      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Started this one too, sent letter for details of all charges on 14/5/06. I did try requesting the information through the online form but ended up with a whole load of nonsense from them I gave up and wrote instead.

Thank you. After reading the other threads and especially the Abbey ones I expect a bit of a struggle getting the data.

 

Interesting... I sent them a nice note online.. just asking for the charges... they sent them out to me within two week.. free od charge... I think it depends who reads them and how they feel on that day, at that hour!!!

I tried three times online (very nicely) and each time I got back stuff about charges notices being altered via my messages and when I tried to explain I got sent to someone else and I had to start the whole process again.

 

I think I will email them again and ask if they have received my DPA letter and remind them of thier obligations.

Sent this yesterday (6/6/06), a bit short but I only had 500 characters.

 

Further to my letter dated 14/5/06. Please supply me with a complete list of transactions & charges relating to my accounts. A complete set of bank statements for that period will be acceptable. Where there has been any event in my account which has required manual intervention by any member of your staff, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention. If there has been no intervention, then please confirm this in your response.

Many thanks for your swift response. I must apologise, since perhaps I was not clear enough in my request. I require details of all transactions, charges allocated to my account in particular. As I pointed out in my original request this information is covered by the Data Protection Act, and perhaps, I may respectfully draw your attention to the case of Durant v FSA 2003, in which the judge ruled that bank statement information is indeed personal information and is indeed thus covered.

If you feel unable to acquiesce to this request I shall have no option but to seek the opinion of the Information Commisioner.

Could I request that you deduct £10 from my account and forward the details regarding my account from the time it was opened to the current date.

I am e-mailing following your recent letter dated 13th June regarding your

cahoot current account.

 

I have taken ownership of your case in order to provide a response to the issues raised in your letter.

 

We do not accept that cahoot's charges are unfair under recent Consumer

regulations. The object of these Regulations was not price control nor were

they intended to interfere with people's freedom to agree the terms of their

contracts.

 

It is well known that banks make charges and cahoot's charges are in line with

those of other banks. The terms and conditions of the account and the charges that apply are clear and fair and were provided to you at the time you opened it. You freely agreed to the terms and conditions and the charges when you opened the account. You were not under any obligation to do so and could have gone to another bank if you did not agree to the charges. Equally, you are free to move your account to another bank at any time if you do not agree with the charges.

 

In any event, we do not agree that the charges are disproportionate. The

charges are reasonable and proportionate to the administrative costs incurred by cahoot. In view of this I would not be in a position to refund the charges

you've incurred, fully accepting the disappointment this may cause.

 

I'm sorry I could not have written on a more positive note but would like to

The cheek of it! I received this today.

 

Notice of charges placed on your cahoot current account. Click here...... There has been a charge placed on your current account with account number XXXXXXX. This is for an unathorised overdraft fee of GBP 30.00, unauthorised overdraft interest charge of GBP 0.12 and authorised overdraft interest charge of GBP 4.96. The total charge will be debited on 31-JUL-2006.

 

I have emailed them asking why they are applying these charges.

yep... I'm going to leave my recent charges for now - don't want to wind them up - or draw attention to fact they haven't acknowledged my money claim yet. I will ask for recent charges when they have paid up. I got charged £25 for a returned standing order of £1. Unbelievable! They didn't even send me an e-mail tell me!!!

Never! A bank playing tactics?

 

I tried to request a judgement on Moneyclaim just now, said I could not as it is not 14 days since issue. I will try later on though.

In any event, we do not agree that the charges are disproportionate. The

If this is true, then why have cahoot just sent me a message to say that they are reducing their charges from £30 to £12?

 

Seems to me they have realised that their charges are neither "reasonable or proportionate"

I started a moneyclaim case, they acknowledged and said they intended to defend. I received an offer from the solicitor for 50% which I rejected and then they offered me the full amount. No allocation questionnaires or anything.

Yeah I checked that last night as the same thought hit me! It was issued on 17th so I have to wait until the 31st. I think I can do it at 4pm.

Received a letter from DLA Piper Rudnick Gray Cary. This is what it says.

 

Dear Madam

 

Yourself -V- Abbey National PLC (sued as "Cahoot")

Northampton County Court - Claim No: 6QZ457993

 

We act for Abbey National plc in this matter. Please note that any further correspondence should be addressed to us at this office.

 

We are in the process of reviewing this claim and preparing the Bank's response. A defence will be filed in due course.

 

In the meantime, we note that you have claimed the sum of £1531.49 in respect of charges that you say have been made on your Abbey account, but have provided no details as to how this sum has been calculated. We also note that you have claimed and additional £272.67 in interest but again have provided little detail as to how this figure has been calculated.

 

As you will appreciate, you will need to produce evidence to the Court of both these amounts. This information should have been supplied by you when you filed your claim. We should be grateful if you would provide such details to us as soon as possible.

 

We should add that if you have any doubts or corncers regarding your legal position you should consult a solicitor or Citizens Advice Bureau.
