Thanks Saintly, do you know if anyones actually met one of them in court yet? or had to attend? If i have to go and they don't attend what on earth do i say or do? Oh this really is a little tinsy wincy bit of a flippin huge nightmare!

Yes they have attended. some won some lost.

Some have met on the steps with a settlement

The norm seems to be that they offer the settlement so close to the court date the funds dont get transferred in time which means you have to attend court. personally, I think this is another tactic to see if youve got the round things to follow it through...co sif you dont turn up chances are the judge will throw it out.

 

What I did with my bundle to Barclays was.....Sent it Special Delivery and insured it for the same amount as my claim, so if it got lost or B's claim they didnt receive..bingo Royal Mail pay up the compo for lost mail.. win win...It costs £1 per £1000 of insurance so worth it.

When you send in your bundle, the next day contact them and ask why you havent received theirs.

I've sent it special delivery now, i realise it will land 2 days late with them, but obviously signed for.

 

The court recieved theirs on the 14th day before.

 

If i turn up and they don't or if they don't submit their bundle in time to the court will i still have to prove a case to the judge or does it give me an 'auto' win? And have any of the lit team turned up to challenge yet?

Hi everyone,

 

Not sure if this is up yet (sorry, at work so not enough time to check the whole thread - sorry!) but I have just emailed Sharon Daboul who is dealing with my case and got this back:

 

"I am out of the office until 6th August 2007. My emails will not be checked in my absence. If you have an urgent query, please contact Paul Haut: [email protected]"

 

I've emailed Paul as I have a court date of 6h August and I would hate for my claim to slip though unnoticed!

Sadly so, he ignored every call, email and fax I sent as did the rest of the team then sent a settlement email in error to me! You will be lucky to have anyone on the team tell you about thier holiday dates, the judge I saw on Wednesday differered from the one I was suppposed to see as he is on holiday - we are always the last to know it seams!

I'm currently haviing this trouble with Krysta who is dealing with my second claim. I found that Kate was very good in comparison. I have sent my Court bundle to them, but not had theirs, I have a solitary email from Krysta in reply to one that I sent in June saying that I woud be on holiday, saying that she would be looking at the claim and intended to settle and to contact her on my return, which I did, since then I have had no reply to mails or voicemessages that I have sent or left her.

 

This morning I called every number on the litigation team until someone answered and informed me that she will settle but when seh gets round to it, great eh, my Court date is the 31st July. I'm adding all of these to this to prove that I tried to settle out of Court, following their advices and that it is Barclays who are proving to be the most unreasonable and non-contactable.

Exactly what I did saracen01, even though mine was a pre-lim I still tried to settle out of court but Barclay's seam intent on hanging on until the last minute before they decide to settle, it's riddiculous! The more proof you have the better I think! vbmenu_register("postmenu_1018872", true);

The credit agreement is at best...... crap! no ppi box no enforceable terms

 

just faxed two letters to him asking for payment ...or else!!

Tom Hickley e-mailed me today, case is Monday week 30th July, he says he wants to call me Monday can I leave him a contact number. I will do that, but whats he like on the phone. I'm tempted to not agree anything there and then but say I'll call him back, once he says what he has to say. or should I say that I'm not contactable by phone during the day, could he e-mail his thoughts, that way I have written proof of what he says. Any thoughts out there

not a hotshot lawyer or stubborn or anything

sounds quite young, but reasonable...

 

i dont think anything you say on the phone will ruin your case, as long as you dont get too angry.

Make sure you print out up to date SOC 1st thing Monday and add on Court Fees and anything else you want so YOU can tell HIM what the settlement figure needs to be if he wants to avoid going to Court.

 

My contact with the Lit'n team was very pleasant. It only seems to be Paul Quinn who is lacking in diplomacy so don't be at all intimidated.

Bit of an update, Paul Haut replied to my email and he is now looking after Sharon's work until she gets back.

 

He also illuded to the fact that I only have a directions hearing on 6th August and that they are not interested settling before this - anyone else had a directions hearing that Barclays settled before?

Hi, Yes I had one which Barclays settled, I also had one last month with another bank but barclays were there and settled all the cases on the day.

Hello I have a court date set for 21 sept 2007, i an scared and confused, PLEASE can someone help! I am thinking of phoning the litigation team and asking them to make me an offer instead of going to court. Can I do this? how will the court see this?
