      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Big thaks to MILKTRAYMAN for your help in a simple thing ie. how to navigate and get on to the site. Now i`ll be able to keep you all posted cus i`ve a funny feeling my claim is somehow going to go `tits up`. I`ll know more Friday8th.

First of all i`d like to say aBIG HELLO outthere as its took me ages how to work out how to start a new thread !! I started using M.S.EXPERT site at first but i now know this one has better information how to go about your claim succesfully. I`m not knocking Martin cus without seeing him on tele i would never have dreamt taking on Nationwide. However, I`ve been reading up on this siteand realised that the folk hear have some really useful info `HOW NOT TO SCREW UP YOUR CLAIM`. Anyhow, i`m at the stage of waiting for N/W to file their defence by this Friday 8th June. Only oe problem, I copied M.S.E. template for my claim which i feel is`nt as good as C.A.Gs also I sent my `Schedule of Charges` off to the N/W but did`nt include them with my claim,,,, So now I have to wait with baited breath until Friday.. By the way ,mno in my title stands for Money no object. That was my old `nickname` Those days have long gone!!!!

Hi and welcome to the CAG site.

 

You've definately taken the first step into claiming back what's rightfully yours.

 

Spend time reading the FAQ's and the Step by Step guide as this will stop you making mistakes along the way. Use the letters and spreadsheets in the Templates Library as these have all been tried and tested in successful claims. Read as many threads as you can especially ones that relate to your bank. This is a SELF HELP site and won’t do the work involved for you. However, everything you need is on here somewhere.

 

Don't be afraid to ask any questions, no matter how stupid they may seem, but please remember that any advice that you receive is normally based on experience only and that you should seek expert advice if required.

 

Once you start the process of your claim remember to open a thread in the relative bank forum, this will enable you, and others helping you, to keep track of your claim.

Hi you need to send a schedule of charges to MCOL this link will help here. I would expect them to enter a defence at the last minute, this is their standard tactic. Once they do we can see if there are any further changes we need to make. Post up your POC on here please.

Goodmorning PARKVALE and LIVELYLAD, as already explained, I copied MSEXPERTs site templates which are not as good as yours. My claim was made in person in Birmingham C .C. My claim was issued on 09 May...served on 11thMay..therefor they have until this Friday8th June to enter their defence. Do you think I should add `S.o.charges` as an ADDITION at this late stage or just wait till Friday now for them to enter their defence.

Also, do you not think it would be a good idea if we had in our armoury SUCESS COURT CASES with details of which courts they were obtained. Especially, in the light of `the Berwick case`. This would surely contra the argument in as much as Banks hav`nt paid out all that money if they feel they were in the right.

Hiya,

 

Can I just ask as Nationwide now seem to be actually putting in a defence what would be the next step if they do not pay up, as most people at this stage just seem to be waiting for the money to go into their accounts! What happens if they decide not to pay up, does this means it goes to court no-one seems to have got to this stage YET!! They have until the 13th June to put in their defence with my claim and nothing heard as yet (I used the N1 way) and nothing in the account can someone just prepare me for the next stage JUST IN CASE.

you need to prepare yourself and dont get complacent thinking it wont go all the way cus it might just do that. DO YOUR HOMEWORK AND GET PREPARED. There are loads of places to get info. i`ll let you know who to look up.

WELL HERE GOES! This morning got my post as usual at 12am. only to find a letter from NATIONWIDE. TOo be honest i thought it was just my monthly statement. SURPRISE, SURPRISE. They said they had put into my account the amount I was asking for plus interest plus £250 court costs. All this with one day to go before they had to enter their defence. I still cant believe it that I actually got my doh. I always consider to be so unlucky. At this point I would like to thank EVERYONE subscibing to the CAG network. Without knowledge we would be nowhere.Couldone of those LOVELY MODERATERS kindly move my thread on to the SUCCESS STORIES. After quickly looking on the site today there seems to have been several SUCCESS STORIES today..............I still am smiling after several hours all the way to the bank.

I can't believe thay have paid you all that money before you deadline!! Did you go through MCOL or N1 way. My claim is for nealry £6,000 and still hoping that ehy will pay up before next Wednesday (everything crossed) but thank you for the advise about the next step if they dont pay up.
