Hi Devereaux, The same fob off story I see, I have sent them a prompt today recored delivery. Its one that someone else has sent and afew other people.

I have sent this today need to keep them on their toes. I think after the 40 days is when you report them.

Martin's right if we all inform each other of their tactics we can be one step ahead of them. When I think of the times I have been to the bank and they have taken all my money out and I have had to wait for them to refund it back. e.g £145 for a DD and kept it 2 days, then charged me because the DD was for £146.50 and still not paid DD. Even though you dont have enough in the account they will take what ever is in there hold it for afew days so you cant get at it and then refund it into your acount, informing you it has'nt been paid but hey don't despair we are charging you £35 for not paying it because you were £1.50p short. Bleep Bleep Bleep. No more Abbey National.

 

And another thing they do, I have my Child Benefit paid in monthly, and I cant remeber the last time I had any of it, because my Bank charges always always come out on the day my Child Benefit goes in. I have 3 children so get around £150 a month I dont get it Shabby Abbey gets it. Has anyone else noticed this?.

 

Sorry For Ranting - But we have had to do without food sometimes because of there tactics.

I been through this myself as then was a single parent with custody (now referred to as care and control) of my son.

I was on working tax credit and family allowance both being bacs transferre.

Looking at the statements I have both were literally confiscated by the bank.

On a thread I been looking at recently here I have seen there is something you can send to them to stop them touching your benefits by sending them a letter listing what this money will be needed for.

I thought I had bookmarked it but cant find.............

There is a process called the "Right of Appropriation" - this allows you to assign funds entering your account to specific events and needs.

This letter would need to be sent before benefits are paid into the account, and before the charges are taken - and needs to be sent on each occurence - i.e. every week or every month etc assuming the appropriation needs to be used each time.

Hi all, good ready from above, I'm even more determinded to get '******' Abbey. I've just recieved my years statements for one account, but had to send another £10 for another account. Don't fully understand the Data Protection act thingy, but printed and will be actioning alans microfiche letter today. Does this mean that even if I send these letters it could take them months to reply, what do i do after the 40 days, do i send a letter to remind them or just take the complaint further, thanks in advance for help.

Hi All

 

I received my printed statement's today and it only goes to April 2005 then at the end of it, it says END OF ACCOUNT. I am confused as I have had the account for over 10 years. I started with just a normal cash card account then a cheque book account now I have a Visa Debit Account. Do they class these as different claims / accounts although it has still been the same account number and everything or are they just trying to BLAG me.

Did you request this with a Dpa ?

If so then they are in breach as its incomplete.

You should write to them straight away and complain they are in breach of non compliance and you demand ALL transaction information.

How long is the deadline off the 40 days ?

Alternatively you can call them using the number on the letter supplied with the statements and simply tell them you want the rest or will be filing a complaint for non compliance.

You do not have to enter dialogue about the account issues.

Hi

 

The letter I sent was the DPA letter. I sent it on the 10th June. I sent the letter ( Alan's Letter From Derby ) afew days ago. Dont really fancy talking to them so I will send another letter telling them they have 7 days to comply to the DPA. Wait and see what response I get.

Been following through your posts with interest !! I've just started the process today, so your experiences have really helped me. I also accept that the process is deliberately made harder by Abbey so that x% od claimants will give up before they get anywhere. :evil:

 

If I ever do get my info through from Abbey (why on earth did I ever call my little girl Abby??)I will post progress to help anyone else who is wondering whether or not to proceed. I waited too long while I dithered so am now taking the bull by the horns and it's thanks to all you others out there!!!

Despite their fame, Abbey have not managed to deterre many who WANT to claim from doing so.

Of course waiting is what they would like everyone to do.

The testimonials on this site will affirm that Abbey are not beyond reproach as none of the others are.

However in standing a good chance to join the many who have won their claims against Abbey then you will need to continue to read up,continue to follow others and also start your own thread.

If you do all this it will go a long way towards seeing YOU get a result !

You can estimate them if there is a pattern of info,or where you know a rough idea.

 

Many of the banks tho leave it until the 11th hour.

I have had 2 lots of statements sent to me on the 40th day.

 

They have got 40 days legally tho so only if you are fairly sure,because if you are way out then they could argue later that you never gave them the 40 days.

Hi Candles

 

Their 40 days is up today and I have only received information up to Aril 2005. I sent them an email today informing them that they have left me no choice but to report them to ICO. But what do i do next??....What letter do I send them as I do not have all the infomation.

 

I sent the DPA letter 10th June followed by Alan's letter. But all I have is info upto April 2005 and at the end of the printout it says April 2005 *END OF ACCOUNT*.

You can either pursue with what you have and send the faliure to respond with complete trans details (letter in the banks temp folder)

 

Or just send the letter and await the rest.

 

Or you could estimate the missing details adding to the ones you have,and ahgain carry on to next stage but still send the letter.

Hi Martin

 

Thanks For Reply. Just to sum up. I know need to send the preliminary letter along with a schedule (which would be an estimate) on the excel sheet provided. Since Apr 2005 I have paid £1200 in charges. Would it be fair to estimate at £4,999.99. I apologise for being a dumwit but I am struggling to get my head around the procedure.

Murph its difficult for me to say on the figure since I dont know whether the consistency was there across the board with your account.

Each to their own.

For example I got my bank statements and saw that there were no charges early on......and none in the last 7 months,

I look back thinking yeah there was reasons for that.

I had a rough idea what the charges might be when I sent for my statements but I was a mile out when they came.

You will know better than me ....or anyone what you reckon yours should be.

 

Having said that its always suggested on here that you should do the estimated and carry on.

 

Later you can haggle here and there.

 

If the figure is looking quite realistic and you could show how you had estimated the figure then no problems.

 

At the end of the day you are going on figures you already know to be true.

 

You still have time before the court stage to try and get the true figures and I would go down that road.

 

If all else fails tho then go with your estimate......keeping it under the 5 grand

 

Maybe someone here can also add to the post who have gone down the estimate road too...

Hi Murphy I havent been on line for a while between 1 thing and another at home. I was wondering how u got on so despite Alan's letter. Did u contact ICO. My 40 days is up next weekend so no doubt ill get what u got cos ur ahead of me slightly in the field. I tried to stop my DD last month but due to the fact I couldn't answer their security Qs due to the fact i havent used the account in a while ive been charged in excess of 400quid, which am refusing to pay, probably land me in more bother. Anyway let me know what happens to u and if i hear anything ill let u know. Take Care PS keep the head up

Hello All, received letter today from ABBEY in relation to my letter sent to them (copy of Alan's letter). Heres the blah 'i confirm that you have been given all the transactional data you are entitled to under the DPA as you have been provided with all the transactional details that are held on our systems. Any previous transactions have been archived onto microfiche and it is not possible to provide you with a computer print out of this information. As these microfiche records are not held as part of a relevant filing system, they are not covered by the DPA and will not therefore be supplied to you under Section 7 DPA.' then they go on to say 'however, i confirm that arrangements have been made for the microfiche records to be sent to you in due course'. This was a rubber stamped letter (signature) from Bradford. So by reading that can i assume am getting my 6 yr request of transactions/charges. The deadline of 40 days is up next weekend. Is microfiche readable???:rolleyes:

They are lifted from MF to paper data.

 

Under terms of the dpa data supplied should be clear and intelligible.

I have not seen their MF generated statements but due to the numbers who have,and then gone on to claim...then they must be ok to work out.

 

I think they would have to let you have these following Alans letter,he devised it specifically to address this issue,and they cannot dispute it.

 

As with Barclays Abbey are renowned for 11th hour responses so wait the 40 days then see what happens.

My feeling is that you will get them..........probably on the 40th day.
