      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Requested the repayment of PPI premiums paid on a loan my wife took out with Abbey National in 2006 but repaid early, two weeks later received a letter saying they were looking in to it. Today received an offer of settlement - six weeks in total so pretty pleased.

 

Ok, so here is the REALLY interesting bit. My wife had a loan with Abbey in 2001 which had PPI attached to it, the loan was paid off early the following year but because it was more than six years ago i didn't think to claim the PPI back as well. The offer made by Santander for the repayment of PPI paid on the loan taken out in 2006 ALSO included PPI for the loan from 2001 including 8% interest. What started out as a claim for £1,200 ballooned to £4,200.

 

You may be shocked to hear we accepted their offer :)

 

Money paid into my wife's account today. Very happy

sent a letter to Capital One on 12th October, got a response saying to wait 56 days, just recieved a letter saying UPHELD

 

£1787.45 Premiums

£290.78 Associated Interest

£714.98 8% Interest.

£2793.21 Total

 

Does that sound right though the PPI was added from 2004, surely the associated interest (card is @ 24.5%) should be more than the 8%, have they just got the figures the wrong way round??

Just waiting for cheques now and then I will be making a donation to this wonderful site :D

Well done to you - it's your hard earned cash after all so I won't say lucky you. Glad you got it back.

 

I've no idea how much to expect.

 

We had a 5000 car loan - paid off over 4 years and a 4000 personal loan paid off over 3 years. I thought we would just get the ppi premium back. Hoping for 2k for the both.

Well done , another result .

Not as big a wow as your last one , but a fantastic result and hopefully just in time for Xmas.

 

Have you started your own thread to check the amounts , because credit card PPI is trickier to determine than loans.

I would do that as advised in an earlier reply .

Quick letter to HSBC recently about PPI on a loan I'd forgotten about - letter back, Dear Mr Hammy, £4253.00 into which account?

No query, no argument - just paid out!

So now to go after the insult they offered on the credit card they defaulted me on seeing as they paid over £4k back to the wife's CC recently too without complaint yet offered me less than £1600 on over £4500 owing PPI/Interest/8%.

mbna settled with me for 700 odd quid only took about a fortnight only sent a questionnaire and letter no paperwork called them to confirm they recieved it they told me a cheque was in the post

 

 

i wouldn't trust MBNA to calculate anything properly

 

you REALLY need to do a spreadsheet to CHECK they have not shortchanged you.

on CC no one will! they dont have to pay it - unless you go thru the FOS or court

 

on loans yes they do

 

its just that people do not calc correctly normally.

Sorry I forgot to confirm that I have received 2/5 PPI complaints from Barclays Bank and they have debited to my account last week.

 

I have still a few more pending and still aggressively keeping a handle on my PPI complaints.

 

I will also be contributing to this site, preferable by cheque.

I got £750 from Halifax, they sent out the cheque without any problems until I realised they had put the incorrect name on it. I phoned them and sent it back, and now 6 weeks later I am still waiting for the correct cheque name...anyone know of anything I can do do speed them up??
