Hi. My name is Sonia. 2 weeks ago i started the process of claiming back charges made on my account by LTSB. I used a template letter from the moneysavingexpert.com site which recommending this forum for help and advice. I have sent one letter and after a reply from LTSB bascially tell me to sling my hook, I am now in the process of sending them the LBA.

 

I have already had the pleasure of speaking with some of the people registered with CAG and they have given me some valuable info for which I am most gratefull. I am now a single mum and every last penny counts. The money that the bank owes me will go a long way. On here i hope to share with you my success in claiming back my money. As they say......watch this space. :D

I have just been taking your advice and reading the library. I have come across something that states i should have included the interest they have charged me the while i am over drawn. I did not include this in my first letter as i was not advised to. I did however include the charge amount and the interest they owe me on the charge from the date of the offence. Should i be claiming back the interest i paid? If so can i include it now or is it too late to enter into negotiations regarding this. I wish i had been pointed in this direction before i sent the first letter. Fiddlesticks!:(

You can claim the interest that they have charged you for going o/d. There is a spreadsheet that works it out for you (I couldn't use it), look in here

If like me you have to do it manually, then a simple way to understand it is this.

 

If you are £1000 o/d, and your charges total £1000, then you can claim ALL the interest charged that month.

 

If your charges total £500, then you can claim HALF your interest charged that month.

 

The way I done it was to have a running total of charges, and compared that to my current o/d (month by month). I worked out what % of my o/d was charges, and then claimed that % of my interest back. It’s a bit time consuming, but as it’s YOUR money, it’s worth it.

 

 

Should i be claiming back the interest i paid? If so can i include it now or is it too late to enter into negotiations regarding this.

 

Thats entirely up to you, and yes, you can include this on your next letter, just amend the schedual.

This part you need to think about. When you join up, you are taken to the FAQ's and advised to read everything about the process before you begin. Did you? If you had you would have seen this:confused:

I have looked at your other posts, and they are in a lloyds thread discussing the 6 year issue, and not relevant to the question you are asking here.

 

This is important, its YOUR claim:eek: , and whilst we are here to help, you need to know what you are doing and why you are doing it, otherwise your expecting others to do all the hard work, and thats not what this site is about.

 

So far you haven't made any mistakes:) , but you need to go back to the beginning and read as much as you can before doing anything else;) . Read the FAQ's and the step by step instructions, and get a feel for whats involved.

Thanks for your advice guys.

I am a little confused though as to what to do next. I was pointed in the direction of moneysavingexpert.com (MSE) and followed the steps there, including filling in the interest calculator and sent that aong with my prelim. A week later i got a letter from LTSB saying that they were not going to refund me the money as the charges were for a service they applied etc etc. I went back to MSE to follow the next step and read through it and it advised i use CAG also for reference. I have now read the step-by-steo guide here and the FAQs and notice that it says if i sent the letter including Stat interest, the bank would know i didnt have a clue what i was talking about. So i spoke to some guys on the chat room who recommended i start my cliam all over again?? Some others said it would be fine and to just continue sending my LBA. I am more then a little confused and would like some advice as to which step to follow next. My LBA should have been sent yesterday to compliy with my 14 day time period so already i am looking and feeling incompetent. Any advice would be most gratefully recieved. thanks

As discussed before, exactly the same thing happened to me, i came from Money expert site and had done the interest straight away.

 

Proceed as you would have with the claim, just when it comes to court make sure your claim is 100% up to date and correct.

Hi Sonia!

 

I didn't have much of a chance to chat with you in chat last night and it was late, but do fully understand your confusion.

 

To not fully understand a process and have varying opinions can be that your confidence may slip due to the many different views and opinions you will find throughout the site. That is why to post on your thread, allows for people to now clarify things for you.

 

Interest for me and trying to explain it would have to be the most frequently asked question in chat. People come in and do not fully understand the process or the spreadsheets and each person has taken a different line with how they have managed their understanding.

 

The simple spreadsheet is just that - very simple. It is about claiming back primarily what are your charges and simple interest is worked out in the spreadsheet.

 

For those that wish to have a greater more complex challenge - then the advanced spreadsheets are there, to work out compound interest and has more variables.

 

What is the most important thing about every step in your claim is YOUR personal understand. If you are not comfortable and confident with the complex spreadsheets and merely after all your charges back and the basics then stick with the simple spreadsheet as it is easily understood and gives you confidence.

 

The mistake would be if you were to not fully understand what you are calculating - as in IF you are challenged, to simply state you followed steps you did not understand, would give little credability to your claim.

 

MY PERSONAL ADVICE - listen to what is said in chat - read what others talk about - knowing each person has a different level of understanding and experience to your own. Take bits as you have done and seek further clarification as your post today has done - then find what works for you.

 

I PERSONALLY - chose the simple spreadsheet. I do not enjoy figures and found I understood the concept - therefor had confidence.

 

Maybe send a message to a mod or ask Louis for a very very clear understanding on the difference between interest and the spreadsheets but my thoughts are, that till you are very confident with how it works, the time frames are irrelevant. Your understanding is important.

 

Chat is a live place for opinions - and yes, it can be and appear very confusing and only sorry that I was busy in there last night not to have picked up on your issues and been able to feed you the confidence needed, but in honesty.....spreadsheets and interest not my forte and would have referred you on.

 

Good luck with your claim! - if you need support or wish to question anything other than interest! - im there and really happy to catch up again.

 

You have got this far - as long as the next letter is confident and so are you, there is no need to start again.

Rudebuy, thanks for the reply. I am in the early stages of my claim and am just about to post my LBA. I did have a bit of a moment earlier when i was worried about the LBA as i had included the Statutory 8% interest with my prelim then read on here that i shouldnt have. But now thanks to some great advice am sending the slightly amended LBA to Lloyds today. What was your time scale from start to finish? Is not important i am just curious. Thanks again. Sonia :)

i sent my first letter asking refund in dec 06, got response in the negative in jan 07. went straight to court action in jan, didnt even bother with the LBA, however i wouldnt advise you do the same. follow the steps in the guide on this site and all will be fine. it gets you down coz lloyds will drag their heels and delay as much as possible, but persist. all in all its taken me 4 months, and i have had a greater joy than some, coz ive had a payout in excess of £90 more than i was claiming.

Sonia, this is very good advice:)

 

I didn't want you to take offence at my post, that was not the intention, but I see many mistakes made by people rushing in, and then these mistake can become costly in both time and monetry terms, and I want to make sure you dont go down that road.

 

So on to your interest problem. Can you just confirm what you will claim in your LBA, is it jus your charges, or are you looking for o/d interst as well. If you want the o/d interest you need to add it to your claim now.

 

If you have decided to claim just your charges, then thats ok, and there is nothing wrong with this, in fact I believe many people do this.

 

I don't want to confuse you, or cloud the issue, but for me, the o/d interest was a few hundred pounds, so just have a little think about it first. If you want help working it out, I will help you as much as I can. Its not an exact way, but it does work, and can easily be defended if you are quizzed about it.

 

Either way, the charges are the most important and its good that you are here to get those back

Thank you for your post. You made it sound much clearer as before the interest "bit" was clear as mud! I have sent my LBA via recorded delivery today including the 8% statutory interest. I included this in my prelim as per advice gained from MoneySavingExpert.com. Then yesterday joined CAG and realised after reading the FAQs etc, that doing so was a bit premature. I paniced then spoke with Bextar in the chat room and she said she had done exactly the same so all was not lost. So I continued my claim with the slightly doctored LBA template this afternoon.

 

In regards to the o/d interest (and being slightly dyslexic) i am not sure how to work this out. I used the speardsheet provded by CAG and it gave me the exact amounts that the calculator on MSE gave me for the stat 8% (of which i have already included) this therefore confused me further more!!

 

I have therefore decided that considering that I thought the money i have paid out in charges was gone for good and now there is a strong chance i can claim it back, i wont bother trying to claim something i dont feel competent enough to. Just the charges would do me and the 8% interest is a bonus.

 

This adds up to just shy of 2k and that would be plenty to take me and my baby girl on holiday.

 

Plus i have a Nationwide account and a Capital One account to claim from - so i wont be greedy. ;)

If someone told you a year ago you would get a £2000 refund from your bank, you'd have called them mad.:)

 

When you come to claim on your nationwide account, you may want to claim the o/d interest (if you have any), and if you need some help, PM me and we'll talk about the easiest, and least complicated, way to do it.

This coming Tuesday it will have been 14 days since i sent my LBA to Lloyds.

 

Honestly.....I am bricking it about the possibility of taking the the bank to court but i am not going to back down. I am wondering how much it will take me to do this though. Being a single mum, money is tight and i need to count for every penny.

 

Does anyone have any idea how much this is likely to set me back?

The courts are quite sympathetic in financial matters, you may find that you are exempt (if you recieve child tax credits, you will be), have a look at this and see if it helps

Anyone else pooping their pants about the recent failure of bank charges claim?? Have read the new thread and i have to say i am. Though i am not put off. After years of receiving an unprofessional service for which they have the barefaced cheek to "charge" for, i refuse point blankly to let them win before i have had the chance to try. I hope that Lloyds dont think this is putting people off because it shouldnt. It certainly wont me. Anyone new reading my thread, read the new thread added by Bankfodder today and it should answer a few questions ( i would give the link but i dont know how ). I am about to put my court proceedings into process tomorrow and i will be keeping everyone on here posted.

 

P.S - does anyone have a copy of their Current account Terms and Conditions they would like to share with the Forum? I no longer have mine as opened my account when i was a stroppy teen and most likely threw them out with my Jason Donavon LP. When it comes to putting my bundle together it would be handy. I am worried if i ask LTSB for them that they are likely to drag their heels. Has anyone successfully received their T&C's on request?

Yesterday morning I received my court papers back from Reading County Court. Lloyds have until the 15th June to either make an offer of put in a defence. I am actually quite excited about but trying not to get too excited, just in case.

3 days to go until the deadline for LLoyds to reply to the court or make an offer etc etc. I am getting very excited, a little nervous, but more excited. It has been 8 1/2 weeks since the start of my claim (from date prelim sent) and I am looking forward to having it over and done with whatever the outcome. I have decided to take my banking elsewhere weather the settlement is in my favour or not. I've had enough of Lloyds. Will be back in 3 days to let update on any communication from Lloyds. Just wondering if it will be the bank who contact me or the court?
