      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi iam currently at the 14days deadline for taking my lloydstsb gold credit card to court for £116 in late charges. 14 days up 2morro after sending lba. credit card bascially ignored me jus been keeping sending apoligies for complaint letters.

the reason for this thread is i need advice on this.

i just won £320 from my current account with lloyds, after making a claim in court they wrote to me to say they will pay up and no need for court blabla. iam accepting that as its only £38 frm what i would have got in court.

anyway back t credit card.

i would like to ask a list of questions and please would like a response??

has anyone taken there credit card to court and won full amount? ( reason for asking is that my credit card keep telling me charges have been reduced to £12 from £20 so i would only get the difference)

does anyone have any templates for credit card court form and credit card spreadsheets?

also is it worth taking them to court???

please also let me know as much information as u can please and thank u!!

OK, Credit Cards. There have been many, many successes with credit cards, essentially they are the same as bank accounts, if anything as a result of The OFT Report in Apr 06 on credit card charges, the case is even stronger.

 

Although we have seperate templates fro CC letters and spreadsheets, the court filing stage is pretty much the same.

That link is for the N1 form, fill it out using the templates supplied and amend intelligently to suit the fact that this is a CC claim.

 

If they try offering you the difference between £12 and £30(?) then DECLINE!

If a penalty charge is unlawful then ,it is unenforceable in its entirety.

 

You ask for the link to the spreadsheet templates, these should already have been completed and sent with your letters, if you have not done so, supply them immediately.

thank u well done on ur claims! i will have a look through spreadsheets but never sent one to bank when asking for charges back!?!?!?!

Hi I Never Sent Spreadsheets With Current Account Just When I Filled In Court. Emm The Link U Gave Me For F1 Form Or Sumit. Iam In Scotland And I Download The Form Of The Scottish Vourts Website Then Hand Them In Court Myself So I Get Fee Waiver. Do U Know Here Templates For Scottish Courts Is ( Credit Card)

well got return date and hearing date for next month so i am expecting a settlement from bank v soon. got all my spreadsheets thanx will let u know how i get on....................to be continued ;)

Just to confirm - on 7/05/07 - your 14 days is up, following LBA, tomorrow. Here we are seven days later and you have a hearing date for next month?

 

Not an expert on the Scottish system but this does seem very quick!

hi yes does seems ver quick went in to court on monday to hand in claim and by the following saturday ( 5 days later) got letter in post giving me the hearing date and return date for next month!!!

was much quicker thn when i claim for my bank account that took few weeks! must be not so busy where i live hehe ;)

so iam glad it nearly all over as once i get this pay out im finished woohoo.......... till any more charges :(

hi an update the £62.00 was not for my credit card refund. it was from when i got my bank charges back. hearing date was for today ( bank paid up) i canncelled it but bank wrote letter to me the day saying £62.00 is court costs and intrest so iam happy gotta bit more than expected yeahaa.

so credit card still no word back! got 1 month till return and hearing dates so hope get a settlement by then will keep u all updated!!!!!!!!!

return day has passed (friday ) not heard nothing at all!!!

is this a good thing???????????

gotta phone court on monday to see if bank loged defence hope not

any way hehearing date this next friday!!!

i phoned court this morning cos return date passed and never heard anything. court told me bank has lodged a defence !!!

iam so scared someone please give me advice court this friday!!!

What address did you use to sar Visa account? Was it the same as your bank account?

hi any time i sent letters to bank for example the lba i sent to the card services address ( the address i kept getting letters from them from) bt when i put my claim into court i just used the lloyds customers service centre address in glasgow as nearest.

i already got a full settlement for my bank account before return day do now they have put in a defence this time has really thrown me apart ooooooooohhhhhhhhhhh nnnnnnnnnnoooooooooooo

first of all;

 

stop panicking as they wont turn up and never do. you can download and print off your cousrt bundle from the templates list. this information relates to charges and their being unlawful so relate to all credit from account to credit card. take this with you just in case and when they dont turn up you will win by default.

 

at the end of the day whats the worst that can happen to you??????

hi can someone give me advice for my prelimanary hearing this friday ( 22/06/06) do i need to take all the bundles with me for it? so much to print out. also do i need to print copy for court and whoever turns up for lloydstsb. ??? any advice would be much help thank u!!!
