My thought about you making the decision on your own to go with another lawyer is that three of you are meant to be beneficiaries of this will trust, aren't you? Normally you would need to act together. HB

    • Hi guys, I am about to file my defence via email as cannot log in to the claim anymore.  Can you please advise if I can paste below and if it's good to go for now, or should I add anything else in?  Thanks!  The Defendant contends that the particulars of claim are vague and generic in nature which fails to comply with CPR 16.4.  The Defendant accordingly sets out its case below and relies on CPR r 16.5 (3) in relation to any particular allegation to which a specific response has not been made.  1.  The Defendant is the recorded keeper of vehicle xxxx xxx.  2.  It is denied that the Defendant entered into a contract with the Claimant - Parking Eye LTD.  3.  As held by the Upper Tax Tribunal in Vehicle Control Services Limited v HMRC [2012] UKUT 129 (TCC), any contract requires offer and acceptance.  The Claimant was simply contracted by the landowner to provide car-park management services and is not capable of entering into a contract with the Defendant on its own account, as the car park is owned by and the terms of entry set by the landowner.  Accordingly, it is denied that the Claimant has authority to bring this claim.   4.  In any case it is denied that the Defendant broke the terms of a contract with the Claimant.  5.  The Claimant is attempting double recovery by adding an additional sum not included in the original offer.   6.  The Particulars of Claim is denied in its entirety.  It is denied that the Claimant is entitled to the relief claimed or any relief at all.

    • Ooops - one to many also s..... my draft reply should read as:  Thank you for your response Mr Schnur  I set out my position quite clearly in my letter of claim and nothing has changed. Your insurance requirement is unlawful and is contrary to section 57 of the Consumer Rights Act, and also section 72 of the same statute. I would also refer you to the outcomes in PENCHEV v P2G (225MC852) and SMIRNOVS v P2G (27MC729).  My deadline for action - 1 May 2024 - still stands, and if P2G wish to avoid the addition of court costs and interest to my claim, you may wish to respond positively before that date.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

As the main thing you are claiming for is the compensation, you would need to take proof of what you want to be compensated for.

 

So copies of all the letters you wrote to ICO, proof of recorded delivery costs, and any other proof of the expenses incurred in order to actually get your statements.

Hi all. I currently have a court claim with barclaycard. It took me 11 months to obtain my statements (due to microfiche).

 

They have a solictior dealing with the case & he writes to me now & again. (how nice of him).

 

However, he had been stating a previous claim ref i had against barclaycard on his letters. I told him he had the wrong ref & gave him the proper one.

 

Now he writes & says that barclaycard "cannot find any record" of the claim number i gave him (even though the entered a defence). He wants me to forward a copy of my application asap, but after being messed around by barclaycard for so long - im really not in the helpful mood :p

 

Court is in the next few weeks & i get the feeling there is now a matter of urgency :D

 

What should i do, be helpful or not helpful??

Hi Missjoy,

 

Is this a court case for your charges claim or for banks failure to comply with SAR.

 

I've seen your last thread and will get them merged - please stick to the one thread or we can't keep track of your claim history.

 

If this court date is for your chgs claim, please post details of how you got to this stage.

 

A good way forward may be to send the sol'r an update of your SOC showing interest to date plus any court fees paid by you and ask them to settle in this amount ASAP.

hi, sorry about the mess up...

 

No, this case is for the charges arising out of the missing statements i received.

 

The compensation case for the £116 i withdrew (more hassle than i could be bothered with). However, the solicitor is referring to the £116 S.A.R - (Subject Access Request) compensation claim even though it was closed by me 2 months ago.

 

So, to sum up, they cant find my claim for the charges arising from the "delayed" statements & while i am looking to settle for £1000 (charges from said statements) they are still talking about the £116 (which was withdrawn by me 2 months ago) & asking where i get the £1000 from! Its funny though, cause barclaycard have submitted a defence to the £1000 claim...

 

Hope someone can advise

 

How i got to claimng for these charges:

 

Sent sar last October,

Finally got statements in October

Sent 7 day LBA

Took action via court service

awaitng... :)

Hi Missjoy,

 

With all thats gone on, best way fwd is to send sol'r copy of your updated SOC and court fees and ask them to settle as they are due in court on xx/xx/xx date.

 

Also, if you have let the other action for £116 lapse, tell bank/sol'r this too.

 

You quote a figure of £1,000 but I assume this is approximate and you have an exact figure that you Filed on your Court Claim.

Hi Slick, thanks alot for your help. Yes, the figure of £1000 is approximate :)

 

I have actually told the solicitor i withdrew the £116 claim, thats when he wrote back and said to forward details of the £1000(est) claim as barclaycard couldnt find it.

 

So, will i do out another "interest to the day" spreadsheet & send that off, even if the total will be more than that on the court application? Do you think i should add on the £10 i paid for the statements & the £16 court fee (and forget about the other £100) i had to pay to make them comply with the S.A.R - (Subject Access Request)? Or should i just settle for the revised speadsheet? What would you do? Sorry fior all the questions, with a court date nearing, im getting a bit nervous & need help! lol

What was the fig you Filed for at court and was this an estimate.

 

Do you now have an exact figure - if so, What?

 

If you let the £116 lapse as a seperate claim, that's it and forget it.

 

Fill in the spready fully if not already done so and come back with info.

Hi Slick, apologies for the mess!

 

I filed for £1124.34 through the court in August - worked out on Spreadsheets. Was not an estimated claim, but based on fact. I only used the £1000 estimate in this thread, so i could be more "incognito"....

 

I withdrew the £116 claim so i wil forget about it.

 

Will i just send the spreadsheet i done in August for the £1124.34 to the solicitor?

Oops, sorry if I've blown your cover now ! lol

 

Yep, send off SOC's with updated s.69 int't and court fees to give a total.

 

Confirm which Court it's at and the Case No. and ask sol'r to confirm when they will settle.

 

Mention also that you'll need to arrange to take time off work if you are to attend and will be claiming for lost wages and a Wasted Costs Order.
