      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Father-in-laws claim from an old Bank Of Scotland Credit Card, started in January, after going through the FOS, recieved a cheque last week for £24,000 :-D

I had a letter from Hsbc for one cc, they are writing to me within 4 weeks with a settlement figure

 

I also rang egg and they confirmed two cheques were sent outside.

 

That means I have 7 left outstanding now

 

Not bad considering I had no paperwork at all :)

Hi all, I have had £1.481.00 (this process took a week) transferred into my Satander Account after sending a PPI compliant letter regarding Alliance & Leicester loan taken out in 2003 (A&L where absorbed into Santander)

 

I have 5 more PPI complaints in motion with Barclays and one with Barclaycard.

I received an update lettter/s stating that I should get a conclusion within 12 weeks from date I sent the forms.

 

Great news and I am counting down the weeks.

My experience with Barclaycard was very good and they paid me everything I asked for, far better than any other CC or banks! Hopefully you will get a good response from them.

received confirmation from deloitte today that our picture financial ppi claim has been upheld. will expect to receive figures and a cheque later this week :)

Me vs Northern Rock

Recieved a letter from them dated 02/09 stating they will refund £4316.90 and £1370.21 in 8% simple interest.

I asked them for a refund of £4182 so mustn't have done my sums properly.

 

I must point out that NR did exceed the 8 week deadline by about 2 days but they investigated thoroughly and even looked at another loan I had prior to this one.

 

Just waiting for the money to appear in my account now. Its been 3 weeks since I returned the agreement and getting a little impatient. :|

took out a secured loan approx 18 months ago which I have recently settled. I rang the company (First National) and asked why PPI had been included in the settlement figure as I hadn't received it. To my surprise I received a cheque for £3.5K last week, fantastic and has paid for my family holiday this year.

Thats fantastic news, I had PPI with Firts National but they sold my loan GE Money, I have never known where to write to First National could u possible let me have an address from you please.

Requested the repayment of PPI premiums paid on a loan my wife took out with Abbey National in 2006 but repaid early, two weeks later received a letter saying they were looking in to it. Today received an offer of settlement - six weeks in total so pretty pleased.

 

Ok, so here is the REALLY interesting bit. My wife had a loan with Abbey in 2001 which had PPI attached to it, the loan was paid off early the following year but because it was more than six years ago i didn't think to claim the PPI back as well. The offer made by Santander for the repayment of PPI paid on the loan taken out in 2006 ALSO included PPI for the loan from 2001 including 8% interest. What started out as a claim for £1,200 ballooned to £4,200.

 

You may be shocked to hear we accepted their offer :)
