here know where I stand by law?

 

Am I entitled to ask them to provide data going back more than six years?

Welcome aboard

 

The reason why 6 years is mentioned is the Statute of Limitations Act - basically this states that you can only 'go back' 6 years to resolve issues.

 

However, there is an arguement (I will keep this short) that you should be able to go back further, because we were only recently made aware of the fact these charges could be unlawful.

 

When requesting a list of charges, it might be wise not to state "from XX/2000 to date" and simply leave the request as "during my banking business with you"- or words to that effect.

 

Some users have reported being supplied with statements further back than 6 years, and others who already had them have decided to go after the lot.

 

It's still a relatively new concept for us, and I don't think any cases have yet reached settlement (for those requesting more than 6 years).

Letter to LloydsTSB (specific details changed):

 

 

Dear Sir or Madam,

 

 

I refer to the letter from your Mr. Andrew Watkins, Assistant Manager, dated XXXX 2006 and am disappointed that you did not agree to my request for a full refund.

 

You will note that my original claim was for £1,498 being the unfair charges dating back ONLY three years to XXXXX 2003.

 

In view of your failure to agree to my request and your failure to provide a full refund I have now decided to claim back all such charges made, with interest to be added, dating back the statutory six years.

 

 

My claim will therefore now increase substantially and will probably be somewhere in the region of £4,000 for the entire period, after interest is taken into account. I am also considering my legal position regarding all such charges made throughout the entire 33 years I have held an account with you. This will of course inevitably result in a much higher claim ultimately.

 

 

I sent a Subject Access request on XXXX 2006 and you have 40 days from that date in which to comply. I therefore look forward to hearing from you and to receiving this information by the XXXX 2006.

 

In summary, as stated above, you should expect my claim will now increase substantially. I am confident it will increase yet further once all the charges you have made for the entire period of my banking with you is calculated.

I expect you're right about the six year limit, although if it went to court (which it wont, because they'll cave in) I wonder what would happen.

 

If they've been stealing from me for 31 years, why should they only have to pay me back for the last six years, assuming I can prove it?

 

They might not have to provide data going back further than six years but who knows what I've got stored up in the attic???

 

I'm like magpie when it comes to keeping anything - even including old bank statements!

Lloyds TSB have just provided me with all my data going back to May '96.

 

Through 96, 97 and 98 they were charging me £7.00 four or five times a month and were calling it "Unauthorised Borrowing Fee". This fee went up to £10 a time in September '98.

 

Then it got more serious when they started calling it "Overdraft Usage fee" and the amounts ranged from £25 - £75 a time. After that they topped it up with "Unpaid D/D" fees and "Unpaid S/O" fees of between £30 - £245 a time. And for good measure they threw in the odd "O/Draft Excess fee" now and again at £30 - £80 a time.

 

All together these charges amount to just under £3,000 in ten years. I dont ever recall agreeing that they could take this money from me and there's nothing in my data that said I did. Plus they were also charging interest and a monthly service charge of £8.00, which presumably is not reclaimable.

 

Am I able to ask for charges back that are more than six years old?

 

Are all these charges unlawful and therefore reclaimable?

First, the 6 yrs query. You need to look for the Bankfodder thread that relates to that, and decide for yourself. Or you could go for the lot, study things some more and when they offer to settle, but tell you they'll only pay the last 6 yrs, you can then decide wheter to pursue the lot or not, or accept the 6 yrs...

 

The amounts: Yes, the lot except the monthly service charge, you are quite right.
