    • DX,   I am In arrears (and maxed out )of one month with several CC companies and am at the risk of being unable to pay hence finding a 3rd party to pay everyone so I don’t have to stress every month finding out how much I need to pay who. It’s draining. Just one simple payment.   In relation to the other question of mine , My main debts are as follows: original creditor : Aqua  Account opened : 26 September 2013 Defaulted : 27/06/2017 Taken over and sold to Cabot sometime after July 2017. amount remaining : £2898 The default for this drops off next year. If I stop paying this will it drop off still or could a new default date be applied or updated ?   Last one was Original creditor : Hitachi Capital Finance. Account opened : 19/01/2016 Defaulted 30/06/2019 Sold to Lowell Portfolio One sometime in July 2019. amount remaining : £4037.
    • The entry and exit times would also indicate no stop was made as likely less than 2 minutes from entry to exit
    • Thanks DX, I think I follow now, thanks for the advice and clarification.   Yes, my partners debts were all taken out while we lived in England. All mine were taken out since living in Scotland, but Capital One and Fluid were within the first 3 months of being a resident in Scotland.   SF    
    • If any of that is because of me, I'm sorry I would never intentionally misinform regarding paying not paying - I did state it was what I would do, because it is, what I did..   Dx's advice is just as easily doable though SF given everything said upto now about dropping to £1 pcm

I will try my best to answer your questions but will inevitably have further questions of my own.   Badtimes123, the alleged debt is a loan from a major bank, which has been sold on. I have no debts apart from the CCJ on my file, I have one credit card which was used purely to help build my credit score - not sure if it actually does - but the balance is zero. I have an overdraft which has not been used in years, a finance agreement on a purchase with no defaults. Ever since the period where I struggled financially, I have made it a rule that I never rely on a credit card, loan or overdraft to pay for things - with the exception of the one item and potentially a mortgage :} Regarding my employment, its the worry of the courts contacting my employers and how this will be taken - I don't think I explained myself correctly in original post.   dx100uk, I will give northants bulk a call on Monday and request that information. on Clearscore it has the CCJ as being discharged. I have the case reference number from that report and it matches the one on the AOE. I can provide this is required and safe to do so. I will post on Monday and update on the situation.   In the mean time what can I do to stop this issue progressing further, will my call to Northants Bulk allow me to delay/extend the AOE?  Additionally, why has it taken them so long to contact me and how can they file for an AOE (creating additional costs) without out actually contacting me?   Again, thank you for taking the time to respond to my predicament. It is very much appreciated. If you require any further information let me know, otherwise, I will update after I have spoken to Northants Bulk.   Gerrard04

Now at 92 days and just phoned regarding another matter and got a number off them.So phoned and it was a recorded message saying that they are having problems due to the volume of requests blah blah blah but any received before may will have their statements sent out by July 7th.Hmmmmm we'll see, the dates just keep getting further and further back.

Well after a bit of scribbling on the old notepad and typing into the spreadsheet,without "sc" (can only assume thats service charge) the figure stands at £2912.50 ,and with the "sc" included it jumps to £3765.

The "sc" charges only seem to appear when my account was overdrawn and had been hit with another "fee" so it's like a double whammy,so its going on the claim. :D

Prelim drawn up, schedule of charges filled in(took a while) all ready for posting tomorrow.

Let the games begin, although going by other threads, I'll be lucky to have my money back before Xmas lol.

Now £120 lighter and back home with most of the paperwork I took - they only wanted one copy of the claim ( I printed 3) and same with the schedule of charges, said they would copy them even tho I had copies of it there with me!!!

Despite letter from court informing me of stays on new cases,have still received defence from CB and today received the AQ which needs to be completed and returned by 24/9/07.

Just what I need at the moment, don't start work until the 10/9/07 so no money till a fortnight later........bugger

If you're on certain benefits you can get exemption from court fees. Ask at the court about this. I suggest that you use the AQ to oppose the stay, and if it's going to cause you financial difficulty make sure you make this clear.

Unfortunately I have never signed on for any benefits despite only working for 3 weeks in the last 6 months(yes it's been a bloody struggle) due to a regular "next week" promise of work.....

the defence looks fairly standard, however I'll try to get it scanned at a mates house and post it here.
