      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well I get the laptop back 7 working day's to there letter, 1 of the two Hard Drives replaced and there is no problem with the display according to them :mad: I'm "MAD." Granted they replaced the drive which was an 80Gig for a 100Gig, and guess what my pre-install is gone, not that I cared much for there pre-install as it sucked. A 64Bit machine running 32Bit Home Edition XP is not K00L :rolleyes: "MAD" you ask why is he "MAD!" because the ass holes @ Mastercare neglected to re-image the Master Drive, they forgot to return the Notebooks Battery and to top it all off told me that it was not possible to ID the machines MOBO for my 64Bit Install? :shock: These "COWBOYS" yes that's what I said they are (RIP OFF Merchants) and have about as much skill as a jack ass.. Now I have a machine here with no Battery for my portable use and had taken half a day on the phone again trying to sort things out, oh and did I mention that there 0870 dial code is a profit sharing [problem] with BT? I guess I have to put it down to entirely bad luck and have learned a great deal from this experience.. never to purchase anything again from this group. There tech support LOL that was a laugh when I phoned for the MOBO ID I was told they could not tell me? And then was told (sir you can not install any other OS on these machines.) LMAO I had to have a laugh :-| then to make things worse adding more insult to injury "sir that driver you require for the MOBO is only available from the manufacturer you could always write your own." ROFL

 

Well the machine is up and running with 64Bit now along with ubuntu Linux and I await the return of my battery. Please do not purchase anything from these idiots and rip off merchants, if you want good customer end user support I don't have a clue where to purchase a pre-build machine from but one thing for sure not these clowns.

under the computers for home scheme you are paying a tax free monthly payment,

 

lets say its £800 for 4 years. thats £16.66 a month.

asking for a refund is like asking your employer for a tax free loan of 0% and you will pay him back over 4 years.

 

because thats what a refund is. your asking for money that does not belong to you.

 

if after 4 years and the payment is in full and you had a strong case that is was faulty then possible,, and only possibly a refund would be allowed. but this may go back to your employer who would then charge income tax. or it will go to inland revenue who will ask for the tax.

 

Also the computers for home got you to sign that you are paying £16.66 a month for an advent. lets say pcworld replaced the advent for a toshiba.

two months later you lost your job and your employer asked for the advent back as listed in your contract. oh look you dont have it.

 

ok next process is the employer beleives you have sold on the laptop in exchange for that tax free loan to buy toshiba.

 

takes you to small claims.. blah blah blah you know the rest

 

my advice dont do computers for homes on something as volitile as a PC. Especially after 2 years the specs of laptops are outdated and viruses, accidents.. its not worth it

 

so what if its tax free, id rather pay cash

I bought an Advent laptop from PC World 8 weeks ago. The screen has given up and shows nothing when it's turned on, took it back today and was told that they only have to repair it as it's more than 28 days old.

 

I tried using the sale of goods act but the response I got was

'these things happen, it's over 28 days since you bought it all we

have to do is repair it'.

They did say they had a courier that would pick it up and return it ( as if that makes everything all right and they're doing me a favour :rolleyes: ) This means they would have the laptop for a minimum of 7 days. This is already causing me problems, I'm a teacher and all my lesson plans for the rest of the term on it.

Surely this isn't right, I would think that after such a short time I would be able to get a refund.

 

Anyone any advice???

 

 

 

Hi I bought 2 Advent laptops from pcw, took one back the next day, the other 4 days later. each time the tguys repair labs had identical laptops in. there is a manufactorers fault with the processor cooling fan (heatsink) which causes the laptops to overheat then switch off. I say this incase anyone is having a problem with Advent laptops. because pcw knows of this fault.

Advent laptops are made by a host of different manufacturers and are rebadged. To say there is a blanket fault across the whole brand is absurd and not something that I am aware of with any of the manufacturers used. Occasionally there is a bad batch of any product and recalls are issued, most recently with Sony laptop batteries but there has been no recall of any Advent laptop in recent times.
