    • Difficult to say however you can most certainly attempt a chargeback with Nationwide.  Call 01793657689 and it should put you through to phone banking. They may reject the chargeback which is completely in their rights to do so.  You've spent the money on this so its not exactly unauthorised but at the same time - Paypal and Nationwide should have failsafes in place to stop this.    IF you are finding it difficult - Can I suggest Monzo as an alternative if things go south with Nationwide?     • Turbo failure on a tdi with 100k miles. Starts sounding more like "common". I've had VW all my life and if looked after they'll go forever, but then maybe i've been lucky. Don't know if you can claim a new turbo from dealer, surely that would make him a loss on a 10 yo car which in market terms is an old banger.

    • The mortgage (what there was of it) was  paid off a few years ago ( by massively overpaying each month and going without holidays, evenings out, fun etc) and the house is in my name.   I shall look into universal credit but was always told, by him, that as I was a 'director' of the company and being 'paid' ... ie the money for the household  bills ... I would not be able to claim unemployment.   I have however applied for reduced council tax ... I did this a week or so after he left and all I have heard so far was a request for his forwarding address, which I have supplied. Since I applied I have paid one months full council tax ... Do they backdate your claim and take any overpayments (in my case almost £50 per month) off an amended bill?   Thank you for replying, I feel incredibly isolated and alone at the moment.

    • This is a bit of a lengthy one but I’ll summerise best as possible.
       
      THIS IS HOW THE PHONECALL WENT 
       
      I was contacted by future comms by phone, they stated that they could beat any phone contract I have , (I am a limited company but just myself that needs a business phone and I am the only worker) 
      I told future comms my deal, £110 per month with a phone and a virtual landline, they confirmed that they could beat that, £90 per month with a phone , virtual landline  they also confirmed they would pay Vodafone (previous provider) the termination fee. As I am in business, naturally I was open to making a deal. So we proceeded. 
      Future comms then revealed that the contract would be with PLAN.COM and the airtime would be provided by 02, I instantly told them that this would break the deal as I have poor 02 signal in the house where I live as my partner is on 02 and constantly complaining about bad signal
      the salesman assured me he would send a signal booster box out with the phone so I would have perfect signal.
      so far so good.....
      i then explained this is the only mobile phone I use for business and pleasure, so therefore I didn’t want any disconnection time in the slightest between the switchover from Vodafone to 02
      the salesman then confirmed that the existing phone would only be disconnected once the new phone was switched on.
      so far so good....

    • The FSA has announced large fines against DB UK Bank Limited (trading as DB Mortgages) - DeutscheBank and also against Redstone for their unfair treatment of their customers.

      It is now completely clear that any arrears charges which exceed actual administrative costs are unfair and therefore unlawful.
      Furthemore, irresponsible lending practices are also unfair and unlawful.
      Additionally there are other unfair practices including unarranged counsellor visits - even if they have been attempted.
      You are entitled to refuse counsellor visits and not incur any charges.
      Any charges for counsellor visits must not seek to make profits. The cost of the visits must be passed on to you at cost price.
      We are hearing stories of people being charged for counsellor visits for which there is no evidence that they were even attempted.
      It is clear that some mortgage lenders are trying to cheat you out of your money.
      You should ascertain how much has been taken from you and claim it back. The chances of winning are better than 90%. It is highly likely that the lender will attempt to avoid court action and offer you back your money.
      However, you should ensure that you receive a proper rate of interest and this means that you should be seeking at least restitutionary damages - which would be much higher than the statutory 8%.
      Furthermore, you should assess whether the paying of demands for unlawful excessive charges has also out you further into arrears and if this has caused you further penalties in terms of extra interest or any other prejudice. This should be claimed as well.
      If excessive unlawful charges have resulted in your credit file being affected, then you should take this into account also when working out exactly what you want by way of remedy from the lender.
      You should consult others on these forums when considering any offer.
      You must not make any complaint through the Ombudsman. your time will be wasted, you will wait up to 2 yrs and there will be a minimal 8% award of interest and no account will be taken of any other damage you have suffered.
      You must make your complaint through the County Court for a rapid and effective remedy.

Hello

 

Don't worry, this is for information only, it means that the court have issued your claim and that it was deemed served on 6th May.

 

The bank now have to reply, either by filing an Acknowledgment of Service by 21st May or their defence. They will probably file the former, which will give them a further 14 days to file their defence.

 

Your claim is progressing as it should and the Court will write to you again when anything happens. Keep coming back here and asking questions about anything you are unsure of - but above all, stop worrying!

It's exactly what it says it is - a notice to you that the claim has been issued to the Defendant. They have until 21st to acknowledge the claim, this will then give them 28 days from the date deemed served.

Hi Chinnygirl. The court bundle is not needed until the end. You still have to go through the motions of Halifax's solicitors defending your claim. You then need to wait until the court decides which track to put your claim on and to give you a date for the hearing.

does any one no what that means i filled in my court letter added the 8% interest from dates of charges but i just noticed a daily percentage should i have added this to the court application?:o

I've just received my notice from the court... halifax have got until the 24th for me...I'll be interested to see what response you get.....will let you know what mine is.....

I believe it should be part of your particulars of claim....my daily rate was 0.43 I think you have to multiply your interest by .00022 to get your daily rate, I'm sure someone will correct me if I'm wrong.

Sorry got it wrong....this was included on my N1 form in the Value section. Also I've just checked my copy of the N1 and it's the total charges x .00022 to work out the daily rate of interest.

I think to change it now would cost you £35 and is no-refundable to change it .

I've got anopther one on the go at LBA stage with Halifax Visa. Got to file tomorrow - might give them a ring before I do though. Might be lucky.

Is there any different procedures I have to follow for Halifax Visa? Should I use the Dunferline address on MCOL or Trinity Rd?

Hi ive just had my asking offer today for the full sum i will accept so do i sent off the notice of issue back to the court now to say the defendant admits to all the money owed or do i wait till they send me the cheq? they had until the 21st may to reply?
