    • Hi All,  I have tried to use my own words as much as possible, any better suggestions are welcome.  I have been sleepless and hence i can't really think of alternative words, will definitely give it another go if you have points that i may have left out? Worry
    • Thanks all for all your input. I have decided to follow this all the way. So far, I have not replied to Alliance Parking's original NTK letter. The time-period for the reduced amount has now finished, and the time to appeal (21 days from the date of letter) will finish on 25th Apr. No further comms received from Alliance Parking. Could you please guide me, for my readiness, on what happens next? Am I going to start receiving letters from Alliance Parking > Debt Collector letters > Letter of Claim? Who sends me the Letter of Claim - Alliance Parking / Debt Collectors / Solicitors / court? How many weeks / months from now is this likely to be? Once Alliance Parking passes the debt off to the Debt Collectors, is there a risk of anyone turning up at the door? Do I need to reply to any other letters from either the parking company, debt collectors, or solicitors? Many thanks in advance.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all well at last things seem to be moving a little bit anyway, an allocations questionaire came through my door this morning and has got to be back in by 17th july. Ive been really good and read up on how to fill it in etc just wondered what tends to happen now is it a waiting game again????:|

Hi all ive been eagerly reading all the threads and the news as to whats been happening with those who have had their court date and it seems that at least things are moving again! Seems so long since any one has won a case or even got further than just a court date:) Well done all of you!!!!

I telephoned my local court today (Leicester) as i have heard nothing and was told that an allocation questionaire would most likely be sent out to me within the next week or so! so i guess not every court has got rid of them.

So i ll carry on twiddling my thumbs i guess and reading threads.

My claim has also been transfered to Leicester, but on the Notice of Transfer it stated that the AQ had been dispensed with. Though it did say that the DJ at Leics may still request one.

 

Oh no, thught we had ot away with filling one in!

 

Will be calling the court tomorrow to see if I need to pay the AQ fee. Have done Draft Order for Directions & covering letter to Leics CC and also nudge letter to Wragge & Co, for all the good it may do!

 

We must be at about the same stage?

Any one know if i need to get any paper work ready to send with it, ive sent copies of my charges to both the court and to wraggs but unsure if i need to send anything else with the questionaire??

It used to the case that, if your claim was over £1,500, you had to fill in an AQ, if below, you did not. I'm not sure if this is still the case, but always wise to ring the court and ask out of courtesy, plus you normally have only 14 days to pay it. It's also a good idea to make contact with the court, as you'll probably have to ring them again a number of times.:wink:

Thanks minijane was folowing that link just got myself a little mixed up but all sorted now. I handed in my AQ at the court today and when i got home i found i had been sent a copy of A&L's AQ bloody hell they were quick i only recieved mine the other day! one good thing though i found out i dont have to pay the fee as im a student and recieve certain benefits. The nice clerk did tell me there was a back log so would most likely be early august til i hear back from them. Does anyone think i should start getting my court bundle together now (not even sure how to do that but he) or hold off??:|

In reply to my 1st nudge letter I posted Tues, I rec'd a offer yesterday(3rd one!). How quick was that?? though not accepting, mind you it was £300 more than the last one, so they are going in the right direction.

My claim is for £2222.12 inc interest so there's no telling if I will rec' AQ, probably!

I ought to advise them of my holidays in Sept as it looks as though it will be around that time when I can expect a court date.

 

How are you doing.............emotionally & mentally??

Hi Jmn yes think we will both be lucky if we get a court date before sept! lol. Both mentally and emotionally im shattered thanks how about you? between studying for my course and studying for this bloody claim my brain is shot! But no matter what im not giving in!!!!:eek:

Hi all just thought i would update everyone,

both mine and wragges AQ have been sent in and i guess its just a waiting game now for the judge to make a decision on a date.

When would you suggest would be a good time to send a nudge letter to wragges? Ive looked at some of them and thought that if i just altered them slightly as in pointing out that the actual amount of charges within the last six years is over £5500.00 not the £5000.00 that im claiming and that im also not claiming interest and would accept £5000.00 and let them off the court fees!

What does everyone think???????8-)

Hi Nicky, Hope you're okay. Its totally up to you, £5000 is real money but at the end of the day they are being ar**s lately and will they pay the lower figure anyway? All the money is rightfully yours and you dont want to lose out.

I agree - I had a few wobbles - but have just done one nudge letter for very slightly less - and thats it

 

I have seen Wragges take everyone nearly to the time limit when other banks are paying up earlier - so untill they actually defend a full case or something else happens I am sticking to my guns

Yep, agree with everyone. My "final" nudge letter was still asking for the full amount, but I'm holding out for "judgement by default" for Wragges not submitting their papers in time, so being brave (not stupidly I hope:rolleyes:).

Hi everyone ive just rang the court to see if anything was happening with my claim to be told that ALL cases were now stayed until the result of the big case at court! came as a bit of a blow really as was hoping the a&l cases would still go ahead.

Any one know when this big case is supposed to be looked at again??

Just wondered does any one think that i could contest the stay using the template? even though i was awaiting a court date.

As a student and mother of a teenager i could really do with the money!

Hi janus yes it was verbal, i rang and asked if there was any news of a date and was told that my case along with everyone elses had been stayed due to the test case.

Think im losing the plot cus i cannot find the template letters to appeal against the stay can anyone help????:???:
