    • Hi LFI, With regard to the ANPR cameras in your post #65, while I was on the phone to the Planning Department, they did take a look at Google Streetview and went back to 2012 where they could see the ANPR cameras in place so therefore they would have deemed consent. I had previously read the T&C Planning Regulations and had read the section on deemed consent so I understood the point they made on the phone. It doesn't matter though, that doesn't harm my case any, and I shouldn't really mention this now, (this is what you reminded me of on another thread) but in the past I was a member of a scheme that gave me access to legal advice, I have spoken to a barrister previously through this scheme on another matter and I think I am still a member. I am going to check if I am still a member of the scheme, and if I am I will discuss my case with a barrister or solicitor, whichever the scheme deems appropriate. I will let you know the outcome. I am also going to take Bankfodders advice in the sticky and go to the local court and ask if I can sit in on a case in the Judges office.
    • deed?  you mean consent order you and her signed? concluding the case as long as you nor she break it's conditions signed upto? dx Yes sorry. they called it a deed at first in court.  Then Judge said she was happy to have it sealed as something else  exact names of orders in message above.     The disease was tested for when his cardiac testing was done immediately after purchase and part of the now sealed case.   However, results were disclosed incorrectly and I only found out  two days ago.   This disease did not form part of my knowledge during the case as I had been informed of a normal result that was not the case.   it is perfect clarity of a genetic disease where as the previous cardiac issue could be congenital until the pup is genetically tested. 
    • Hi, Halifax recently sold a credit card account of mine to Cabot. I am unemployed and have no assets and was thinking of making token £1 payments for 12-18 months in order to drag things out a bit and reduce the chance of Cabot being able to get the correct CCA documents from Halifax if I requested them in future. However, I saw on the pages on this forum about defending county court claims that one of the standard approaches when defending such claims is to say “I had an account with bank X, but I don’t remember the details and so don’t know if I owe this debt…”.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hiya

sorry to be a pain..BUT - I have sent the 1st letter requesting my 6yrs statements and enclosd my £10.

 

they have now sent me this and i spent many a long day inputting ALL my charges in the spreadsheet.....my claim is for a very embarrassing £4110.00 :-| .

Sent the 2nd letter off requesting my settlement etc and they sent me another letter back saying that they cannot process my claim until I send £10 for them to send me a list of my charges - but they already have done this and that is why I sent them my 2nd letter with the list of charges attached!!!

NOW, I sent another letter (after reading one of the posts on here) saying that I am actually requesting a settlement and NOT statements and could you please reply in 14 days or will be looking into further action etc.....

 

This 2wk date expires tomorrw - however, this morning I have now recd another letter basically saying the same thing. they have processd my £10 as i mentioned in my letter and they have 40 days to send my statements!!! AARGGGH HOW thick are they??

Now, do I need to do my LBA or ring them up n explain??

Im sorry for the waffle but all this money they have fleeced me for has made me VERY mad! and I am determined to get it back!:mad:

 

any advise would be much appreciated!

Don't worry about their obtuse stupidity. You just move onto the next part of your claim.

If that means starting a court claim then that is what you do.

Do it when you said you would do it.

 

The money is yours. Look at the CYNthesys disclosures

Thanks for your replies, my previous correspondance to YB was that link i was posted about them cashing in my cheque etc etc, so now its the BIG step of threatening court action!

Im soo scared BUT determined, I mean its me, hardly got a few quid to my name (thanks YB) taking on the Bank!

Hiya all

I previously posted awhile back for support when I sent my second letter to YB (sorry not yet familiar with the lingo on here yet!) - Didnt get a reply off them so just under 2 week ago I sent them the 'threatening before takin them to court letter.

 

The problem is, I didnt include my interest of 8% with my spreadsheet, I just sent them the normal breakdown again of all my charges....so does this look like i havent a clue of what Im doing and YB will walk all over me?

 

Im so stressed now as when it gets to Thursday (2 days time :eek: ) I will have to send em my court request and how the hell do i do that? Im not a very confident person and this is not helping me!!

Please could anyone advise if this has now gone t*ts up and what i need to do to issue a court letter?:???:

Its just very daunting prospect at the moment as it looks like I (along with several others here) will end up going to court....Im really not wanting to go that far but when I see how much ££ they have fleeced me out of - i will do it!

 

Will keep posting and reading on here for advice.

As far as I am aware NO-ONE has made it to a courtroom with YB , we just wish they would actually . Maybe then the courts would be able to rule on the beggars ( can`t write what I usually call them)

 

Just stick to the tried and tested steps in here and you won`t go far wrong , 7066+ people have reclaiming £10 Million + didn`t go wrong;)

Hiya

I have sent my third letter to YB threatening em with court action etc and they have STILL sent me another letter saying about they have 40 days in which to send my STATEMENTS and bear with them at this stage from that T Rayner person!!! :mad: this is the 3rd one they have sent now......

 

HOW THICK ARE THEY!!??

 

Im soo upset now i feel like ringing em up n blastin em up down the fone - do i just send em my court letter now then and hope for the best??

the first one for my statements sending to me was back end of Feb and then ive progressed religously from there...so my threating to take em to court one was sent just under 2 wks ago - their 2wk deadline ends on Monday....:mad:

 

Im in 2 minds wether to ring em up or go to the Financial Ombudsman for advice.....is that ok to do or is it best to do it alone??

The SAR is when you ask them to provide you with statements going back 6 years so I see from the above that you have had them and have now moved onto claiming the money back.

 

They have 14 calander days to respond to the LBA and if you have not received a reply in this time then youi could call them to see what is going on but they will probably only say that that they are still looking into it and will come back to you later.

 

As such you should seriously consider starting the claim through the Small Claims Court-there is no real need to involve the Ombudsman

I've merged your threads so that all your progress is together Phoebe. Could you answer a few questions for me please, so I can be clear in my head what is going on.

 

1. Have you got all your statements going back to when you opened your account?

 

2. Have you used the template letters off this site, or did you start on another one and use theirs? No problem if you did, but I just ask because if you used different ones, it helps to know exactly what you have asked for if not CAG's letters.

 

3. Are you in England or Scotland?

 

The only ones who should be embarassed by the size of your claim are YB. Try not to get stressed and just keep reading the forum. There is a lot to take on board and it is mindblowing to begin with, but as you learn it becomes easier.

In answer to your questions:-

 

I have received all of my 6 years statements and have filled in the spreadsheet and returend it back to YB with the letter asking for my charges back.

 

I am in England (altho dealing with these lot feel like im in LA LA land!)

 

I have used all the templates off CAG - they made me look professional! :p

 

I may give YB a call today to see what the hell they are doing? then take the step of court letter (altho we go away nxt week and the money for the court letter would be better off in my holiday fund!)

Im back!! some questions I have to ask you fellow CAG-ers...

 

Im just about on the verge of doing the court letter, How can I find out if my local county court will do the proceedure? Just read on here that Pontefract CC doesnt do this type of thing - is that right or am I too spaced out by being on here for 2 hours?!

 

I have got a figure of 4117.00 then with the 8%interest of 1,109.65 i have grand total of 5,226....(im soo embarrassed!) anyway - so do i need to charge a daily interest on the highest figure or that one before the interest is added?

Sorry for being slack - ive had bad day!

Hi Phoebe Buffet,

I have replied on my thread. Pontefract county court wouldn't do the N1 for Non -Compliance of the DPA/SAR they wanted to do it as a pre-action disclosure.They do do the claims for charges. I think you mis-read what was being discussed (can happen when you read a lot) sorry if you mis-understood.

Hiya all

Just to let you know IVe sent my form for the courts enclosing my cheque (had to do it for £250)...but im still bricking it! :eek: I get a sneaking feeling that I will get it sent back saying ive gone wrong somewhere and will end up looking like a fool..but heres hoping!

 

Sent the banks copy to their registered address in Leeds is that right?

 

Going away Monday for few days so by the time I get back next weekend Im hoping there maybe some feedback.

Hi, Claire,

try not to worry, if you have followed the correct way of doing things then you'll be ok. It is daunting, but it is a matter of waiting now and sticking to timetables. Read as much as you can, if you don't understand anything ask. There is a lot of good people on here, that give you excellent sound advise and if you get stuck or are worried about anything post it and someone will answer it.

Claire did you give all 3 copies of the N1 to the court? Because you've mentioned about sending 1 to YB's head office.

Hi Pheobe,

 

Just a quick one and i'm not 100% positive on this but you said that you paid £250 for your court fee which implies you are claiming between £5000.01 and £15,000.

 

I don't think you include the interest for your court claim when determining the court fees.

 

I think as the charges are £4117 you should only be paying a court cost of £120.

 

Can someone confirm this and possibly explain it a bit better.

£120 would seem to be more accurate on a claim of just over £4000.

 

Can you let us know why you have paid £250?
