    • Hello, Following the submission of my defense, last night I received an email from DCBL indicating that the claimant intends to proceed with the claim (I've attached a screenshot of the email for reference) along with the N180 directions questionnaire. I'm unsure how they obtained my email, but I suspect it was through the courts' form when I completed the Acknowledgment of Service. This email almost slipped my attention. I have also today received a letter from court to state they have received my defense.  It appears they are requesting an online telephone hearing with the court.     • Default Amount £9237.88, all this started in 2006 Admitted debt £9075.65 Weightmans added £1515.01 immediately they became involved, no explanation The Statement shows when Marlin bought debt in May 2011 £10439.25 Their statements, not received until the SAR, are based on this. Cabot deducted £1515.01on their statements in January 2019, again did not find this out until SAR. Weightmans added in  2007 after the CH1 etc was confirmed by the court £741.50, made up of Process server fees, Court Fee (they tried for bankruptcy), Solicitors fee and Land Registry fee. Unspecfied Legal costs were added by Marlin in March 2015, again I did not know this until statements received with SAR I had been paying monthly, without exception until December 2018. I am minded to take the property charge, CH1 amount ,deduct all my payments and the subsequent fees, and request/demand a refund on the final payment made? I consistently disputed Weightmans balances, but they never responded. I also told Mortimer Clarke/Cabot that I disputed their amounts.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello all,

 

I am due to take PC World to the small claims court, about an ADVENT Laptop that had a cracked screen.

 

Has anyone had experience, of an ADVENT laptop, or any other laptop, having a cracked screen, very soon after purchase? Maybe cracked in shipping, or in light use?

 

Any information on this, would be useful for building my case.

Hi, I have an Advent 7109B bought February. Last week the integral mouse stopped working. I rang the Tech Guys who attempted to reboot to see if it would restart. No luck. They then said they would arrange to collect it next week for repair.

I went to Currys and asked for a replacement. They refused and said I have to accept a repair.

I have looked at the time taken to do these repairs and they take a long time - up to a month. At present I can`t do withput my PC for that long and have cancelled the repair. I am using an external mouse.

I was not given or shown any terms and conditions on purchase.

Any comments?

Coppercat, apologies if you already know this but there is a key combination which when pressed disables the touchpad. I'm not sure what it is on the Advent but I do know that Advent's have it. On my Acer it's Fn + F7 to enable / disable the touchpad. Is it possible it's been accidentally disabled? Again, apologies if you were aware of this.

pcworld terms are written in the aftersales leaflets

 

basically stating within 28 days of purchase you can contact the store direct to refund, replace or repair product if proved faulty.

 

after this on all repairable items (over £130 in most cases) call their telephone customer support line for assistance for the fastest remedy.

 

SOGA 1979 also states that within reasonable time from purchase buyer has the right to a repair, replacement or recission of contract (refund). after this reasonable time they buyer has to allow the company reasonable time to inspect and repair product before a recission is allowed.

 

basically SOGA and company policy is the same. SOGA is the law but it does not narrow down or prevent companies using manufacturers, other departments or qualified (to manufacturers standards) repairers.

 

the company policy helps because instead of standing around instore for a week or two before it gets inspected or repaired they use external parties after the initial 28 days who will come to your address next day.

 

again where most other posters fail to realise as long as a department of the company or a authorised external party is actually dealing with it then there is no breach.

 

so if the local store was to say "sorry we cant deal with it at all, bye" this is a breach

 

but if they say "sorry we at our level cannot deal with it but here is our repair department/authorised repairers that can" this is not a breach

So it's £130 now then? It was £100 originally! I repeat yet again, return the product to the store unless circumstances make it better for you to phone customer services. Forget this 'telephone Head Office for approval' balony!

yes i just checked into it and DSG have changed the store authority to £130. well demanding a unqualified instore shelf stacker to repair a laptop or wait 2 weeks for them to get engineer instore is a sircumstance to call the helpline.

 

but then again dont bother getting it repaired fast, instead live without a product for as long as possible. ignore any advice to get it fixed faster. and sue the company wasting many more weeks of your life.

You do not seem to grasp what the SOGA is, what protection it offers, or why it is of any importance so I won't bother trying to explain as I can see that has been done over and over and over (and then some). But the "quick fix" is not as appealing as you try to make everybody believe, and the reason this is offered is so that the consumer loses any legal rights they have - if somebody takes this option they may well come to regret it at a later date.

HI

I bought advent 7096 laptop from pcworld 13 month ago.

when i first got it the power supply broke and it took the technicians 2 weeks to suss it out and replace it, 3 weeks ago approx12 month and 3 weeks i noticed that the brackets that hold the screen to the base was cracked and wont close properly without having to prize it back in .this is not due to being mistreated as its not something i am going to do with a £500 piece of equipment, i then noticed that there was a thin white line with a red and blue strip on the left hand side of the screen on the desktop, this will disso pear if i slightly move the whole screen slightly sideways then comes back when i let go.

I have noticed that the laptop gets really hot at the back and the heat sink for the chipset has fallen off probably due to the amount of heat the whole thing gives off.

Not happy at all with this..

What can i do ???

Any similar problems like this out there???

If you can prove the fault was present when you bought the unit, then you can claim against DSG under the Sale of Goods Act, for a free repair or replacement.

 

You need to gather evidence to prove to them (and SCC if needed) that the fault was inherent, though. As the unit is out of its guarantee period, then that no longer applies, and you fall back onto your statutory rights... As in the guarantee period, the guarantee is easier to invoke than SoGA if the unit is over 6 months old... ;)

Hi,

 

I'm new on here. Was searching for glue to put a screen on a laptop. I got my daugther an Advent 7107 for christmas. On 7th feb she was doing homework and called me over. There was a mark at the top. I carried on watching and it just cracked halfway down and then to the side. She hadn't done anything to it. After several attempts PC world refused to fix it unless I paid, which I havent. I was furious.

Sounds like an overtightened screw or fixing though i evidently haven't seen it.

 

You should get an engineer to look at it.

Off to Small Claims Court in Feb08 for Advent screen crack, actually beneath the spot on case where you would press it shut. Many letters to DSG who encouraged me to get 'Independent Report'. Got the report and the Tech Guys (in house technicians!) completely ignored it. The company line is that LCD screens MUST have been damaged. They will not accept any responsibilty for possible design fault (poor build). My screen has never had any impact. So..will take all my letters plus I/Report AND laptop to court. But be warned it's cost me about £150 so far. No guarantees of success but if any advice on similar problem welcomed.

bought an advent 8109 from pc world last feb and now one of the hinges has started to break away and when i tried to contact them about this they said it wasn't their problem:evil: and it came under manufacturers guarantee so i ahve been looking around the web for contact info for advent but can't seem to find any, can anyone help

Never ever buy in house Advent stuff from PC World especially laptops. The desktops are pretty standard screwed together cheapies and can be repaired or have bits replaced but the laptops are horrible to get bits for.

 

The laptops are the cheapest and naffest stuff they can find, usually made by Gericom but also from other unbranded makers.

 

Also check if you buy a branded lappy that its not one of PC World's "Exclusives" like my Mrs' Sharp, for which there are no drivers and it seems to have some kind of memory which is apparently made only in mount Doom on a leap year, so we can't upgrade it. I suppose I know why nobody else sold it.

with the advent laptops ring pcservice call on 0870 901 3000. insist on the laptop being collected, the people on the phone are mostly capita chimps now but you may be lucky and get a technical trained staff from when it was still dixons, mostly weve left tho.

 

once its in the workshop they will look at where the crack starts/ends if theres any impact marks and make a decision, one advent the ert2250 has this as a know issue

They may seem keenly priced but think hard, they are not those prices for nothing e.g. Windows XP machine with 256mb RAM :(, poor machine took 30 minutes to boot.

Far better off spending a few more quids and buying a dell if only for the better support.

We haven't got the money, so we've got to think!

Not really, considering ECS and Quanta (who make the bulk of the PC World lappies) make Dell as well.

 

As with anything there are crappy models and good ones. Most of the Advents are the same lappies which are rebranded for other makers - including FSC. In reality, the bare bones of the lappy (ie MB, screen, chassis) will be exactly the same. The rest is how you distinguish them - LOOK at the RAM, see if it's suitable. Check if there's enough HDD space (1GB and 60 GB for Vista - which may need 2 GB RAM). A Core2Duo CPU is preferable to an AMD Turion, then a pentium dualcore - all three of which are far better than Celerons and Semprons. All of that can be customised.

 

Windows XP with 256 is perfectly sufficient. IF you don't then overload it with bloat and turn off the XP theme and run it in Windows Classic. But it works better with 512 and preferably 1GB.

 

Same with Vista, put it on a machine with 512 and it will be ****, it works well enough with 1GB but ideally needs 2.

 

But of course, if you know the lappy is under spec you wouldnt buy it. It's not about PCW, it's about caveat emptor. If they can sell a crappy CelM430 with 512 MB and Vista don't expect it to fly - if they then sell a C2D with 1GB and Vista for about £50 more - marking the **** one up and the good one down... well, people still buy it.

Yes, most engineers will issue an offical report for about £30 - £50. Just make sure it states the damage caused, the methods of examination, cost and methods of repair and the probable cause of damage.

Hello, firstly can I advise you that you start up your own thread as it is then much easier to keep track of what of your issue. As for your problem can I ask how old your machine is? as if it is under 6 months then you do not need to get an engineers report done at all as it is up to DSG to prove that is does not have a manufactures fault not for you to prove that it does.
