Hi all,


Well have just joined the forum today! Feel like my process of claiming back charges has stalled. Called Halifax back in April requesting last 6 years statements, the charge of £5 was collected from my account on 18th April! It is now 30 May and I have not received anything! I chased it again on 21st May, was advised that they would be sent urgently! Again NOTHING! How unprofessional and annoying! Shouldn't they have been sent to me within 40 days?? :confused:

Yes they are supposed to be sent within 40 days if you requested them by using a data protection act subject access request.

If you just called them and asked for them then there is no schedule applied.

Call the bank today, tell them you have reuqested the statements on 18th April (42 days ago) and you will begin court action if they are not recieved by Friday. You will then have to follow the process of DPA SAR and make a formal request. If they do not comply within the 40 days from that date then you can go to court and apply for an order.

All advice is based on my experiences. I am NOT qualified and as such cannot be held responsible for any mistakes. If in doubt...get professional help.

hi everyone, im new to this forum but like you all I have problems with bank charges concerning the RBS.

My wife and I sent away for our statements 3 months ago along with our 1st lettter to claim back charges,this went to plan and we recieved our statements at a cost of £5 .

We highlighted all our charges which came to just under £5000 over 5 yrs,we sent them back with registered mail and within 40 days,we were told by phone our claim was being dealt with and we would recieve an offer within 6-8 weeks so things were going well.

This week my wife phoned RBS and was told we would recive an offer by the 25 th of this month (june), I recived a letter this morning 16th june from RBS with an offer of £500 which I thought was insulting,so I then called their office this morning and told them I was refusing their offer and would be going to a small claims court for satisfaction,the reply was, thats ok and asked for my ref number so what do I do now.?
