    • Just to clear it up, sorry I don't make sense sometimes. I have paid £4000 £1200 of that was suppose to clear the £1200 debt.   Meaning I have sent a extra £2800 on top of my normal mainternance money.   Thank you

    • Hi, I shown my key worker a letter that was sent to me saying that I owe £1200, she setup a standing order around 2021, this was to pay back money I owed, with my mental health status I have had complex issues to deal with and I just simply forgot about this standing order so it has been running for about 3.5 years acording to my key worker, anyway I'm not worried about the money that was sent that I call a overpayment, it went towards supporting my child's household so I am just happy with that, I am a little sad that I am being told I still owe this £1200, I have sent bank statements over 3 years worth but they have not taken away this £1200 bill and still say I owe it   Thank you

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I do believe I have had a bit of a success myself this week, with my complaint regarding mis-sold insurances, but will fully report when the cheque is issued and safetly in my bank balance :D

Sent a letter to Welcome Finance in mid August requesting a refund of my PPI .

Got 2 letters saying they were looking in to the matter and they would be in touch soon

Got a cheque today for just over £1000 can't believe it!!! :):)

welcome paid up on ppi with out a fight, thats a first

 

may i ask, what were your arguments for future reference to help more caggers

 

 

I believed my policy was missold i had a single premium ppi policy, i repaid my loan early & the ppi added £2.5k onto the total of the loan.

 

Welcome did say in their letter that they disagreed with my points raised but as a gesture of goodwill they were refunding me.

PPI Success - My first one!!

 

Argos Storecard - Standard letter sent on the 22nd Sept, letter recvd yesterday with a copy of CCA. Letter stated I had asked for PPI then crossed the "no" box yet they still charged me?!?!

Anyway they have refunded £677, this has been taken off my balance. I'm over the moon as have another few PPI claims in so this gives me hope!

 

Does anyone know though if I can request the payment via cheque rather than coming off my balance? It just means I'd betempted to spend more in Argos now?!?!?

Well done for your success, write to them and demand that they refund you the £677, plus the contractual interest, to yourself in the form of a personal cheque, for them to refund it to your balance is controlling the money they unlawfully took from you.in taking money you had not consented for them to have, or your will pursue them via the courts

HHNF - Thanks for the advice, I emailed them immediately on Sat afternoon I'll keep you posted with the response.

 

I havent yet set up a thread for my other claims but I'm certainly going to, I didn't think it would be soooo easy, people need to know so they can go after them too!!!!

Won my claim with FirstPlus - yippeeee

 

I must say it wasn't too problematic. Sent 1st letter and got fobbed off i.e. "we've listened to phone calls and we did nothing wrong" !!

 

Then requested S.A.R - (Subject Access Request) and the conversations I listened to were very revealing. These companies are very good at informing you what they did tell you but fortunately it's what they DON'T tell you that gives you the proof you need.

 

Getting single premium plus interest refunded, plus all ppi payments made to date. Loan will be rescheduled and hopefully repayments will be significantly reduced.

 

I now am in pursuit of other missold ppi and wish everyone the best of luck.......

No joy with the cheque request, got a very snotty reply. I even tried the emailing the CEO. Do you think I should just give up on that one??!

I didnt get a huge payout but i bought a laptop with dell. They gave me back 95 pounds and have reduced my finance payments by 5 pound a month. not a huge amount but a success at least!
