Have CCA'd Lowells and been told that the agreement is no longer available and that they are closing their files. But they entered a default in January 2001. Any idea if I can ask for this to be removed? I'm sure I've seen a letter somewhere on this site but have got Sunday morning brain lag!

Get credit reports from Experian, Equifax and CallCredit.

See what's there and take action as you need. Have you got anything from Lowell's in writing?


As it's 2001, I thought there was a 3 year 'expiry limit'?

Defaults are supposed to 'drop off ' after 6 years, not 3.

If the default was placed on your files in January 2001 it should have dropped off by now. If it hasn't contact the three main credit agencies and insist it is removed. If they refuse, or start bleating about having to contact the creditor blah blah, report the matter to the Info Commissioner. He'll order its removal.

I wouldn't ask them, I would insist they remove it..no proof of the original agreement..so how can they prove that you defaulted. I would also write to the CRA's stating what you have already done and the outcome, They will no doubt tell you they will have to write to the CA concerned but should also place a notice of dispute on file in the meantime
