Hi guys, I've been reading your posts for a few days and it has provoked me into action.

 

I have opened myself a parachute account and am in the middle of transferring to it.

 

I am at the stage now where I have sent off the original letter requesting my statements, trouble is i was a little hasty and sent it to the branch where I recieve my statements from and secondly I didn't send it recorded delivery.

 

Is there any advice you guys could give me, shall I just wait or shall I send another letter to the correct address? (it's great hearing all your stories and has given me a good idea as to how Barclays will handle my claim)

Hi if you have only sent it recently..resend it.

You could be waiting for the 40 days only to find theyre saying 'received nowt sorry'

Send the SAR with payment by recorded [you will get the payment back]

 

The very least that will happen is that you may get two sets of statements which is good....less photocopying LOL.

..and indeed, two sets of statements arrived last saturday along with my payment. just gotta get on with the next step Amount claiming £925, I didn't think it would be so much!

I've been trying to get my pre six years statements from barclays but they keep sending me only ones from the last six years.

 

I asked on 6/6/2007 for this information but instead recieved 6 years worth and then I sent them a letter on (18/6/2007) reminding them of their obligation and have today recieved the same statements again.

 

Have any of you guys had any success with statements going back further? I need them for 1996 - 2001.

Well, on 5/7/2007 I emailed the complaints department to let them know that they were failing and I recieved a reply saying it had been escallated to a customer complaints manager who will be in touch by snail mail.

 

I also recieved a reply to my first letter with my SOC, just standard stuff saying they will get back to me within 4 weeks, which is not within my timescale.

 

Do I just wait and send the LBA on the 17th or should I send them a letter saying this is not acceptable. and in the standard LBS the first paragraph it says

 

"I am very disappointed that you have failed to respond to my letter of "

 

Should I amend that to read something like.

 

"I am very disappointed that you have failed to respond appropriatly within the timescale I outlined"

 

or does anyone have any better wording as English is not my strong point.

Hi Cloister

 

My teeny tiny brain is a little confused. You have received the 6 yrs worth of statements. Have you calculated the charges and sent a Preliminary request for them to be refunded OR have you done nothing because you are waiting for pre 6 yr statements in order to do one big claim?

 

Personally, I would get on with the 6 yrs worth as you may be in for a long battle to get the earlier years and this simply.

 

With regard to the pre 6 yr statements being delayed, you can ceratily send them a LBA, there is a whole thread dedicated to this problem http://www.consumeractiongroup.co.uk/forum/barclays-bank/50838-barclays-breach-data-protection.html

I agree with welshcakes on this one.

 

I like to play a little safer and go for the 6 year one first and get the ball rolling. Then once this ahs been settled then go in for the rest. It just means you are not putting your eggs in one basket (a basket which will take longer I would imagine).

25/4/2007 - Sent original SAR (not recorded) for just previous six years.

3/5/2007 - Sent another SAR sent recorded still just for previous six years

6/6/2007 - Called Customer support and requested data from acct opening

16/6/2007 - Recieved two sets of six years statements

18/6/2007 - Sent another SAR referencing my call of 6/6/2007

25/6/2007 - sent request for payment with SOC (recieved on 2/7/2007)

5/7/2007 - Recieved another set of 6 years statements

5/7/2007 - Sent an email to Complaints department and recieved an email reply stating that somone will be writing to me.

6/7/2007 - Recieved reply to my letter for repayment with a standard letter.

 

and thats where I'm up to. I mistyped the date in a previous post so thats probably why you're confused, sorry.

Hi Cloister

 

Well you are bang on track with your 6 yr claim and now it's simply a 14 day waiting gave before you file in court. The concensus is that MCOL is snowed under and it is far quicker to file direct with your local county court. http://www.consumeractiongroup.co.uk/forum/bank-templates-library/681-4-particulars-claim-n1.html

 

In respect of the 6+yr SAR issue, I have no doubt B's will at some point claim that they only hold records for 6 yrs which is why everytime they respond to your complaint, they dish out 6 yrs worth of duplicate statements.

 

Do not stand for this, B's are able to provide up to 12 yrs worth of transactional information for customer accounts. I'm due in court against B's for DPA breach and am confident I will win as their Defence is factually flawed and I have letter from them (which will form part of my bundle) that prove they have willfully and knowingly providing false information and contradicted themselves on numerous occasions.

 

I'm hoping for a CCJ against them :D

Hi Welshcakes,

 

have you got a thread I could follow (I'll have a look for it in a min) I could really use some help on this one as to what I need to say in the relevant forma and what I would need for the bundle in this case, if you don't mind helping me that is.

 

I intend to file at the local court itself, I think it will be much better that way because as you say MCOL is inundated at the moment. I'll also go the local court route when I go for my claim for the past six years.

Well, Yesterday I recieved another set of statements from barclays! Woohoo!

 

but it was from 2004 - 2007.... BOO!!!!!!!!

 

So now I have 4 sets of statements! Should I re-contact barclays to let them know how badly they are doing? Should I just continue on and take them to court for my information.

 

 

I just can't believe, actually I can reading the various posts.

Well Today I recieved my statements from june 2008 and althought they don't go to account opening I can see that I won't have been charged anything before then, so erm... Woot!

 

I've also been away so now I'm back I'll have to file my claim in court and start that.
