    • Hi there Manager for our soccer sixes team moved overseas mid season and we struggled for numbers so we told the ref about 5 weeks prior to seasons end that we would see out these games then be done and he told us he’d ’pass the message on to the relevant people’. Heard nothing, then 3 days prior to the new season beginning we were given our fixture for that weekend. Told the guy over text we had pulled out and the ref should’ve passed a message on but we were told sufficient notice wasn’t given and it needed to be in writing. I argued it’s not our fault the ref didn’t do as he said but we were countered by the T&Cs.    now being chased for what was £608 kindly reduced to £476 to pay off remainder of the season. Been sent a letter in the post from their accountancy team and told needs to be paid by Friday.   seen a lot of the other threads saying we can literally just ignore everything but im concerned about debt collections and credit score being harmed. Can anyone confirm if this all works/what we should do?   thanks
    • Hi,   I have given an official police witness statement for the prosecution in an upcoming criminal court case, and I am very anxious about what might happen.  Specifically regarding being cross-examined.  My statement is very short, and only a couple of paragraphs long, regarding a conversation I had with one of the victims.  I have tried to research online about what information about me the defence barrister might be able to find and use to discredit me.  I have by no means have a shady past but, I am concerned about what private information might be brought up, and as this is a case that will be in the national press as it is in the public interest.  The two preliminary hearings were reported in the papers.   I have tried to research  online what information the opposition can seek, but it is all very complicated.  I believe that they can legally access public records, but I'm not sure what information public records hold.  Can they access my medical records, educational history, HMRC, and Department for Work and Pensions? (I am a self employed sole trader).  I was arrested once, and this was unfortunately instigated by the victim in this case, so could well be of interest to them.  It resulted in no further action, however I have only discovered this week that that, in fact, this means I have a criminal record, and will be so until I am 100 (no chance)! This has really annoyed me to say the least, especially since I asked him afterwards why he rang the police and he said 'for a laugh'.  So I have started to look into applying for it to be deleted, but again, if anyone has any advice on this I would be appreciative. At the moment, my name isn't on the confirmed list to give evidence, but the detective I have been dealing with has said it is 'likely'. The names of the victims in this case will not be allowed to be reported, are witnesses fair game for the press? I really need no know how deep they can delve in to my life so I am prepared if my character gets assassinated in front of the nation. I really wish I'd never agreed to this.   Many thanks
    • A belated thanks dx. Yes I may take your advice regarding StepChange. I am finding that I am telling them (on behalf of my Son) the true balances outstanding? They never seem to check properly in which worries me. If I was to take on myself is there another way of dealing with various debts? I have already submitted other IRL complaints on his behalf. Today I have received a further response from Quidie T/A Fernovo confirming that they will waiver all interest paid.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Everyone.

 

Helping my mum and a work colleague, and a work colleague's brother through the process against both Northern Bank and Ulster Bank, status is as follows:

 

Work colleague taking on Northern Bank, charges amounted to just under £2k without interest, they instantly offered £950 in settlement even though charges are fair and reasonable etc.... Settlement offer was declined although colleague was willing to make a counter settlement without prejudice of £1750, awaiting response within 14 days given. Also have to give northern their dues as they sent statements out well within 40 days and made a settlement offer within 2 days of receiving claim letter, bless them :D

 

Mum: just received statements from ulster bank, played many games over statements, as other board members have mentioned, they claimed to only receive letter a week after posted, they claimed they had 40 working days not 40 days to respond and eventually ran over both 40 days and 40 working days, 4rseholes. Estimated charges are about 3k, i've noticed several comments on here referring to splitting claims to keep them under the 2k limit for ni small claims, just wondering if anyone can advise how this is generally done, is this for specified periods or for specified charges eg one letter for 3 years, another for further 3 years, or one letter for referral and another for unpaid DD?

 

Work Colleague's brother: sent letter requesting statements to Northern, will wait and see.....

Further update just this morning, Northern have just replied to my work colleague on the counter offer stating that this matter is under investigation and that they will reply within 20 working days, seems like further stalling on their part. Would advice be to proceed with court action on the end of the 14th day?

Certainly, they replied to the first guy within no more than 30 days (he can't remember exactly but estimates 3-4 weeks), still waiting on a response to the other but they do appear to be one of the more cooperative banks......

Update: northern bank wrote back to work colleague 'your account overdrawn frequently bla bla bla' end result they're willing to pay out 1750 in full and final settlement, which colleague is happy to accept. That was damn easy, no court, no legal process whatsoever.......:D

 

Round 2 with northern bank still to come, ulster bank also still to be pushed......

Hi Conlee,

 

I'm not 100% sure where you're coming from but if you're asking with regard to filing seperate claims for business and personal accounts, then to my knowledge that is acceptable. Is this the case where you want to distinguish between accounts or is it because of the sums involved?

It is because of the sums involved, the account that I am checking first has charges of nearly £3,000. I don't know yet what the total for the personal account is. So I was checking that we will be able to make a claim for both accounts as they are under the same name.

hi conlee

you must claim for seperate accounts on seperate claims you cant bundle them up together.

if your claim is for more than 2k on each claim you will either have to forfit the amount over 2k on each or use a civil bill instead which goes through the county court.

2 quick updates, bully boy tactics and stalling have commenced on both other cases:

 

Ulster bank have cancelled my mums o/draft without notice, 15 days after the date it apparently was only agreed to (anyone ever heard of a overdraft arranged for 3 1/2 months:-? ) and head office have to approve a renewal. Little do they know she's waiting on a huge divorce settlement and the charges will be stuck to them in the next few weeks.

 

Northern bank have told the other guy that they cannot provide a service to him for direct debits etc and that he should find another service provider. still waiting on statements.

 

i'm beginning to enjoy this in a twisted sort of way, they'll all get their comeuppance eventually!

latest update, 2nd claim proceeding against northern bank, prelim letter 4 claimant sent today, falls almost indentically to his brother's claim, lets see if northern roll over again.

 

Ulster bank are still playing games, reinstated overdraft for one month, finishing in middle of month, aboslute joke. mum expects settlement by end of july so will take it from there and keep u all posted....

preliminary letter now on way to ulster bank, settlement through and they owe a total of £3229 excluding interest, will be interesting to see how they respond as my mum is about to put a large 6 figure sum in her account, perhaps only to move it to another bank soon to spite them :D

hi there

splitting claims dosent work here in ni the court sees it as an abuse of the small claims system. the banks know this as well and wont pay out on a second claim as far as i know. you need to use a civil bill through the county court.

Hi johnspeehs, that is not strictly true. You can split claims here in N.I. cos i have and so has LTWFB. If a claim is above 2k , then you can split it to under the 2k or just on the 2k. Once this claim has been settled and only then, submit the other claim immediately. You do not have to notify the bank, all that is needed if the bank asks when settling the first claim, is that ' I/We accept your kind offer of blah blah for claim number' and that is IT! As in my case once i received my first money i just put in for my second with my £62.00 and that was that. These could be seen as one claim but then the bank did have the chance to settle for the entirety in the beginning and also, this can be translated technically as 2 different claims. The only thing I will say is just be aware that in Belfast there is a certain judge who may deem this to be abuse of power, as I was personally told by a very kind member of the small claims court, but YES, you can SPLIT your claims!! Hope this clarifys the situation!

CONGRATULATIONS nishields on the new addition to your family. Hope all is well and there are not too many sleepless nights!! Received 94% offer yesterday, sent back acceptance receipt today, made a few amendments to it by scoring out the sentence that says I will never make another claim, and gave them until next Friday to send me banker's draft or else I may have to reconsider my position!! You are right, I have given them ample time and my patience is now running a little thin!

Latest update, another victory against Northern..... guy went to meeting with bank and accepted 85% of charges (against my advice!) but no court, no time lag no nothing.

 

On a sour note, had told both these guys didn't want anything for helping them along, just asked that they give me a donation for this site, neither has done:mad: . w4nkers. Can't see me helping those outside family again.

 

LBA going to ulster bank for my mum tomorrow, not giving them the chance to claim 12th and 13th influenced their ability to respond and all that crap.....

Just thought I'd let you's all know that my friend was taking Ulster bank. He was about to submit court action when he got a letter from them Saturday week past to say that he was getting all charges back. As of today he still hasn't got the funds.

I received my offer letter on a Saurday as well. I waited for 1 week and then rang them(the no. on the letter) on the Monday. They told me the money would be in our account by the end of the week but when I checked an hour later,it was there.
