    • Meter certification periods re given in The Meters (Certification) Regulations 1998, Schedule 4. From there you can check if they are correct about your specific meter .. https://www.legislation.gov.uk/uksi/1998/1566/schedule/4 If they're telling porkies then you have e clear grounds to tell them to take  hike. If they're correct or if you haven't been able to confirm then you have  few options. You could just keep fobbing them off. In general Octopus can't keep up with demand for smart meters. It took 9 months to get our. So they may not push too hard. Or ask if you can install your own choice of meter. The Electricity Act 1989 cover this in Schedule 7 (2) and (2A) https://www.legislation.gov.uk/ukpga/1989/29/schedule/7 Or fight the them and their enforcement. Or go off supply.
    • We received a copy of the completed Directions Questionnaire (N181) from the solicitors along with a draft copy of their directions. I am on a course today so can upload over the weekend if needed. By 4pm on 16th May both parties must each give standard disclosure of documents by way of list by category. By 4pm on 30th May any request for inspection or copies of docs must be made and compiled 14 days thereafter. I will provide more over the weekend.

    • I (and other respondents) always advise “not getting caught in a lie” it hardens their response. Why would they now believe protestations of remorse and “I won’t do it again” if they've already seen you'd lie and say it was a one-off when it wasn't..  You can try approaching the prosecutor on the day, but "I wouldn't hold my breath" …..

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

OK, Story so far.

 

Issued 1st letter to reclaim charges totalling £4595.50 on 23rd March (took this to local branch) received letter saying no sorry not repaying these charges on 31st March. Sent LBA on 7th April by recorded delivery which they received on 10th April. Received another letter exactly they same as before dated 13th April only saying further to our on-line correspondence!! No correspondence has been don this way but never mind they ignored the LBA, so we filed with the court on 14th May deemed served on 16th May and are still waiting for the Acknowledgement of Service which runs out on 30th May, so I wait with baited breath as to if they are going to defend or not, looking at the other threads on here I expect we will receive notice before 30th and will have to wait another 28days for money!!!! Oh we also recevied yet another letter from them dated 17th May exactly the same as the other two saying they wouldn't be repaying the charges, but that was in response to a letter we sent on the 12th May telling them as they had refused to pay the charges we were filing with court as they had had more than the 14 days to reply to the LBA which they received on the 10th April.

Ok, received Acknowledgement of Service today and they are defending, Surprise, Surprise. So another 28 days to wait. Keeping a close eye on the account now so fingers crossed.

Mcwills, The next stage if they defend. which they normally do. Is that the court will notify you of their defense and send you a copy. The court will send you an AQ which

Thanks Parkvale for that, but how long does the court give you to fill in your AQ and what happens if I fill this in and send it back and then the Nationwide pay up. Can I claim the £100 back from them?

Cos U are Claiming more than £5,000 (...not incl. Interest + Court Fees),

Okay Hi,

 

I know its late but have been celebrating you see I have checked my account today and have had some MYSTERY CORRECTIONS put into my account totalling the charges outstanding!!!!!!!!!! Cant believe it I have WON!!!! Nationwide have paid out before the deadline of 13th. They have paid the £4,595.50 so far which totalled the charges so just waiting for the interest and court fees now. Can't tell you how I felt when I check my account this morning unbelievable. Many thanks to all those who have helped and I will be making a donation as soon as they put the rest of the money in:D

 

Patience and persurverance wins through in the end and justice to those who wait and believe.

Thanks Parkvale, I will fill in the survey once they have paid the intereest and court costs as these have not been put in yet, expect they will be put in soon.

 

Otherwise I will be carrying on with the court claim, they have until Wednesday, so not quite over yet........

I havn't heard from court yet, but have found the interest and court costs have been paid into my other account (which I dont use anymore, and which I wasn't claiming on) very clever, luckily still had a cash card for this account and when I checked the balance, just on a whim there was the rest of my money!! So will be writing to the court to say it has been settled and am going to sent for the last 6 years statements for this account now as I had forgot about it, so really the Nationwide did me a favour about reminding me I had another account and I will be claiming the charges back on this one as well:D

I refer U to the advice that I have posted on Michelboo's Thread earlier tonight (Mon) re: AQ/Settlement.

I would also be mindful that when U Claim on this NEW account, Nationwide may attempt to say that it has ALREADY refunded some of the money that U will be trying to Claim on this account.

 

Methinks that U may need a clarifing letter from Nationwide, stating exactly which Court Claim their recent Credits are for + which accounts they have been paid into??!

 

Perhaps a Recorded Delivery Letter to them stating the amounts of the Credits + the accounts that they have been paid into, are acceptable to U in Full Settlement of your current Claim (...quote Court Case Ref. No. in your letter)??!

 

This may offer U a basis to more easily fight off any swerve balls that they may throw at U during your 2nd Claim??!
