    • Back to octopus from the smart meter/tariff salesperson. Octopus have now said just ignore the letter - I dont have to have one despite there letter implying (at least) it was required, but that i will HAVE to have a smart meter if current meters stop working as 'their suppliers dont supply non smart meters any more'. I am of course going to challenge that. Thats their choice of meter fitter/supplier problem not mine
    • Point taken that we should inform new Caggers that the £20 option is there in wrong registration cases.  Well, supposedly there, who knows what the PPCs would do in practice.  Anyway, the option is allegedly there with both the BPA as you say, but also the IPC (I've just checked). However, there's a danger here of baby, bathwater. The two easiest types of cases to win are (a) residential - due to Supremacy of Contract and (b) wrong registration - due to "de minimis".  Indeed until recently we has been boasting that no Caggers, over two years, who had sent a PPC the wrong registration snotty letter, had even been taken to court, let alone lost a court hearing. We simply can do nothing about a terrible judge.  The judge seems - I say seems because we haven't had all the details - to have ignored "de minimis",. got fixated on a sign and awarded unreasonable behaviour costs.  A totally bizarre judgement.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello

 

I have just approximately calculated my charges to be £3500 and I need to do my spreadsheet ( can somebody point me in the right direction to a spreadsheet for works). I am unsure can I claim the interest now or do I have to wait till court as in a personal account as the bit I have just read on the forum doesnt quite clear it up for me so I just wanted clarification? Many thanks

Just an update just sending my prelim approach off as I wanted to get totally clued up with the laws and everything, plus had few problems also in the mean time with my business! I shall keep you updated in due course!

I had a settlement offer now of £586 so I will be oviously asking for more, but obviously need to make sure what I am doing next is correct. But just as a note with my settlement offer I was giving an envelope which is addressed to Carol Stokes, The Manager, Corporate Accounts (South), Alliance & Leicester Commercial Bank, Bootle, GIR 0AA

can somebody please point me in the direction of a letter for the stage after prelim that rejects offers and would still like to pursue for the full amount! Also can I add fees I have had since the charges were originally sent and also is this when I add the interest onto the case? Thanks in advance

can somebody please confirm that when sending my lba do i mention the offer in the letter that I wish to reject and also just add a line to say that there have been extra charges since the last correspondance and they have been added to the list of charges making then new sum xyz??

if you go to FAQ and step by step instructions - and the template libarary there are rejection letters (6 in all) to use at each stage .You cana djust them to your own needs ( but not too much they are tried and tested!)

 

Also do a search on Michael Browne threads - everything you need is there.

 

As far as I am aware you can change the schedule of charges right up to the time you file - I would just make it clear exactly what the changes are / keep copies of everything and obviously send by recorded/special delivery.

just stick to the timetable in the FAQ - and if they both happen at the same time then so be it.

 

Dont forget to read ahead - not just the stage you are at - as if you reject you have to be prepared to go all the way.

Actually its letter 1 with amendments. If they have not sent a cheque, take tat part out and fill in amend the parts in red to be relevant to you

You can also add to it the additional charges.

You note that since your original claim of ****** that they ( the bank ) have added additional charges to your account, you are therefore addding that amount of ***** to your claim. or something like that

Then amend totals.

 

What spreadsheet did you use to calculate your charges ?

i used the basic excel english template from the source list on the main page is that ok?

 

yes that should be fine, i think it lists the charges and descriptions on it which is what you need.

Dont forget to put the new charges on there as well

 

You can also add to the letter, that should any further charges be levied to your account, you will be adding them to your claim should they not reply with a satisfactory response (use your own words for that)

 

As Jansus correctly said, keep reading up and staying well ahead of the game, then you know what is coming next, no nasty shocks

got the same offer again from A&L yesterday so its LBA time. Just going to read up on MCOL before I send my letter though as I only have 7 days don't I if I stick to my time line! Can anybody suggest key areas that I should be especially aware off for claiming off a business account when it comes to MCOL.
