Hello all.

 

Barclays offered to settle in full, by letter today, which is great news...

 

However, they have said that if agree, then payment will be made to my Woolwich account. The problem is, the machine swallowed my Woolwich card when the account became in dispute some months back.

 

Can I request that they pay me either by cheque, or into my new current account, or can they just refuse and let it go through to court, citing me as being unreasonable??

 

Help!!!

and yes, this is YOUR settlement agreement which means it only gets settled when they agree to everything you say, paying by cheque is one of the conditions,,just tell them

Got the same letter today! I've got a similar Question my Barclays account is closed but I want my money paid into my other Barclays account. I am going to request this when I fax it over tomorrow. Says I also have to fax a copy of the letter I am going to send to the court??

Get your money in your hand before you even think about notifying the court of discontinuing the claim...Only once you have told the court, then you can send a copy.

 

think about it...

they have a letter of discontinuance with your signature on before they have released any money.....what dyu think they could do with it?

Hello.

 

There is another thread somewhere... I have a court date set for August, and I called him and he sent a letter out for the full amount requested.

 

Back to my original question, can I get them to put the money direct into my new current account, with a different bank, or will it have to be a cheque??

Can you tell us at what stage Barclays have agreed to settle in full with you?

 

Hi, this varies depending on who you manage to get to handle your claim in the Litigation Dept.

It can be anytime from the date Barclays enter their defence right up to 10 minutes before the hearing.

One guy was on the steps of the court house when received the phonecall.

As Dar£n has said it varies, but it does seem that they are in a paying mood at the moment, so it does seem that a call the second you hear a court date, or receive directions from the court that try to force the banks hand, then the quicker you are in getting your money.

 

As has been said on many posts now, the Lit team seem to be very nice, and are, after all, only doing their job - which luckily for us seems to be signing big cheques!:D

It's me being dim... I couldn't work out whether it said that they would not be able to pay into my new Current Account, with a different bank, or whether it would be a cheque only.

 

Should I just put the account details I want it paid into on their settlement letter and fax it back to them?

 

Also, do people normally scribble the confidentiality bit they put on the letter?

Yes, and anything else you disagree with as well!

 

Remember, it's YOUR case against THEM, not the other way around. If they really want those terms adhered to, then tell them they can see you in court!

 

Most people seem to be crossibng that bit out especially, and I think some people have removed the full and final, and replaced with full and final for this litigation (or something similar)

I've also just read that I need to send them a copy of the letter I am sending to the court - I've read somewhere that this should not have my signature on it...

 

Is there a template of this letter anywhere?

Right, I won't.

 

They are sneaky sods for asking for it.

 

They are going to get their letter back with the new (natwest) bank details to pay the money into, and the confidentiality part removed today, and once the money has cleared I will notify the courts and this forum.

 

Many thanks to everyone that has helped me with my varied, and sometimes odd issues...
