    • Isnt there some indication in there of at least intent to inform arbuthnot? IF he wasn't then it would seem to be Vennells decision to keep him 'uninformed .. Although seems to me if arbuthnot was unaware - he was either incompetent or should have very detailed records of denials. Seems vennells is constantly at the core of all the lying about all these issues though.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Ok im starting to get worried that iv missed something. I had my notice of transfer 04/04/07 6 weeks ago now!

 

A cover letter of notice of trasfer,

 

To all partys,

A defence to this claim has been filed.

The claim has been transfered to the court covering the area where the claiment lives or carries on business.

 

Then,

please read the accompanying documents carefully and note that the allocation questionarire should be returned to the nottingham county court. All this has been crossed out

I phoned the court and for further details and the lady on the phone said that it had gone to the judge. and i asked if there was anything that i needed to do. She said no. At this point i got it in to my head that all im waiting for is a pre trial date or a date. iv been waiting to hear from the corurt . now im panicking there was something i needed to do i should have done it weeks ago and now iv fluffed it.

 

then the next page is DGs defence followed by there acknowledgement.

then my letter asking for my soc to be attached then a copy of my soc.

 

Now what i really want is someone to tell me to stop worrying all is fine and it will all be ok. But i dont think it is. I was reading cyclepaths thread and he was a few weeks behind me now hes printed of court bundles and all that!!! please help. thanks all

I would phone the court and explain that it's been 6 weeks and ask what the status is. I know that most courts have a backlog of bank charge cases so things are taking longer than usual. Give them a call - they're usually very helpful.

I have read and re-read your post and it all looks in order - but have to agree that a fair amount of time has passed since you received this - of course we all know that the courts are clogged up with these claims - and that may be the reason.

IMO I'd give the bank a quick call just to make sure no post to you has gone missing, or anything like that.

It seems to me that you have done all you need to. The court has not asked for anything else and the judge has probably looked it over and he has not asked for anything else so I would't worry. give the court another ring just to put your mind at rest.

It's the waiting that gets to you and can drive you insane. Think positive and don't let the barstewards gind you down!!!:)

Let us know what they say at the court.

Thanks all for your quick replys youv put my mind at rest just a little bit. will try and get round to giving them all a ring befor i have to go to work. Also trying to sort tesco out. having a right problem with them. Just a mental note for you all dont have tesco moter insurance!!!! anyway thats another storie.

OK iv ran out of time and have to go and get ready for work. iv tryed to phone the court and didnt get an answer. will have to try tomoz when i get home from work i will read read read. to make sure i havent missed anything. but in the mean time if theres any one else in my situation that could help put my mind at rest a little morethat would be very must appriciated!!! thans agian all for you quick replys.....

Ok i called the court this morning to ask whats going off and they say i havent heard anything as of yet purley due to a back log of claims and that there taking around 6 weeks to deal with. I should hear something soon. So i feel much better now that yesterday. So my next trick is to send DG another nudge letter. Can any one point me in the direction of a second nudge letter template. I cant find it. thanks
