    • Thanks dx.    Would I not SAR Asset Link Capital as it was assigned to them in 2016 (according to the POC)?   To provide some context, I'm familiar with attending hearings etc and have fought and won a couple of battles.  I don't mind risking a couple of K in extra costs to give it a shot but I need to feel that there is at least a chance of success.   The card was originally an Egg card taken back in 2000 and then sold to BC who then sold to Asset Link Captial (no5) Limited.   When I did a CCA request to BC back in 2015, they provided reconstituted T&C's that post dated when I took the card out with Egg and a Credit Agreement for BC (which was clearly made up as the account was with EGG!).   Appreciate you are being careful to provide advice and not push someone to do something that could end up costing more money, I'm up for the fight though!

    • you wont get eric and that doesn't solve your problem as thats mainly to do with private parking set asides really as most judges now view PPC Backdoor CCJ with dissent and grant it regardless.    i absolutely hate link and paul burrell he built up a £1B+ empire of wealth solely by conning debtors into paying debts they mostly didn't even owe, but in this instance you are on very shaky ground.   me pers i'd not even debated it and i'd just gone for it win or bust. once you get the set aside it should be plain sailing.   but you came for advice and i can't not be truthful here.   the only otherway to better gauge you chances is to SAR Barclaycard , get everything they hold. that will show you the cards that Link will have to play with , they might well be pants.      
    • I have read everything about these cowboys but need a little advice. I was issued my fine on 9/12/19 but only received a dated letter on 11/01/20.   Ive had all the threatening letters from DRP and now Zenith and ignored them all. My wife was driving our car but yet its my dad who's getting all the letters as he's the registered owner.   They managed to get my number and rang me today, I busted them for being the same company but the guy on the phone was super aggressive.   I said to him Ive spoken to Trading Standards and they told me by law a ticket has to be issued within 14 days of the offence. But as you can see it was over a month,   I said this to the aggressive dude on the phone who actually knew way to much about parking fines. I think they are actually under the same umbrella as VCS also.   He was firing back that the law doesn't state that and I should look at 2012 laws or something and the DVLA, and it takes time to get my details from the DVLA to issue my charge????   Does this mean anything to anyone pls Regards   Stuart

      I bought some clothes online in may through Evans and paid through PayPal
      returned them all seven days later
       
      I waited the 14days for my refund and no refund came
      I put in a dispute through PayPal but I didn’t get any emails to escalate the case - PayPal closed it. 
      evans said they couldn’t refund the money because PayPal have cancelled the refund because of the open dispute
       
      I contacted PayPal
      they said the dispute had been closed but Evans at no point had attempted a refund.
      fast forward to today
       
      I’ve got copies of numerous messages sent to and from twitter messages as it’s the only way I can contact them
      I’ve also contacted their customer service too
      all I get is PayPal have cancelled refund because dispute is still open.
       
      I have proved that the dispute is closed
      I have got an email saying that if Evans sent the refund they would accept it
      but up until the date I got the email they have not once attempted a refund .
       
       I have sent them a letter before court email
      I have even offered to have the full refund as a gift card just to get this sorted !
       
      I’m literally at the end of my tether and don’t know where to turn next !
       
      i suffer with mental health issues and this is affecting my health and I’d saved the money for a year to buy these clothes as I’m on a low income .

yes, did it yesterday - it should be in your inbox of private messages - above the thread on the right side - blue box saying welcom molly1959 - just click on private messages - it should be there - if not - let me know i'll resend. it's not the full mcol - just the particulars of claim which has to be just so...and is a very small box with limited space on the mcol

 

ok, just checked - not in my sent items - so have resent it now

yes, it's in that getting mcol right thread - after you file - you send the court 2 copies of your breakdown - and when dg acknowledges your claim you send them one.

Thanks yet again sorry to be a pain, is this the address for the bank in mcol 8 canada square london e14 5 hq Thanks for the link looking at it don't think i have to pay court fees:) I am doing my daughters as well she is with hsbc might take a while but i will get their, i am writing everything down so i don't forget, or write the wrong thing.

that's correct, molly, if you are excempt - you can't use mcol - you must file the n1 at your local court. so you can use the much longer particulars found in the template library. and the copies of your breakdown for the court will go in with the n1 (on the positive side of the n1) you don't wait 2 weeks for mcol to transfer you to a local court when they defend at the end of the 28 days as you are already dealing with them

I rang the court i do have to pay the fees as i am still getting paid from work. So i have used mcol for my daughters just finishing sorting hers then will start mine, have i got this list of charges right.

 

Name xxxxx

HSBC BANK

SORT CODE XXXXX

ACCOUNT NUMBER XXXXXXXSCHEDULE OF CLAIM FOR CHARGES

FROM XXX TO XXX

Then listed them as

overdraft charges, card misuse, unpaid d/d charges and put the amount with which ever applicable. I then send a copy to the court to be put with her claim is that right. I have just redone my charges with the 8% on but i have found a £10 card misuse that i shouldn't have had not sure what to do about it.

Don't worry about the card misuse fee. DG will pick up on that when they make you an offer and just deduct it.

Hi

 

Have i done everything ok with my daughters claim its the thread above this one thanks. Also on the letter to the court it says how much she is claiming do i add the £120 court fees she has paid today.

Well finally done it did my daughters yesterday and just finished mine so it's ready to do. I used mcol it was easier than going the courts cause still not allowed to drive.

I have sent 2 copies to the court with the letter in the getting mcol right.

That was right i think. I didn't ask for the interest at the daily rate as was not sure what it was will that be ok?

yes it will be ok - on the amount you are claiming it works out at about 0.22pence per day so if it lasts 4 months say it is £27.00 approx so it is not a great deal to be missing.

Hi

Today i received notice of acknowledgement think iv'e got it right i send a copy of our charges to hsbc solicitors looked at the template i am only claiming the 8% interest so i don't copy the red bits about interest on my overdraft? Also at what stage do i ask to be paid by cheque?

not had to do it yet but i think when they make you an offer or settle in full - then you can request a cheque.

 

hopefully someone will confirm this for you - i know there is a letter for this on the forum somewhere.

When they make you an offer, in the acceptance letter you send them you can stipulate that you will only accept the offer if it is paid to you by cheque. You can also put this in your nudge letters to dg.

Thats great thanks but do i send hsbc solicitors a copy of charges and am i right in deleting bit in template about interest as im only claiming the 8%?
