Hi there! Don't be afraid by my username, I'm not a pervert, honest :D

 

After looking through my online statements I can see I have been charged just over £1000 over the last 5 years, and I intend to go through the process of trying to claim it back.

 

I have a few questions though. I live in Scotland although my branch is in England as I lived there when I opened my account. Does this effect how I need to go about my claim?

 

Also I have a loan through Lloyds TSB, would they decide to make me pay the full loan amount back should I decide to go ahead with a claim?

 

Also has anyone actually lost when going ahead with a small claim if the banks decides not to settle?

The maximum for small claims court in Scotland is £750 compared to £5000 in England. If you put your claim through the English small claims court, you can claim the lot, but you need an address in England for correspondence, etc. Alternatively,use the FOS and let ther ombudsman pursue your claim on your behalf.

If your loan payments are on track, there is no reason why they should.

No straight-forward penalty charge claim has been lost.....the banks settle before court, sometimes right at the last minute.
