hi everyone

 

i am in the process of claimng back nearly 4000 pound from barclays have opened a parachute account with the post office.

 

my questions are as follows i have a loan with barclays which apart from the odd missed payment i have managed to keep up to date with ( at a struggle!!)

i still owe about 8000 on it originally 14000 and i am also 1500 overdrawn

 

what is likely to happen when i get the pay out will they shut my current account and persue the loan repaid in full ( which i obviously wont be able to do ) can they do that??

No I doubt it very much, this will be seen as an act of retaliation and is not accepted in banking codes of conduct.

The loan is a seperate account and is nothing to do with your court claim.

there have been fines issued to banks that take retalitory action against claimers.

 

i would not worry.

 

i would also look at p'haps request any payment of YOUR money unlawfully taken by them as charges , be paid back in the form of a cheque, as you have many debtors that deserve and equal share....[don't you]

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Open a 'parachute' account elsewhere if you are worried about it.

Once you start these proceedings to reclaim your charges they cant take action as the account is in dispute.

Hey!

Thankfully Barclays aren't really into closing accounts and demanding full payment of overdrafts and loans! If they do try something you need to know that as soon as you started claiming back your charges your account is now in Dispute, so they are NOT ALLOWED to demand full payment of anything.

And when you get your payout they may pay it straight into your account, but you are able to ask for it to be paid by cheque.

Please don't worry alot of us on here have loans and overdrafts with Barclays - and too be honest thats the way Barclays like it as they make more money from us with the interest they charge!!!:D

i dont mind clearing the overdraft to be honest just didn't want to bring another situation on myself with the loan etc.
