Morning all!

I've sent the snotogram to Hillesden via Recorded Delivery from the UK with a £1 PO. Meanwhile, I've received another letter from them. Notice of Debt Recovery dated 10th Feb. So I think the letters have crossed....

I'll sit tight for now. Martin/Mods - I've scanned a copy of the missive and will send via e-mail if that's OK.

Ok that looks alright.

I noted their references to you possibly being referred to their "Debt Surveillance Programme"

I have to admit I havent heard of this one before....must be a new frightener.

Where on earth do they find these flashes of inspiration ?

I think they have been watching too many James Bond films.

Just be careful to check for any wires or out of place devices near your doors walls and windows.:laser:

Ha ha! Yes - I noticed that too. Never heard of this before...

Meanwhile, I checked with Royal Mail as to when my letter was delivered. Seems it was delivered 11th Feb, but the signature's like nothing you've ever seen - I kid you not, my 3 YO nephew's got better writing than that!!

Anyway, I'll print off the proof, scan and add to my files. Give them a chance to reply (oops I meant ignore).

What has been your experience with DLC/Hillesden?

Hmn I have had some dealings lets say.

They are fully aware of their needs to comply with regs and codes of practice.

I do believe that they will read whats been sent and be forced to take stock. The consequences of them ignoring that, are potentially serious.

Ha Ha...

Dont they spout some rubbish.

Our service monitors the financial status of debtors for up to five years using periodic contact via telephone, letters or agent visits.assuming the debtor is happy to agree-in most cases they will not. Keeping regular contact and adopting a sensitive and focused approach to all aspects of the process ensures that if financial circumstances improve, the introduction of an appropriate collection method can then be implemented.

In other words they just keep looking at your credit file to see how you are fixed to agreeing to any requests for payments.

Morning all! :-D

Quick update for you....

Got a letter from Hillesden this morning. Basically they confirm the following:

  • They were passed the account from HSBC who remain the legal owner of my account
  • They did not know my claim was still subject to court proceedings
  • They claim a copy of the complaints procedure is enclosed. Of course, no such copy was sent! :D
  • They have returned my PO, and placed my account on hold pending confirmation from HSBC that the case is still stayed...:roll:

Oh dear, oh dear -Looks as though HSBC were in such a hurry to get their hands on my (non-existant) dough, they clean forgot I still had a case against them!

I await the next instalment with interest (excuse the pun!)

So no copy of their complaints ?

Then they are in breach of the regs-and should be reported.

No copy of the complaints procedure. To be fair to them, it did state in the letter the procedures were enclosed but they were not like I say. Should I still go ahead and complain, or do the decent thing and allow them to send?

I've also sent another mail to the court just to clarify that the stay is still in force. That's what I surmised from the original mail, but wanted to make sure.

I dont see why you should have to be chasing them further.

You clearly asked for a copy of their complaints procedure, and they did not send it.

They are in breach of guidelines laid down by the FSA OFT and need reporting.

You can do this online via Consumer Direct.

I would also send the OFT an email explaining that you asked for this but did not get it,and can they confirm that there is a requirement for them to do this as a Consumer Credit licence holder.

Dear Sir/Madam,

Could you please confirm whether a company holding a Consumer Credit licence has a responsibility to furnish me with a copy of their complaints procedure if it is requested ?

The purpose of me asking,is because after writing to Hillesden Securities Limited1418063 whose Consumer Credit licence is 0100058,they have responded to other questions yet failed to provide a copy of their complaints procedure despite me specifically asking for the same.

Yours Faithfully

Dear Sir/Madam,

I wish to make a formal complaint against a company who has failed to send me a copy of their complaints procedure, despite a request in writing to do so.

The company Hillesden Securities Limited is licenced by the Office of Fair Trading CCL 0100058.

Should there be no requirement for Hillesden to supply me with a copy of their complaints procedure on request, then perhaps you would kindly clarify this by way of reply.

Yours Faithfully

I really do believe that firms like Hillesden continue to fail in their obligations, because there is a lot of apathy and uninformed consumers.

If everyone made a complaint to the regulators when faced with their non compliance,we would begin to see Hillesden being brought into line.

I have to say that in the last 12 months, the OFT ,has been actively pursuing many companies following complaints.

There has also been the joint debt letter guidance issued in conjunction with the CSA and OFT.

It should be noted however, that even in those conclusions, the CSA were still of the mindset that regulations were too sided to the debtor.

The Manifesto argues that there is a relationship between a regulatory culture which enables consumers to avoid their debts and the growing problem of over indebtedness.

Quick update for you all...

This morning, I received in the post a copy of Hillesden's complaints procedure - If you could call it that. It was actually a flow chart which was cut off at the edge....I'll scan & post up later. It was sent together with a copy of the letter they sent me earlier this week.

I reckon they realised they dropped a ricket and dispatched a copy of the requested 'procedures' ASAP before I complained. I wonder if the Signguard I used on the letter gave a clue?

Hi all - The Cat is back!

Just musing. Haven't heard anything from anyone about the claim. It might well have been struck out, and will need to check with the court tomorrow.

I am still unemployed, and have heard that my claim might well be allowed by the Financial Ombudsman if I can go down that route claiming hardship.

Is anyone able to shed light on this please?

TIA :)
