Hi Lynn here just joined today. Trying to claim back £3060 from Lloyds awaiting response from second letter. Getting close to starting court proceedings and am getting scared. What do I need to repare for court. Looking forward to hearing from you. Lynn

Thanks Martin for moving me to the right thread, all a bit confusing to begin with. Can you or anybody out there tell me what I need to prepare for court, any advice welcome losing sleep worrying about the prospect of going to court. Thanks Lynn

Hi Lynn, Guiness book of records no longer allow staying awake the longest records as they are bad for your health, so get some sleep. Court is unlikely. Have a look at these if you haven't already http://www.consumeractiongroup.co.uk/forum/faqs-please-read-these/31460-example-step-step-instructions.html. Also look in the templates library http://www.consumeractiongroup.co.uk/forum/bank-templates-library/ for info on form filling for MCOL and N1 claims

I won my case with lloyds tsb for £1486.00. Wait for their reply. Their reply will be "get lost". then Fill in the Small claims court form & pay the £120.00. CAG has notes on how to fill in the form. missmarcy

hi missmarcy thanks for that. Did you do the claim on line or use the N1 FORM. Sorry this may sound stupid but what is CAG. Also did you win your case prior to a court date. Thanks Lynn.

CAG=Consumer Action Group, sorry. I used the N1 form. The information needed to fill in the N1 form is on this website. I paid £120 & popped down to my local courts with the N1 form & the money (I'd wrote to them THREE TIMES asking for my charges back but they had replied - no!). At this point they will sit up & take notice.

THANKS MISSMARCY SEEMS TO BE BETTER TO DO IT THAT WAY THAN ON LINE. Lloyds have got 4 days left to write back to me before my deadline, so heregoes, thanks for the advice LYNN

hi just wanted to let people know started court proceedings Lloyds acknowledged on the 18 july and stated they would defend. Today had a letter from Lloyds solicitors stating that they are no way liable but as a good will gesture they will pay us the full amount of £3745.75 including interest and court fees as long as I reply and agree in ten days time. However I am not going to stop court proceedings untill I HAVE THE MONEY. I THINK THIS IS VERY NEARLY A SUCCESS.

There Are Lots Of Conditions To This Settlement And Is Probably A Standard Letter As Usual Do I Agree To The Conditions Or Can I Not Agree To The Conditions And Still Hope To Receive The Money. Thanks Lynn

Persoanlly I wouldn't agree to any of them. Most people are advised to send a letter stating that they accept the settlement unconditionally but reserve the right to make future claims if any further unlawful charges are levied on the account. It is up to you of course;)
