hi all, hope someone can help me here, i pretty much rushed into things without doing any homework.:x

 

i wrote my first letter to lloyds with an ESTIMATION of how much they owe me, basically i skipped the statement request because i have 3 years worth of statements, so i simply doubled the amount, and stated that if they did not agree with this to send me the statements covering this period. i also sent off a breakdown of charges made to my account.

 

i recieved a reply from lloyds stating that they were fees and not charges, and perfectly legal, basically just fobbing me off. They gave me a ref number and told me to send off a cheque to this address-

 

Statement request

Lloyds TSB Bank Plc

Customer Service Recovery Centre

Charlton Place (c25)

Andover

Hampshire

SP10 1RE

 

They also said " if we cannot come to an agreement, i will provide you with details of the financial ombudsman service so they can consider your complaint independently"

 

My question is, where do i go from here? do i start from scratch and request the rest of the statements i need from the above address? What about the estimation i made? do i go back on this?, have i screwed up by sending them an estimation?

 

this bank really have made my life a misery for years, i really want to kick thier arses, i mean look at this-:-x 28th feb 2004 UNPAID CHEQUE CHG £125.00, :-x surely this cannot be a fair charging system as they claim.

 

any help such as an appropriate letter template would be appreciated:smile:

Hi The first letter doesn't matter too much but the fact that your estimating your claim does! You need to send a proper SAR from here http://www.consumeractiongroup.co.uk/forum/bank-templates-library/ and work out the exact amount using one of the spreadsheets, also in the link abouve. Take some time to read the http://www.consumeractiongroup.co.uk/forum/faqs-please-read-these/31460-example-step-step-instructions.html and also read a lot of threads to get an idea of what to expect. It's very important that you prepare properly.

ok, so i should only request the statements that i dont have? may 2001-may 2004, also should i send the SAR to the address they gave me quoting the ref?

If you've had your account longer than 6 years see this thread http://www.consumeractiongroup.co.uk/forum/lloyds-bank/81799-issues-raised-llloyds-bank.html. I would ask for all your statements anyway as you will have to copy them if it goes as far as you doing a court bundle. Don't worry about that yet though. Just get your statements.

yes send it first class and by recorded delivery. that way you can track it online and see when it gets delivered.

I always send mine signed for. Costs £1.04 but i've read on here that proof of postage certificate from the post office for free will do.

i sent off my sar to lloyds 2 weeks ago now, and i still havent heard a thing from them, and they havent taken the £10 from my account.

what do i do now?, do i pester them with phonecalls or just sit tight and wait for 40 days to elapse? thanks in advance.

you need to sit tight i'd say wait till the 40day dead line then start the chasing...

 

when your dealing with lloyds you need to have the patience of a saint as they drag things out till the very last minute along with there solicitors

hi all, back again, i recieved my statements from lloyds this morning, 3 days before the deadline!, problem is they are just a breakdown like so-

 

28SEP01 CHG O/DRAFT USAGE FEE 20.00

30MAR07 CHG UNPAID CHEQUE 70.00

 

so how am i supposed to work out the interest i'm owed without my account balance? is it possible to work out the amount with these sheets?

so i just add all the totals and produce a schedule of charges then send them off with the perliminary approach for payment letter?

 

what figure would i put in the overdraft interest part below? do i just exclude this part?

 

What I require

I calculate that you have taken £XXXXX plus £XXX which you have charged me in overdraft interest for the sum which you have taken. Total £XXXXX .

I enclose a schedule of the charges which I am claiming with this letter.

sorry to sound dumb but i've spent a good while looking around the forums, and can't find a clear answer to this- on my statement sheets, there are O/draft interest £00.22. do i add these up also?

You can continue to add any charges up to the date that you file a claim against them
