We had some building work done in 2002 and have withheld the final payment because of poor workmanship.


The company acknowledged the problems in 2002 but since then have failed to rectify them or to take any action other than to contact us every 6 months with the outstanding bill. Every time we have received an invoice we have reiterated our complaint but no action has ever been taken by the company to resolve the problems.


The company has now passed the matter to a solicitor suggesting that the problems are due to 'wear and tear' and threateing us with legal action if we do not pay the £1000 within 7 days.


Can anyone please advise how we should respond?

When you say they "acknowledged the problems" - how did they do this?


Did they write to you, did you write or phone them?


Essentially, what records do you have of the dispute?

Yes - they wrote in October when we first raised the complaint suggesting that the builders complete the work and that following this they would arrange for their services manager to visit with a view to inspecting the work and signing it off as completed. The work was not completed but a site visit was made by arepresentative of the company in February 2003. He told us he would get back to us but never did.


since then the company (always a different person) has contated us on average once every six months requesting payment. We have reitierated the compalint each time and have been told they will get back to us, but they never do.


We have a detailed record of all the letters and telephone conversations but are now very worried that legal action is being threatened .
