    • They have defended the claim by saying that the job was of unsatisfactory standard and they had to call another carpenter to remedy. My husband has text messages about them losing the keys a second time and also an email. What do they hope to achieve??? Most importantly,  as far as I have seen online, now I need to wait for paperwork from the court, correct?
    • The Notice to Hirer does not comply with the protection of Freedoms Act 2012 Schedule  4 . This is before I ask if Europarks have sent you a copy of the PCN they sent to Arval along with a copy of the hire agreement et. if they haven't done that either you are totally in the clear and have nothing to worry about and nothing to pay. The PCN they have sent you is supposed to be paid by you according to the Act within 21 days. The chucklebuts have stated 28 days which is the time that motorists have to pay. Such a basic and simple thing . The Act came out in 2012 and still they cannot get it right which is very good news for you. Sadly there is no point in telling them- they won't accept it because they lose their chance to make any money out of you. they are hoping that by writing to you demanding money plus sending in their  unregulated debt collectors and sixth rate solicitors that you might be so frightened as to pay them money so that you can sleep at night. Don't be surprised if some of their letters are done in coloured crayons-that's the sort of  level of people you will be dealing with. Makes great bedding for the rabbits though. Euro tend not to be that litigious but while you can safely ignore the debt collectors just keep an eye out for a possible Letter of Claim. They are pretty rare but musn't be ignored. Let us know so that you can send a suitably snotty letter to them showing that you are not afraid of them and are happy to go to Court as you like winning.

    • My defence was standard no paperwork:   1.The Defendant contends that the particulars of claim are generic in nature. The Defendant accordingly sets out its case below and relies on CPR r 16.5 (3) in relation to any particular allegation to which a specific response has not been made. 2. Paragraph 1 is noted. The Defendant has had a contractual relationship with MBNA Limited in the past. As per Civil Procedure Rule 16.5(4), it is expected that the Claimant prove the allegation that the money is owed. 8. On the alternative, as the Claimant is an assignee of a debt, it is denied that the Claimant has the right to lay a claim due to contraventions of Section 136 of the Law of Property Act and Section 82A of the consumer credit Act 1974. 9. By reasons of the facts and matters set out above, it is denied that the Claimant is entitled to the relief claimed or any relief.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Lloyds Success:

 

GOOD NEWS.

 

Even better than just simply canceling the LPI, they have offered me a full refund of all the premiums, plus also the interest that has accrued to date.

 

This is to be applied to the loan account, which is acceptable.

hello all

Yesterday i received my cheques for mis sold ppi from the alliance and leicester a total of £870, i know its not as much as some, but i still got it back. My thread of this is alliance and leicester ppi x2

 

They gave in after just one request for payment letter. They also said that they couldn't prove i'd had sufficient info to make an informed decision on ppi.

To anyone with mis-sold ppi on their loans go for it you never know

Hi,

 

EGG CREDIT CARD

 

My egg Credit card had a narrative called 'credit card repayment protector' totalling over 4k ... So I wrote off and requested refund. Well after 11 weeks and an exchange of 5 letters they have finally refunded me. So that's a FULL refund of monthly premiums and interest at 8% for each amount debited over 4 years.

 

I feel that the recent fine imposed on egg (i think it was for 721k) by the authorities helped a lot and enabled me to present a strong case.

 

So there's my brief story - if anyone out there has this type of ppi (which is what is it of course) i recommend strongly that you put a claim in.

After 6 months of my initial complaint just received confirmation that my ppi complaint with Barclayloan has been successful.

 

Initial letter Oct' 08 then another letter March complaining that my initial letter had not been acknowledged, received a letter in response stating that they needed more time to investigate (24 weeks wasn't long enough) & They would prefer if I didn't take it to the FOS, spoke to barclays on the phone and again was told that I had the right to take it up with the FOS as they couldn't give any form of response & that someone higher up would ring me back within the hour, phone call never came, however just received letter confirming PPI full refund of £3,326 including 8% interest which wipes out the loan (one debt less) and makes me about £300 a month better off.

 

Time to start another three ppi battles 1 old loan & two barclaycard ppi's, if they accept mis selling on one it should apply to any loan/card withinthe group.

I had a previous success in getting PPI back from RBS amounting to £611 which was only for 5 months premiums before i closed the account.

 

Following this success i decided to attack my wifes loan with egg which was paid off around 2 years ago. She had PPI on that loan, we didn't discover it was front loaded until went to pay off the loan and was told it was £600 more than i had expected it to be. Feeling very p****d off i paid it. After my success i decided to go after Egg, i sent one letter and yesterday my wife received a letter from them with a cheque for £1,045. Easiest money i've ever made.

Ihave just made a claim through the Financial Ombudsman for missold PPI on Lloyds TSB in 1999 - ten years old! They have been told to pay me back all of it plus 8% interest over the period. I have fought and fought for 10 years and each time been knocked back by Lloyds TSB. I read that they cannot use the Limitation Act if you have attempted to claim and this is clearly true. Am now waiting for my settlement. Absolutely sweet justice. Please fight on everyone else. I have a thread on Cahoot - hopkinsn if anyone wants help.

I have fought and fought for 10 years and each time been knocked back by Lloyds TSB. I read that they cannot use the Limitation Act if you have attempted to claim and this is clearly true. Can you post any details of whether it was a single Loan or multiple agreements since 1999 this could be really really important to others claiming pre 2005.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did :mad:

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

 

PPI Claims ongoing with:

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.

LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

 

1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.

I was asked whether single loan or multiple. It was a single loan for 12k they added 3k for ppi then added interest and the whole lot came to 20k taken out December 1999. Heartbroken for many years but now they have to pay it back and recalculate everything. Still not heard for Lloyds TSB but I have my FSO confirmation and cannot wait for their miserly letter and am framing it. Am going to close my account with them now after 25 years and they are getting no more of my money.:lol:
