Not being allowed to increase customer bills by 40% (of which well over 50% of the new total would NOT be investment) 2. 1 plus regulators not agreeing to letting them do 'things in their own time (ie carry on regardless)

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Applied to the court for judgement against the Halifax in respect of our bank charges, received a letter from the court on Saturday saying that judgement against the Halifax had been entered on 30th May.

 

How long do I have to wait before I send in the Balliffs?

Hi Gary's wife, Julie here, I have already said that I am going to take the camera and the video camera, so I can take stills to put on the site and video to send to the news companys, to highlight that you can get your charges back.

 

I am just itching to do it, I can't wait.;-) :razz:

Gaz, is going to call the court in the morning to find out how long we have to give them, but if you go on how long you have to wait for everything else, next week we should be able to send in the big GUNS via the court, we were saying tonight, if Joe Bloggs get's a CCJ, you can't credit (well not a decent apr), but if your a bank, that doesn't matter, you can still get credit and give credit.

 

I will of course get everybodys permission to film, before doing so.

 

It seems one rule for one, another rule for the other one(the banks).

 

So we will let you know tomorrow.

 

But I will be posting pics or a link to them, just to show that it is not all for nothing.

I thought I'd call Sky to, one morning Eamon Holmes was on about he wanted to reclaim his charges, but did know how to, one of their paper reveiwers, I think he writes for the Sun (I know), is all for the public claiming back their charges.

Well'll find out i nthe morning how long, then I will see what day, their time is up on and then get the balliffs ready and a few days before I'll call all the companies, to see if they want to send repoters and camera crews down to Margate Halifax.

 

We could get Gaz to supply you with tickets to Margate train station, it's not far from their it's a short walk up the hill, to the high street, turn left at the carphone warehouse and Halifax is down on your left handside.

 

I just can't wait, I am so itching from them not to send us the money.

It gets better. I've received a letter from Halifax legal division saying that because I only quoted the account number on the claim form they are unable to find the account.:rolleyes: Anyhoo! I've just phoned a Ms Jamila Karolia at HBOS's legal department, she's claiming that the first they've heard about the claim was when a judgement by default notice landed on her desk. I pointed out to her that I started this claim Nov 06, that they have received numerous documents from myself and the court, and that only now do they decide to write to me.:mad: Ms Karolia say's she's going to deal with it today, I'm not holding my breath.:(

Today we have been into the Halifax in Margate and hand delivered a letter giving till 4 pm on 20th June to pay us the bank charges, after that we will be asking the court to send someone on our behalf to get the money back.:eek:

 

We have a recipt, so they can not say that it was never recieved, because we have the evidence that it was.

 

Now lets see what they do.

Then next Thursday as moneyclaim are only their certain hours, next that morning Bam, hit them with the court apointee, see what they do then.

 

Can't get out of it, unless they pay up quickly otherwise we've waited this long maybe another 14 to 28 won't hurt.

 

Just have to wait a little bit longer for those extra's.
