    • Are you allowed to appeal if you plead guilty?   I know you appeal the sentence, but the criminal record formed from your guilt would surely remain?   I'm not sure if your able to appeal a crimianl record if you plead guilty are you?
    • DX: I did not pursue Link after I got the CCJ amended to monthly payments. Pretty sure the CCJ does not mention reviews, I do have the CCJ somewhere, I will have to look it up in storage. It is as mentioned on the thread you referenced  in your post #28. The Barclays loan was taken out in September 2004 for 60 months! Current Balance remaining approx £2K. On checking back my past correspondence with Barclaycard about this loan, there was a history of them ignoring my letters and offers to pay, and I even had problems in obtaining their bank account details for them to accept my payments! I have received strange correspondence from them too, one referring to insurance which I did not have. They seem very disorganised! Barclaycard told me to pay "Masterloan" a while back and I now receive regular statements and arrears notices from "Personal Loans from Barclaycard" clearly marked Masterloan, they changed the account reference number! I have never requested a CCA on this account. I advised them of my change of address last September, but they are still sending, until today, statements etc. to my old address! I have received 2 letters from Barclaycard Loan today though, not opened them yet!!
    • Yes, a few months ago. They wrote back saying there was no CCA and the debt was unenforcable. I then started gtting bombarded with threatening emails from their 'litigations team' which have been sent to spam. I've now recieved the letter before claim with the PAP form enclosed, but still no CCA or even a letter from them to say the debt is deemed enforcable. Thank you.
    • That's a shame but not unexpected.  I'm not sure about your assumed  questions because I haven't been to court but I'm not sure about not accepting a criminal record. It could be a language thing but it isn't your choice unfortunately.  HB

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

next-CCA turns up after they have committed offence,(30 days) S.A.R - (Subject Access Request) time!

monument -CCA not signed reported to TS for harrassment 1st letter sent TS are useless

associates visa-no CCA

think there might be a pattern here!?:lol:

barclaycard-- N1 put into court

capital one - won

NatWest- won

Feeling right peeved now I can tell you.

just had one of hubby's friends on the phone telling him he thinks I should except the £3000......... bird in the hand an all that!

 

nearly led to an all out aurgument with hubby!

 

I just can't bring myself to except that offer when my claim is now £5600 inc 8% interest. that excludes court costs of £120.

I know having that £3000 now would help us out of this really big hole and would mean I could just whip out and buy another fridge/freezer.

 

But my reasoning is, we do have a credit card we could use! and yes we would probably have to find 1 or maybe 2 months extra payments on the card, but if I win we'll have a bigger payoff and I can clear it then!!

 

Sh*t.... as if this is'nt all difficult enough as it is, without adding this into the mix and causing tention between me an hubby......... feel like poo.

 

Think hubby has conceeded to my way of thinking though..... bless... he does try to be supportive of everything I do.

Tempty do not fall out it's not worth it. Your hubby has not had a look at this site and how things work, let him on for half an hour, let him see what peeps go through and what happens. That's if he will, most men think things just happen! us girls know different, you have to make them happen. You have shut him out and they don't like it, that you can achieve something and without their help. Try and get him more involved if you can.

trouble is he's just left me to get on with it all, so although he supports me in doing it, he has'nt got the first clue as to what's involved (lol think I'm only slightly ahead of him there anyway). so trying to explain to him what's ahead of me, how long it's likely to take, what my chances are and why I think they're so high. is a bit of a nightmare!

we have'nt fallen out as such, just had a slightly heated discusion! we very rarely aurgue over anything! He's just worried, I get that. So am I if the truth be known. I will deffinatly try to get him to have a look at the site tomorrow, he's got another friend of his over atm. they're in the shed doing god only knows what to his bike atm (lol oh well keeps him chiled out, so who am i to complain)

Well get a print off of some winning claims or something, won't he come on here and have a look for himself. Anyway it's not worth a domestic, but in my eyes the money is YOURS you have the right to claim it back. The money has been long gone, if you had not put a claim in it would still have been long gone and to let go so close and lose 1 third of your claim is not on, IMHO.

It's so easy to fall out about money when you're skint.......... and totally fatal as well! Just imagine how he'll feel when a cheque for the full amount plops through the door - cos you can do an awful lot more with the full amount than you can with £3K hun. Don't worry - he'll probably understand it a bit more when he looks at the site. xxx

I'm with you on that one. I don't ever remember telling the bank they could have that money!! and now that I've found out I can have it back I'm certainly not going to settle for only part of it. if anything (oh eck and now the anger is kicking in)..... I'm more determined to carry on and get the lot now!!! just to make his friend look a total pillock and prove I was right

Morning Gang :)

 

well no big supprise, did'nt get any reply from my mail to Mr higley, so it's onward and upward we go :)

 

will be sending a letter of rejection to natwest today regarding the £3000 offer, and will also be sending out a mail to cobbets containing a copy of rejection letter, copy of mail sent to mr higley, respone to CPR 18 (as in don't need it, stop bugging me LOL) and cover letter stateing my intent to file a N244 (as soon as I hear from courts) and of course new copy of schedule! ...... phew that little lot should keep me busy for a bit!!!

 

first job though.......... gotta go buy another fridge/freezer :(

then go recover me grub from up the road in my friends house! Thank god for small mercies in that we have a car big enough to pick one up ourselves!.......... saves £25 delivery!! and means I can at least get it sorted today!!!....... providing I can find one to fit in the damn hole in the first place LOL

well good new's is I found a freezer :) can't get it till saurday though, but no biggie! Also have to have the damn thing delived as some idiot decided he could'nt find his brake pedal and drove at 20 mph straight into the back of us while we were waiting at the traffic lights!!!!. Can my luck really get any worse....... no don't answer that.

Needless to say both hubby and I are now feeling rather sorry for ourselves, both of us suffering with very sore necks (felt perfectly ok at the time though) so looks like it's a trip to the doc's for both of us, just to get checked out. car looks like it'll be a write off as the rear has been shunted forward about an inch and has 2 big creases down the sides. Have to say though insurance company have been diamonds.... within 3 hours of calling them I have a brand spankers mondeo delivered to the door as replacement till mine either gets repaird (doubtfull!) or written off and we get paid for it, They have booked a call for solicitors to contact us (now at the time i called them, i thought that was a bit over the top.....we felt fine) pretty glad about that now. Also Recieved a call from them an hour ago to say they've contacted the 3rd party and that our car will be picked up some time tomorrow. So have to say was impressed.

 

feel like sh*t, can't believe our bad luck! was just very gratefull we did'nt have the kids in the car at the time.

 

intend to get very, very, drunk later (need to laugh, or I'm seriously gonna cry!)

thanks for the hug hun, must admit feeling pretty low, but I'll be ok

 

was pretty funny watching the front end of his car totaly fall apart when we tried to seperate them, my tow bar had compleatly dissapeared inside his car Lol

 

like I said gotta laugh or I'll cry :)
