HSBC 'default charges' - hole in defence?

Part of HSBC's standard defence (point 4) which they have filed for my claim for credit card charges and bank charges reads 'Furthermore, the charges are not default charges, therefore cannot amount to a penalty'.

 

However I just found this PDF on the HSBC website (copyright 2006) contradicting this as it states the charges as 'default charges'!

 

Is this significant/useful?
