Was on the phone to them yesterday.

Used to pay them via my credit card for three different items I have with Mastercare but I called in February and changed it to a Direct Debit from my current account.

But they never changed it and continued to try and take this from my credit card, it succeeded once but I got rid of the card (which was why I changed the payment method) and therefore I built up a bit of a deficit. I spoke to a lady with them who was seemingly really helpful....told me that on the 9th June they would take a enw DD from my bank which would include the deficit I owed them.

I checked my bank on Friday and they had tried to take the money then, two weeks early and the money wasn't there as I'd paid all my bills and DD's for the month and I keep my spending cash for other things seperate, not that that matters.....

I called them and was put on hold for half an hour, complained to a TL who told me she spoke with the agent I dealt with and she told me that a DD would be taken immediately and then another on June the 9th which is a falt out lie....

Now I've got a £39 bank charge for nothing, I've only just got my bank charges back but can't be arsed going through the whole process again when it's these idiots fault.

I'm not disputing that I owed them the money, through an error on their part, I did, but they told me that nothing would come out till the 9th of June and they lied.

I've to complain to them in writing which I dare say will take a month (s) so is there any other course I can take with this?

Any advice appreciated.

Ask for a copy of the recording as you dispute their version.

If you are 100% sure they are telling porkies you can ask your bank to credit your account as the payment was not authorised to be taken until the 9th June.

PUTTING IT IN WRITING & KEEPING COPIES IS A MUST FOR SUCCESS

They are saying they only record their calls at random and might not have a copy and any complaint would need to be in writing.

If you did not authorise the DD to start until 9th June you can get your bank to refund you under the Direct Debit Guarantee.

Give them a call and ask them to instigate a refund for the money taken out and they should be able to refund the charge at the same time. Worth a try.

Meanwhile I would recommend cancelling the Direct Debit and asking the Company to give you the details needed (Acc No, Sort Code and Name) to pay by Standing Order. That way YOU are in charge of when the money goes out and how much goes out!!

Good Luck

Thanks Mate, but the money never actually came out, it was a charge for a failed Direct Debit.

So all I'm left with is an unpaid item and a £39 charge.

Sounds like a penalty charge to me ;)

Eek.

Sorry i didn't realise that the charge was for the DD "bouncing".

As you will no doubt know this site is the place to be to get the info you need to get the charge back. However, sometimes it's worth simply asing, if it's just the one.

Meanwhile, stiff letter to the holder of the DD mandate I think.

Also, ensure that the bank have cancelled the DD so they can't do it again and then you can take control with a Standing Order.

I am afraid that in the small print of the D/D mandate, they can take it up to 11 days early, this is why every company push for D/D, and some even charge £4-£5 for paying by alternate method, I would suggest a standing order, which differs from D/D as you pay them, and not they take, this way you can control what comes out and when, although the banks still charge a unlawful penalty charge if there is insufficient funds
