Hi everyone we have just joined the site and are currently in the process of claiming back charges from Barclays. They initially came back with an offer of £1000 which we declined and so have taken steps to take them to court. We have registered our claim with money claim online adn have received notification from the court that they have had an acknowledgement from BARCLAYS. They have up to the 16th May to respond now - can anyone please tell us what the next steps are likely to be and how long this takes etc.

they'll say their going to defend, then they sometimes pay out, if not then you'll have to wait for the AQ, i'm not really sure how long this will take mcol, and it depends on how busy your local court is, your on the last stretch now, not to long to wait, have a read in the barclays success section and you'll get a better idea of what to expect:D

Hi everyone

 

We have put our claim through moneyclaim online and so far have had an acknowledgment from barclays but no defence - YET? We are due to reach our 28 days very soon so wondered what happens next? Are they likely to submit a defence if so what happens? If not what happens then? We are claiming £4300 including interest so I doubt it will be forgotten :-?

 

Any help would be greatfully received.

Hi everyone can anyone please offer us any advice. We live in Scotland but have put our claim to Barclays using a family members address in England which we have been told we can do. Barclays have acknowleded our claim on moneyclaim and have a couple of days to put in a defence?

 

Will the defence come to us in writing or will we just find out on moneyclaim?

Whats the likelyhood of them putting in a defence now?

We are quite concerned over what has happened with the case today with TSB so any advice would be greatly appreciated.

You will be notified by the court that B's are defending and you will be sent a copy.

they WILL defend unless they miss your claim, it does happen.

you are right to be concerned but as I stated earlier on a post..

there are a lot of people panicking now about banks going to win..

If the story is read in full, this guy tried to beat the system by using his own path of procedures, didnt follow as advised on here,

People who DO NOT take time to read these posts and advise FULLY ..WILL GET CAUGHT OUT.

These Banks are not stupid, they can tell if a claimaint is trying it on and is not fully competent. if they see weakness in a claim they will push it.

Many thanks for the quick reply and this has made us feel a bit better as we have followed everything to the "T" so hopefully should be ok. We can live in hope I suppose that they will have a bad day and forget us?

Hello,

 

Its not unusual for the banks to use their full allocation of time. If your worried, contact the court and ask if there has been any sign of their defence. The courts are busy, so I would wait a good few days after the deadline has passed before getting exited that they haven't responded.

 

I know its hard, but try to relax and just let matters take their natural course.

Hi I have just checked my moneyclaim online status as the bank had until today to register a defence and at the moment there is nothing to say they have? I know we have to wait until midnight to place judgement but has anyone else had this - it seems strange that they havent entered a defence especially after yesterday. I called the claimline and they are closed now until tomorrow?

 

perhaps they have forgotten us ;-)

barlcays are generally late at entering defences, so I would get too carried away with the Judgement button just yet, even if you go for a Judgement they will get it set aside! They were late entering mine so I sent them this letter:

Legal: Litigation and Disputes

Level 29

One Churchill Place

London

E14 5HP

 

 

2nd April 2007

 

 

Dear Sirs

 

Claim Number .........

 

You have not ‘acknowledged’ the claim, the claim number is ...... and the time to file an ‘acknowledge has now passed and judgement in default will be granted.

 

I am writing to give you one final opportunity to make full payment of £.......

 

If I have not received payment in full by 4pm 9th April 2007, I will file for Judgment in Default.

Oh well it was just a hopefull thought thats all. Did you do your claim with money claim online? Thanks for the letter though I will definately give it a try if they dont put in a defence.

Yeah, I did mine with MCOL and they were late both to acknowledge and defend my claim!!! Also the good thing with that letter is that if (big if) it went to court it shows that you have been willing to be nice and try to settle this out of court!!! Always a bonus!:D

Hi folks

 

Please can we have some advice we filed our claim with MCOL and filed our judgement as barclays hadnt put in a defence? However we just phone MCOL to find out what happens next and were told the account was "barred" as they were now preparing a defence - suprise!

 

Please can we have some advice on what we do now? We have copied 3 sets of our statements and some other bits. Do we contact the bank at all?

 

Let the fight begin...........

You will get a copy of the defence which has been lodged, and on it will be details of the solicitors involved:

Barclays Legal & Compliance

Litigation & Disputes

Level 29

One Churchill Place

London

Fax: 01452 638 359

 

Your case will now be transferred from MCOL to your local court. Send a letter to the Legal Dept acknowleding their defence and enclose a further copy of your Schedule of Charges (inclusive of 8% and court fees).

 

Also send 3 copies of your SOC to the court and ask them to file it with your case No. xxxxxxx . (That's if you haven't already done that online).

You may get an AQ to fill in and return to the court, but some are dispensing with it these days.

Read some of the many procedural threads on this site, and ask for further advice if you need it - it may not be me, but someone will come back to you - there's a host of people out there only too eager to see justice done.

Just follow the timetable and you can't go far wrong.

Hi we have just had the information back from the court and the judge has ordered that Barclays list all cases they have turned up to defend within the next 14 days or they will dismiss the case and award us all - can you believe it?

More judges are doing this now ,they're getting cheesed off with banks wasting courts' time!

 

Not long now till you get your money! You earned it by being patient and it shows the system works.

Spoke to Thomas in the litigation team today. Seemed very helpful. Charlotte is dealing with our case but isnt in today. Thomas asked me to e-mail a copy of the order to Charlotte as it may be stuck in their postal system. The date of the judges signature is 1/6/07 and the order gives them 14 days from date of service. I only got my copy on saturday the 9th. Is the date of service likely to be the same date that I got my copy....The question now is do I help myself by sending the order direct to them or should I just sit on it and wait for judgment day?

The date of service will be 2 days after the court posted it, which isn't necessarily the date the judge signed it - in fact its likely to be at least a day or 2 after.

 

If the main priority is to get your money ASAP then I'd send them the order and let them settle - which they will. The process of obtaining judgement does take time, although granted it is probably more satisfying!:D
