    • we dont get N157 because its new OCMC but no court dont have evidence either.   Just seems a bit of a pointless wait but oh well
    • Post #9 suggested some options to avoid or put off having a smart meter. Post #12 a simple solution to your complaint about the ay they handle fixed monthly DD. It's not really clear why you posted if you're going get irate when members "jump in" with suggestions. You can see what I'm referring to on "gasracker.uk" to allay your suspicion that I was lying in Post #16 which was made to correct ther misinformation shown in your Post #15
    • Back to octopus from the smart meter/tariff salesperson. Octopus have now said just ignore the letter - I dont have to have one despite there letter implying (at least) it was required, but that i will HAVE to have a smart meter if current meters stop working as 'their suppliers dont supply non smart meters any more'. They also say they do not/will not disable any smart functionality when they fit a smart meter I am of course going to challenge that. Thats their choice of meter fitter/supplier problem not mine
    • Point taken that we should inform new Caggers that the £20 option is there in wrong registration cases.  Well, supposedly there, who knows what the PPCs would do in practice.  Anyway, the option is allegedly there with both the BPA as you say, but also the IPC (I've just checked). However, there's a danger here of baby, bathwater. The two easiest types of cases to win are (a) residential - due to Supremacy of Contract and (b) wrong registration - due to "de minimis".  Indeed until recently we has been boasting that no Caggers, over two years, who had sent a PPC the wrong registration snotty letter, had even been taken to court, let alone lost a court hearing. We simply can do nothing about a terrible judge.  The judge seems - I say seems because we haven't had all the details - to have ignored "de minimis",. got fixated on a sign and awarded unreasonable behaviour costs.  A totally bizarre judgement.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello all,

as i said in the tag I'm new to the C.A.G I am going after the money NatWest has been fleecing form me since i started my advantage gold account.

I am not well versed in countulating interest or the law and over so many years also the NatWest A.G.C.A charges changed so many times over the past few years

that i have found a history of here thanks NATTIE

http://www.consumeractiongroup.co.uk/forum/NatWest-

bank/27521-advantage-gold-unarranged-borrowing.html

and all the F.A.Q

and I am also slightly dyslexic (as you can probably tell don't misinterpret i love numbers) so am worried about how I would 'handle' this i don’t like writing as, I misspell words miss whole words sentences and use the wrong words to get it over and done with and have scavenged bits from my previous documents and really appreciate word processors.

I have been looking around for the past few weeks doing my research Via this great site's brilliant info and opinions plus the support and positive reinforcement is outstanding. MANY MANY THANKS YA'll.

Only for me this all seems quite daunting, and so am considering appointing a specialist firm, to prep and do the work for me and having seen yesterdays news lloyds bank favorable DISTRICT court judgment I think I might be heading in the correct direction (preparation wise) the firm I’m considering is a sub. of a legal practice and charge a favourable 10% all the way and put up any costs required so I guess they are under cutting the rest and religing as I hope on calculating the correct return amounts, interest, any costs and time wasted stuff plus whatever else i/we (well we all as victims and therefore claimants) might be or in fact & deed entitled too ( I have asked for one of there claim packs).

I hope they don’t get the money and sit on it creaming the interest as most banks and financial institutes do with our cheques and almost any transfer.

Plus I believe they would be better placed me thinks to do the all calc's and much better versed with the law and i'm a bit 'lazy' well scared my dyslexia will put me out of play early  so sacrificeing the 10% is looking tempting for the experience expertise and patience they will bring to the table.

Has anyone here had any dealings personal experience with any of the companies i sure would appreciate any info.

I would like to thank all for the wealth of knowalge and intelegence I have up to now found on this site and would like to offer any assistance I can. Also I would appreciate any opinions guidance and help I can get.

I had been considering starting the ball rolling for a few months, only about 10 days ago I did, I am well peeved as I have been paying 'penalty charges' intermittently since at least 2003 but it seems like every month for the last year and a bit i mean last month they even charged me £35 for making a £1 payment that had been processed on the same day but only after they applied there own charges and penalties, that put me over my overdraft in the first place this happens every month I'm not earning loads at all in fact it's very tight with not much coming in for me at the mo but i always pay my way inculing those charges and it seems like a evil loop pushing me further and further along and into a bigger and larger O.D.

Had they make the £1 payment first before their then they would have found more than enough to cover that and the monthly fee but the sequence they applied them gets them even more interest and 'penatly charges' or what ever and so on. thankfully the muppets show all of this on the statements:p:rolleyes: .

As i said whatever i can do to assist/help i would be glad to do so well, save for large fiscal donations as I'm not very flush but once i get my money I will be making a donation by way of a thanks and to help those that are in a tighter spot than myself (and you have that in writing).

many thanks in advance and for any info advice guidance and support

all the best.

Hi Fidz, welcome on board the nat west forum!

It must feel quite daunting attempting to reclaim your charges if you have dyslexia, but don't worry - we're all here to help, support, guide and encourage you every step of the way!

Rather than paying somebody to do it on your behalf, we'd all be more than happy to check over any documents you do and to suggest any improvements. Have a think about it as we're all really supportive on here!!

As for calculating the charges, all you have to do is highlight each charge on your statements and then enter them into a spreadsheet. The spreadsheet calculates everything for you! Maybe you could get a friend to help you as well - bottle of wine (or whatever your tipple is!!) and a friend are great company when you're going through this process!

Again - welcome on board, it's good to have you here, and I hope you'll have a think about keeping all of your money!!!

Best wishes and good luck, hedgey xxx :p

Can't find what you're looking for? Please have a look at Michael Browne's

fidz,

Do not engage a company to help you get your charges back. There is lots of help and assistance on this site from people who have successfully claimed charges back. Also do not worry about the Lloyds case, this is one case out of thousands of successes - if he appeals he will win!!

With regards to your dyslexia, don't worry about this. There are plenty of template letters you can just copy and paste and any letters you want to send that are not templates just post them - the spelling mistakes can be corrected for you and then its just another cut and paste job.

Good luck with your claim and once again please don't pay someone to do this for you. You'll find it easier as you go along.

Rory

fidz,

If they keep charging you unlawfully you keep claiming against them - it's that simple. Eventually the banks may learn!!

Hi

Don't go to a specialist firm, they charge about 20% of your claim, why do that when you can follow Hedgey's advice and get a friend or friends to help?? A bottle of wine to a mate is a much better alternative, everyone on this site will also help when you're stuck. Cutting and pasting is so easy now with word processors, and with pm's you can send your stuff to someone on site to check over as well.

Everyone will help as much as we can.

go for it girl!!!

Me too actually!!! Especially tonight, just come back from pub, celebrating play off win, and now finishing off last nights bottle of chardonnay (tesco didn't have any zinfandel) - only reason I didn't finish it last night was cos my fridge broke so couldn't chill it and it tasted like petrol...... however tonight it tastes lovely....not sure if thats cos it's now freezing cold or cos I've had so many up the pub it doesn't actualy taste like anything!!

Gotta go soon, replay on on the telly soon.

Well its just what I imagine it would taste like, if I was that way inclined... which I'm not....not even when I',m very p****d, which I'm not...yet!! Rocket fuel might be a better description - and no, I've never tasted that either, I could have said cat piddle, but again, not on my usual wine list, its all a sort of imaginaryy yeeuuurrrky sort of menu, if you get my drift.

Do you think we should stop hi-jacking Fidz's thread and go onto one of our own? But not for too lomng cos the match just started.
