Had a reply from the CC saying that my claim is stayed until the 17 May 07 to enable the parties to attempt settlement. It goes on to say that on or before the 31st May 07 one of the following steps must be taken.

1) Notify court that the whole claim is settled.

or

2) Notify court that an extension is required.

or

3) all the parties must file a completed allocation questionnaire at the court.

 

I thought i had already filed the AQ, do i need to file another one? any feedback of what happens now would be welcomed.

This sounds like to me that the court is giving the bank a chance to either submit their AQ, or settle, basically he is trying to instruct them to settle out of court.

Contact their Litigation Dept and advise them of your directions that you have been instructed by the judge to try to reach an amicable solution before the date stated..

To cover yourself, contact your court and confirm they are in receipt of the completed AQ. Ask them to enter a note in tour file that you have contacted them to confirm.

 

You will probably find you are home and dry now, the bank will not want to complate an AQ, so whats left????? Settle!!!!

 

Go for it! dont accept anything less than what you are happy with, if they cant agree simply tell them that you will let the judge decide on the day.
