      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All,

 

Got statements

Highlighted charges

Asked for money back - Typical standard letter telling me they are fair.

Sent another letter telling them to reply in 7 days or I will start court proceedings. Have not received a reply back, 7th day was yesterday. Any advice?:mad:

Hello and welcome, DK34.

 

I think it's 14 Days you have to give them, wait another week then start court proceedings. Start your own thread in your Banks Forum, keeps people up to speed with your claim and lets them help you if you need it.

There are a few things which are a must for you to do:

  • Print them out for future reference, believe me you will need them.

  • Read the threads in your banks forum, this will give you an ideal insight into what you are taking on.

A few things to remember:

  • This is your money, it took years for the banks to collect it, so don’t be disheartened to find it takes more than a few weeks to get it back!

  • Ask any questions you feel you need, but please remember someone may have already asked the question, so try searching for the answer first.

  • Its your money, your responsibility, your job to get it refunded. We are here to support, guide and assist.

  • If you are approached by anyone offering to do this for a fee, tell them NO and report them to admin / mod. You can do it, we all had to start somewhere and have been successful. You don’t need to lose up to half your money getting it back and you don’t need to have a degree in law!!

A few things you might want to consider:

  • You are a newbie, and as you are reading this, chances are another newbie is signing up. So give a little back and support others when you feel ready to. You can do this by keeping your thread updated so others can read, and maybe offering advice to those who are at the stage you have already completed

  • If you would like to donate to the site once you have been successful, then it would be extremely appreciated, especially by those who we haven’t helped yet….because by donating you are helping to keep the site free.

  • Use our links to go to other sites; we currently have links to amazon, u-switch and a general search engine. This really helps.

The letter you sent giving them 7 days should have been the LBA which gives the Bank 14 days. Please please to enable you to go through the claim without hassle read the FAQs carefully and understand the process, it saves a lot of worry and problems later on!!

Thank you all for your replies. I don't know how to post a thread, very new to this site. I will have to give my bank another 7 days, I'm scared and really stressed out!!! feel that I do not have the energy, but have to keep going, lloyds have really left me in a right mess.

This whole claiming thing is so depressing, since I sent off this claim to lloyds, been feeling really low, maybe because I haven't heard from them.

Hey Cheer up it's worth the wait I have until the monday the 14th of May and thus send my LBA and thus wait another 14 days then start court proceedings either N1 or MCOL still reading and digesting So thats the best thing to do while you run thru the process is read other CAG's threads for experience and tips etc etc.

I think this week has just been a downer, taking it out on the bank. I'm keeping my chin up and will not let them rest until I get an answer from them, not going to let them get away with it.

Think I just need to rest my mind, been worrying about this bank thing all week.

I know this is not totally connected to the last reply, but I am chasing the tsb for my charges, it has taken 3 months to get the copy of charges. they arrived today, but lo and behold they are someone elses charges> Now if the fella is registered here then he knows who he is I have written to him. but seriously i feel that this is a serious breach of the data protection act can anyone give me some feedback on the legalities of this?

I think they are merely trying to delay but it is my opinion that this is a big legal no no on their behalf. someone help me out before the pound signs flash before my eyes toom uch.
