I have just received a notice of transfer of proceeding from MCOL. \in the paperwork it states:

 

Without hearing

 

IT IS ORDERED THAT:-

 

1.The filing of an allocation quesionnaire be dispensed with in this case unless the district judge at the court of transfer orders otherwise.

 

Note: Any party affected by this order may under Rule 3.3(5) apply to have it set aside, varied or stayed. Such a party must apply under Rule 23.3 within 14 days of service of this order.

 

HELP!!!! what does this mean, we have already gone through this process with Lloyds and won but when it was transferred we received and filed the AQ and Lloyds settled 7 days after it was filed.

 

Not really sure what this means.

MCOL have started to issue Orders dispensing with the AQ.

PLEASE BE AWARE THAT EVEN IF THE AQ IS DISPENSED WITH, THE AQ FEE OF £100 (IF CLAIM OVER £1500) IS STILL PAYABLE (AND RECLAIMABLE FROM THE BANK).

The fee is payable within 14 days after the despatch of the notice of allocation to track (County Courts Fees Order 1999 Schedule 1).

Dont panic, this is standard now from MCOL. Its designed to speed up the process. You will recieve further information from the court. Remember if your claim is for £1500 or more you still need to pay the allocation fee.

Not yet, you should be notified by your local court when this is required, If you haven't heard after 10-14 days give the court a ring and ask.

Okay thanks, thought I had this sorted after going through it with lloyds!!! I will ring court tomorrow to check as it will be 14 days on Wednesday.
