Hi there

 

Can anyone advise me on how to claim over £750.00 in Scotland.

 

I want to claim just over £1814.00.

 

I am at the stage whaere I will need to send them the Letter Before Action but I am not 100% sure how to claim via the English Courts as I stay in Scotland.

 

I think the max in the Small CLaims court is £750.00 in Scotland.

 

HELP!!!

Hi, Flipper25.

 

You can claim up to £1,500.plus Interest plus Expenses using Summary Cause. You could also claim through the Financial Ombudsman Service for the lot of your claim, just download their complaint form and post it off. Claiming through FOS saves the hassle of going to court, I believe they have a 100% record so far.

THanks for this advice.

 

Should I send the LBA Letter stating that I will be going via court or FOS or just leave it as

 

"I require full payment if this money. If you do not comply within 14 days then I sall begin a claim against you for the full amount plus interest plus my costs and without further notice"

Hi Scott,

 

I am really interested in FOS route as my claim over 5k beyond 6 years. Is that 100% in terms of all claim elements for each case going through the FOS?

Have claims over 6 years been successful- leaving aside any delays that may have been caused by the banks themselves from the original claim date.

 

Any info much appreciated and will be recirculated to maximise effectiveness.

With my LBA I mentioned both, keeps them guessing. If your not happy with your response from FOS you can still take them to court, but if you go to court and loose, you cannot complain to FOS.

I'm not sure about your question. There is a good thread by Bigmacversus you should read.....it's....Georgemcm v Clydesdale Bank. Or click on Bigmacversus name and read ...threads started by Bigmacversus. He is a lot more clued up on FOS than me.

Charges:£5,156.39 Information Commissioner's Office informed June 12th who wrote to BoS, June 22nd for non-compliance. #1a/c: passed to BoS Senior Review Team. Discovered 2 further a/cs, and 3 Loan accounts. "Goodwill offer" of £7,424.23 06/07/07. Accepted (partial repayment). 20/07/07 Top-up payments of £2,558.10 & £1,154.00

£11,136.33 paid back thus far.

New claim issued: 9/07/2007 for 3rd account: £500+ PRESSING ON!
