I have had one payout of £4,500.00 from BOS without resorting to litigation. However, on the second account i am reclaiming on, I have, last night, filed a claim with MCOL. My reason was that these claims are quite time-consuming -but I only found the section on MCOL on CAG after submitting. So, my fault; I did not include the date i opened my account. I did not supply a schedule of charges to the bank. I did not state in so many words that "That the defendants contractual term which allows charges is unfair and contrary to common law." (Though I did state that the charges represented apenalty and were therefore unlawful). I did not mention the S.15 argument.

 

Can I kiss the £3,500.00 on this account farewell?

Anything important will be requested by either the defence or the judge.

 

At this stage all you have to demonstrate to the judge is that there is a valid reason for bringing the case. You can catch up with all the specifics in your bundle.

 

As a Litigant In Person you will be given some latitude, especially as to the wording you use.
